Necessity Never Made A Good Bargain: When Consumer Arbitration Agreements Prohibit Class Relief, Thomas V. Burch Jul 2004

Necessity Never Made A Good Bargain: When Consumer Arbitration Agreements Prohibit Class Relief, Thomas V. Burch

Scholarly Works

The American system of arbitration is constantly evolving. From the first formal arbitration tribunal in 1786—established by the New York Chamber of Commerce—to the creation of the Federal Arbitration Act in 1925—passed to suppress judicial hostility towards arbitration -- the system has continuously adapted to accommodate changing business practices and rising judicial concerns over the legitimacy of the institution. In fact, the system’s adaptation has been so effective that the Supreme Court now recognizes a “national policy favoring arbitration.” This “national policy” is the most recent phase of the arbitration evolution, and it raises several concerns. Most significantly, lower courts …

Gene expression profiling of diffuse large B-cell lymphoma (DLBCL) has revealed prognostically important subgroups: germinal center B-cell-like (GCB) DLBCL, activated B cell-like (ABC) DLBCL, and primary mediastinal large B-cell lymphoma. The t(14;18)(q32;q21) has been reported previously to define a unique subset within the GCB-DLBCL. We evaluated for the translocation in 141 cases of DLBCL that were successfully gene expression profiled. Using a dual-probe fluorescence in situ hybridization assay, we detected the t(14;18) in 17% of DLBCLs and in 34% of the GCB subgroup which contained the vast majority of positive cases. In addition, 12 t(14;18)-positive cases detected by polymerase chain …

Is Atkins The Antithesis Or Apotheosis Of Anti-Discrimination Principles? Sorting Out The Groupwide Effects Of Exempting People With Mental Retardation From The Death Penalty, Christopher Slobogin Jul 2004

Is Atkins The Antithesis Or Apotheosis Of Anti-Discrimination Principles? Sorting Out The Groupwide Effects Of Exempting People With Mental Retardation From The Death Penalty, Christopher Slobogin

Vanderbilt Law School Faculty Publications

In "Atkins v. Virginia", the U.S. Supreme Court held that people with mental retardation may not be executed. z Many advocates for people with disability cheered the decision, because it provides a group of disabled people with protection from the harshest punishment imposed by our society. But other disability advocates were dismayed by "Atkins", not because they are fans of the death penalty, but because they believe that declaring disabled people ineligible for a punishment that is accorded all others denigrates disabled people as something less than human. If people with disability are to be treated equally, these dissenters suggest, …

Energy-Landscape-Model Analysis For Irreversibility And Its Pulse-Width Dependence In Cells Subjected To A High-Intensity Ultrashort Electric Pulse, R. P. Joshi, Q. Hu, Karl H. Schoenbach, Stephen J. Beebe Jul 2004

Energy-Landscape-Model Analysis For Irreversibility And Its Pulse-Width Dependence In Cells Subjected To A High-Intensity Ultrashort Electric Pulse, R. P. Joshi, Q. Hu, Karl H. Schoenbach, Stephen J. Beebe

Bioelectrics Publications

We provide a simple, but physical analysis for cell irreversibility and apoptosis in response to an ultrashort (nanosecond), high-intensity electric pulse. Our approach is based on an energy landscape model for determining the temporal evolution of the configurational probability function p(q). The primary focus is on obtaining qualitative predictions of a pulse width dependence to apoptotic cell irreversibility that has been observed experimentally. The analysis couples a distributed electrical model for current flow with the Smoluchowski equation to provide self-consistent, time-dependent transmembrane voltages. The model captures the essence of the experimentally observed pulse-width dependence, and provides a possible physical picture …

Evidence That Catalytically-Inactivated Thrombin Forms Dimers That Bridge Between Fibrin/Fibrinogen Fibers And Enhance Polymerization, Michael W. Mosesson, Irene Hernandez, Kevin R. Siebenlist Jul 2004

Evidence That Catalytically-Inactivated Thrombin Forms Dimers That Bridge Between Fibrin/Fibrinogen Fibers And Enhance Polymerization, Michael W. Mosesson, Irene Hernandez, Kevin R. Siebenlist

Biomedical Sciences Faculty Research and Publications

Phe-pro-arg-chloromethyl ketone-inhibited α-thrombin [FPRα-thr] retains its fibrinogen recognition site (exosite 1), augments fibrin/fibrinogen [fibrin(ogen)] polymerization, and increases the incorporation of fibrin into clots. There are two ‘low-affinity’ thrombin-binding sites in each central E domain of fibrin, plus a non-substrate ‘high affinity’ γ′ chain thrombin-binding site on heterodimeric ‘fibrin(ogen) 2’ molecules (γA,γ′). ‘Fibrin(ogen) 1’ (γA, γA) containing only low-affinity thrombin-binding sites, showed concentration-dependent FPRα-thr enhancement of polymerization, thus indicating that low-affinity sites are sufficient for enhancing polymerization. FPRγ-thr, whose exosite 1 is non-functional, did not enhance polymerization of either fibrin(ogen)s 1 or 2 and DNA aptamer …

Linking Session Focus To Treatment Outcome In Evidence-Based Treatments For Adolescent Substance Abuse, Aaron Hogue, Howard A. Liddle, Sarah Dauber, Jessica Samuolis Jul 2004

Linking Session Focus To Treatment Outcome In Evidence-Based Treatments For Adolescent Substance Abuse, Aaron Hogue, Howard A. Liddle, Sarah Dauber, Jessica Samuolis

Psychology Faculty Publications

The relation between specific therapy techniques and treatment outcome was examined for 2 empirically supported treatments for adolescent substance abuse: individual cognitive–behavioral therapy and multidimensional family therapy. Participants were 51 inner-city, substance-abusing adolescents receiving outpatient psychotherapy within a larger randomized trial. One session per case was evaluated using a 17-item observational measure of model-specific techniques and therapeutic foci. Exploratory factor analysis identified 2 subscales, Adolescent Focus and Family Focus, with strong interrater reliability and internal consistency. Process–outcome analyses revealed that family focus, but not adolescent focus, predicted posttreatment improvement in drug use, externalizing symptoms, and internalizing symptoms within both study …

Making Lawyers Compete, Lester Brickman Jul 2004

Making Lawyers Compete, Lester Brickman

Articles

The article argues that the market for contingent-fee-financed tort litigation is not price competitive, primarily due to uniform contingency fees charged by lawyers regardless of case-specific factors such as risk or effort required. This lack of competition leads to excessive costs for claimants and contributes to the expansion of tort liability. The author contends that the legal profession maintains this system through various barriers, including ethical rules and entry restrictions, which prevent competitive market forces from functioning effectively.

Regarding Historic Preservation: Historic Neighborhood Preservation Associations And Success, Brian W. Kenny Jul 2004

Regarding Historic Preservation: Historic Neighborhood Preservation Associations And Success, Brian W. Kenny

Student Scholarship

In spring 2004, residents of historic districts in Phoenix described how they achieve historic preservation success, which factors account for success, and why some designated districts seem to achieve more success than others do. Interview transcripts were parsed through ATLAS/ti qualitative analysis software. Subsequently, a theoretical model was conceptualized and sketched. Success in neighborhood historic preservation — how residents achieve successful historic preservation outcomes — remains an important question that hold potential for redirecting the focus of professional preservation managers. Such questions also provide neighborhood preservationists with opportunities to weigh methods for working more closely with their best ‘worthy opponents.’

Holding Internet Service Providers Accountable, Douglas Gary Lichtman, Eric A. Posner

Coase-Sandor Institute for Law & Economics Research Paper Series

Internet service providers are today largely immune from liability for their role in the creation and propagation of worms, viruses, and other forms of malicious computer code. In this Essay, we question that state of affairs. Our purpose is not to weigh in on the details—for example, whether liability should sound in negligence or strict liability, or whether liability is in this instance best implemented by statute or via gradual common law development. Rather, our aim is to challenge the recent trend in the courts and Congress away from liability and toward complete immunity for Internet service providers. In our …
