USF Tampa Graduate Theses and Dissertations
This study translated, cross-culturally adapted and validated an instrument's scores for use in public high schools in San Salvador, El Salvador. The original instrument consisted of items developed by the Centers for Disease Control and Prevention (CDC) to assess HIV/AIDS knowledge and five dimensions of attitudes (Abstinence, Peer-pressure, Condom use, Drug use, and Threat of HIV) in grades 7 to 12 in the United States. Items were translated into Spanish using the back-translation method. The instrument was cross-culturally adapted using guidelines proposed by Guillemin, Bombardier, and Beaton (1993). A cross-culturally equivalent version of the original instrument was obtained using three …
The Jurisdiction Of Justice: Two Conceptions Of Political Morality, Larry Alexander
The Jurisdiction Of Justice: Two Conceptions Of Political Morality, Larry Alexander
San Diego Law Review
My topic in this essay is a major fault line within normative theory. More precisely, it is a major fault line within that part of a normative theory that deals with the content of our moral obligations to others. When I refer to moral obligations here, I am referring to those acts that morality demands of us such that it permits force or its threat to be employed to secure those acts. Moral obligations as I use the term are thus candidates for legal enforcement. I argue that much of what is debated within liberal political/moral theory can be usefully …
Toward Reasonable Limitations On The Exercise Of General Jurisdiction, Walter W. Heiser
Toward Reasonable Limitations On The Exercise Of General Jurisdiction, Walter W. Heiser
San Diego Law Review
General jurisdiction is one of the most controversial aspects of the current jurisprudence of personal jurisdictions. General jurisdiction refers to a state's exercise of personal jurisdiction over a nonresident defendant in a lawsuit not arising out of or related to the defendant's contacts with the forum. General jurisdiction is particularly controversial in international litigation involving foreign defendants who do business in the United States. This article examines the potential limitations on the exercise of general jurisdiction in the context of international civil litigation.

Mental Disorder And The Civil/Criminal Distinction, Grant H. Morris
Mental Disorder And The Civil/Criminal Distinction, Grant H. Morris
San Diego Law Review
This essay, written as part of a symposium issue to commemorate the 50th anniversary of the University of San Diego Law School, discusses the evaporating distinction between sentence-serving convicts and mentally disordered nonconvicts who are involved in, or who were involved in, the criminal process–people we label as both bad and mad. By examining one Supreme Court case from each of the decades that follow the opening of the University of San Diego School of Law, the essay demonstrates how the promise that nonconvict mentally disordered persons would be treated equally with other civilly committed mental patients was made and …
An Enterprise (No-Fault) Liability Suitable For Judicial Adoption - With A "Draft Judicial Opinion", Virginia E. Nolan, Edmund Ursin
An Enterprise (No-Fault) Liability Suitable For Judicial Adoption - With A "Draft Judicial Opinion", Virginia E. Nolan, Edmund Ursin
San Diego Law Review
In this Article, the authors propose that courts recognize an enterprise liability applicable to persons injured on the premises of supermarkets. In contrast to strict products liability, victim compensation under their proposal would not turn on whether the supermarket's premises could be characterized as dangerously defective. Instead, the proposed doctrine would impose a strict enterprise liability for personal injuries arising out of the use of the supermarket's premises by entrants on those premises. The resulting doctrine would avoid the intractable - and litigation producing - defect problem, while holding down costs - and litigation - by limiting recoverable damages.

We tested the hypothesis that glucose-insulin-potassium (GIK)-induced protection against myocardial infarction depends on ATP-dependent K+ (KATP) channel activation and is abolished by hyperglycemia before the ischemia. Dogs were subjected to a 60-min coronary artery occlusion and 3-h reperfusion in the absence or presence of GIK (25% dextrose; 50 IU insulin/l; 80 mM/l KCl infused at 1.5 ml·kg−1·h−1) beginning 75 min before coronary artery occlusion or 5 min before reperfusion. The role of KATP channels was evaluated by pretreatment with glyburide (0.1 mg/kg). The efficacy of GIK was investigated with increases in blood …

Video Surveillance, Evidence And Pipeda: A Comment On Ferenszy V. Mci Medical Clinic, Anne Uteck
Canadian Journal of Law and Technology
One of the most common uses of surveillance is in the area of evidence gathering for investigation by litigators. Private investigators have long been retained for this purpose, and law enforcement officers routinely utilize surveillance devices to assist in the prosecution of a crime. The admissibility of video surveillance evidence obtained by private and government investigators is obviously not a new issue. What has come to the fore- front is the application of the Personal Information Protection and Electronic Documents Act in the context of video surveillance evidence, and its impact on civil litigators. Privacy interests inherent in the collection, …

Bias In Perceptions Of Parenting Roles: Analysis Of Gender And Socioeconomic Status, Krislea E. Wegner
Bias In Perceptions Of Parenting Roles: Analysis Of Gender And Socioeconomic Status, Krislea E. Wegner
Theses and Dissertations
After industrialization in the United States, men primarily moved from the farm to the workplace, leaving women responsible for the children and maintaining the household alone. This arrangement contributed to the so called "tender years" doctrine, which suggested that mothers were better caretakers of the children and should therefore receive sole custody. The preference for mothers continued until the 1960's, after the women's liberation movement, when a large portion of women moved from the home into the workforce. State statutes were later changed to establish gender-neutrality for the purposes of determining custody decisions and suggested the custody of children should …

Cons, Ex-Cons And Odinism Across Cultural And National Borders: Why Attempt To Procure Knowledge And Dare We Not?, Lene T. Vallestad
Theses and Dissertations
The occurrence of right-wing extremism is becoming more prominent in the social landscape of Western European countries, including Norway, and in the United States. Amongst these movements one will find groups that base and justify their racist behavior in religious beliefs. Odinism, a pre-Christian, Norse neopagan faith, has merged racist beliefs and violent behavior with religious creed and ideology, and is a prime example of these right-wing religions.
During the 1990s Odinism emerged as one of the most dynamic trends within the extreme right-wing milieu in the U.S. and Western Europe. The popularity of Odinism today is connected to the …

Perceptions Of Domestic Violence In Lesbian Relationships: Stereotypes And Gender Role Expectations, Betsi M. Little
Theses and Dissertations
In light of evidence suggesting that violence between lesbian couples is often times dismissed as “mutually combative,” expectations that support this perception were examined in the present study. T"> this end, undergraduate participants (N = 287) read a newspaper brief describing an incident of domestic violence taking place within the context of a lesbian partnership. As gender-based stereotypes guide not only expectations for the behavior of lesbians, but their appearance as well, participants were shown pictures of both the alleged victim and accused that varied in terms of how feminine or masculine they appeared.
Participants were randomly assigned to one …

However, a substantial correlation occurred between the post-test attitude and knowledge scores, indicating that as students' knowledge increased, their attitudes towards wildlife and environmental education became …
Local And Regional Impairment Of Fish Assemblages In A Mined Appalachian Watershed, Jason Gregory Freund
Local And Regional Impairment Of Fish Assemblages In A Mined Appalachian Watershed, Jason Gregory Freund
Graduate Theses, Dissertations, and Problem Reports (ETD)
I used the Cheat River watershed, West Virginia, as a model system to examine the regional impacts of extensive localized stream impairment. Acid mine drainage (AMD) in the Cheat River watershed provided a unique opportunity to test the hypothesis that regional biological condition can be impacted through multiple local sources of degradation. Acid mine drainage is the result of the interaction among pyrite-rich coal, oxygen, and water. This interaction produces a solution that is generally low in pH and buffering capacity and high in heavy metals and sulfate and is toxic to aquatic life. Acid mine drainage also has the …
