A Review Of The Americans With Disabilities Act: Accent On Employment Decisions, Gloria Fernandez-Vanzante, Neal Vanzante

Mountain Plains Journal of Business and Technology

This article focuses on Title I of the Americans with Disabilities Act (ADA), which prohibits discrimination against any qualified individual with a disability in hiring, compensation, promotion, termination, and job opportunities. The article is intended to be a follow up to Professor Cheryl Hein’s article entitled “The Americans with Disabilities Act: Accent on Employment Decisions” that appeared in the Summer 1992 edition of the Central Business Review. The article begins with an overview of the ADA and offers a brief ten-year review of the ADA, as well as a discussion of two recent Supreme Court decisions and reactions to those …

Corporate Responsibility To Provide Work-Family Programs, Susan R. Madsen Oct 2004

Corporate Responsibility To Provide Work-Family Programs, Susan R. Madsen

Mountain Plains Journal of Business and Technology

Defining and determining the responsibility of business organizations to provide and assist employees with work-family programs and initiatives (e.g., employee assistance programs, parental leave extensions, childcare, elder care benefits, flextime, compressed workweek, and telecommuting) is a current critical issue that has ignited controversy during the past few decades. The author argues that work-family programs (at some level) should be a part of every company and should be strongly linked to employer benefits. To expand and implement work-family programs and services in companies today, she argues that training and educating business leaders about work-family options and benefits is the bestsolution. This paper …

Review Of The Children Of Africa Confront Aids Edited By Arvind Singhal And W. Stephen Howard; Ohio University Press, 2003, Sue Ann Gardner

University of Nebraska-Lincoln Libraries: Faculty Publications

This slim volume is packed full of information about the plight of children in Africa due to the AIDS crisis. It is divided into four sections-Vulnerability, Coping, Courage, and Possibility-containing not just a litany of the horrors that children in Africa face but also descriptions of attempts at solutions to the problems. The challenges that many children in Africa confront are daunting. There is widespread sexual violence and sexual coercion of children, and there is currently inadequate infrastructure in health care and nutrition, education, and social structure to deal with the problems effectively. The issue of sexual violence and coercion …

Using Wind To Power A Groundwater Circulation Well—Preliminary Results, Andrew Curtis Elmore, Ron Gallagher, K. David Drake Oct 2004

Using Wind To Power A Groundwater Circulation Well—Preliminary Results, Andrew Curtis Elmore, Ron Gallagher, K. David Drake

United States Environmental Protection Agency: Publications

In areas of the country where the U.S. Department of Energy has classified the available wind resources as Class 3 or greater, the use of wind turbines to provide power to relatively small remediation systems such as groundwater circulation wells may be technically and economically feasible. Groundwater circulation wells are a good candidate technology to couple with renewable energy, because the remediation system removes contamination from the subject aquifer with no net loss of the groundwater resource, while the wind turbine does not create potentially harmful air emissions. Wind data collected in the vicinity of the former Nebraska Ordnance Plant …

Economic Engagement: An Avenue To Employment For Individuals With Disabilities, William Kiernan, John Halliday, Heike Boeltzig

All Institute for Community Inclusion Publications

The role that employment has played for persons with disabilities over the past several decades has moved from one of no engagement in the workforce to a realization that persons with disabilities can work and are interested in working. The shrinking workforce has increased employers' interest in looking at the full range of potential workers, including those previously considered unemployable. The growing economy—coupled with the declining birth rate, the increase in technology and supports for a diverse workforce, and the increasing expectation that all persons should be provided with the opportunity to work—has led to a new view of individuals …

With the current emphasis on universal access to employment services for all members of the community, the workforce development field needs to evaluate service delivery. This technique allows organizations to collect data on the experiences of One-Stop Career Center customers from the customer perspective. The brief includes a sample shopper questionnaire.

In the winter of 1998/99, after the deaths of 16 homeless people in the streets of Boston attracted wide attention by the media, the Commissioner of the Massachusetts Department of Public Health (MDPH), Dr. Howard Koh, convened a group of I stakeholders serving the homeless street population. The goal of this MDPH Homeless Taskforce was to reduce the number of homeless people dying on the streets as well as to improve service delivery to those homeless individuals most at risk of dying. Finding Lawyers For Employees In Discrimination Disputes As A Critical Prescription For Unions To Embrace Racial Justice, Michael Z. Green Oct 2004

Finding Lawyers For Employees In Discrimination Disputes As A Critical Prescription For Unions To Embrace Racial Justice, Michael Z. Green

Faculty Scholarship

At such a crucial time in our history, major concerns exist regarding the viability of labor unions and the capability of employees to pursue racial justice in the workplace with any success. Continued improvement within both movements may depend upon finding a cohesive intersection between them. With the race and class divide affecting relations between organized labor and black workers (a dilemma which must be explored in more detail), this Article offers the thesis that there remains an area of opportunity for justice where interests of unions and black employees may coalesce: providing legal assistance to unrepresented black employees in …

Currents And Crosscurrents In The International Intellectual Property Regime, Peter K. Yu Oct 2004

Currents And Crosscurrents In The International Intellectual Property Regime, Peter K. Yu

Faculty Scholarship

Since the establishment of the TRIPs Agreement, intellectual property protection has been expanding rapidly, and many less developed countries have become dissatisfied with the international intellectual property regime. From bilateral free trade agreements to the increasing use of technological protection measures, many commentators fear that the recent "one-way ratchet" will roll back the substantive and strategic gains made by less developed countries during the negotiation of the TRIPS Agreement. Interestingly, intellectual property rightsholders feel equally threatened by the recent developments, in particular the development of the Doha Declaration, the World Summit on the Information Society, the WIPO Development Agenda, and …

Intellectual Property At A Crossroads: Why History Matters, Peter K. Yu

Faculty Scholarship

Intellectual property is at a crossroads today. As the Commission on Intellectual Property Rights noted in its final report, “[o]ver the last twenty years or so there has been an unprecedented increase in the level, scope, territorial extent and role of IP right protection.” From the rapid privatization and commodification of information to the creation of property rights in bioengineered microorganisms and lifeforms, recent developments in the intellectual property field have sparked major controversies, calling into questions our values, worldviews, and the way society protects and incentivizes human creations and innovations. To grapple with these difficult questions, courts and commentators …

Scholarly Articles in Law Reviews & Journals

INTRODUCTION: "[Y]ou are a disgusting piece of dirt."' Judge Steven Shutter, a county judge in South Florida, used these words to describe a twenty- four-year-old woman whom he labeled a terrorist and who was condemned by the media. Aside from name-calling, Judge Shutter raised the woman's bail from $3,500 to $25,000 when he learned the nature of the offense, 'just in case" the woman might be able to afford the lower bond. Given the strength of Judge Shutter's animosity toward her, one might assume that Yasmin Kassima Sealey- Doe had provided assistance to the terrorists who attacked the World Trade …

Broken Scales: Obesity And Justice In America, Adam Benforado, Jon Hanson, David Yosifon Oct 2004

Broken Scales: Obesity And Justice In America, Adam Benforado, Jon Hanson, David Yosifon

Faculty Publications

This Article is not so much about the scales we use to measure weight, but the scales we use to infer causation and assign responsibility-including the scales of justice. Ultimately, the problem we face is not obesity itself. Obesity is only a symptom of the problem. When scientists and public health experts point to various environmental agents-whether larger portion sizes, corn subsidies, video games, or urban sprawl-they, too, overlook the deeper source of our troubles. Our real problem is that we have an extremely difficult time seeing and understanding the role of unseen features in our environment and within us …
