State, Be Not Proud: A Retributivist Defense Of The Commutation Of Death Row And The Abolition Of The Death Penalty, Dan Markel Sep 2004

State, Be Not Proud: A Retributivist Defense Of The Commutation Of Death Row And The Abolition Of The Death Penalty, Dan Markel

ExpressO

In the aftermath of Governor Ryan's decision last year to commute the sentences of each offender on Illinois' death row, various scholars have claimed that Ryan’s action was a “grave injustice” and, from a retributivist perspective, “an unmitigated moral disaster.” This Article contests that position, showing not only why a commutation of death row is permitted under principles of retributive justice, but also why it might be required. When properly understood, retributive justice, in its commitment to moral accountability and equal liberty, hinges on modesty and dignity in modes of punishment. In this vein, retributivism opposes the apparently ineluctable slide …

Small Town, Granville Hicks, Warren F. Broderick Sep 2004

Small Town, Granville Hicks, Warren F. Broderick

Literature

Granville Hicks was one of America's most influential literary and social critics. Along with Malcolm Cowley, F. O. Matthiessen, Max Eastman, Alfred Kazin, and others, he shaped the cultural landscape of 20th-century America.

In 1946 Hicks published Small Town, a portrait of life in the rural crossroads of Grafton, N.Y., where he had moved after being fired from Rensselaer Polytechnic Institute for his left-wing political views. In this book, he combines a kind of hand-crafted ethnographic research with personal reflections on the qualities of small town life that were being threatened by spreading cities and suburbs. He eloquently tried to …

Highly Qualified Teachers, Sarah C. Mckenzie, Gary W. Ritter Sep 2004

Highly Qualified Teachers, Sarah C. Mckenzie, Gary W. Ritter

Policy Briefs

One of the key features of the No Child Left Behind Act (NCLB) of 2001 is a requirement that all teachers in core academic areas be “highly qualified” before the 2005-2006 school year. Even more quickly, by the end of the 2002-2003 school year, all newly hired teachers in Title I schools had to be highly qualified. The core academic areas— which must be taught by a “highly qualified” teacher—are English, reading or language arts, math, science, arts and foreign language, economics, geography, civics or government, and history. Teachers of special education and English language learner students are not required …

Masters Theses & Specialist Projects

Spatial variability of precipitation is examined over the state of Kentucky and surrounding areas. The study focuses on the analysis of monthly precipitation totals from the period of 1961-2000. The purpose of the study is to develop a set of indices to represent the spatial variability of the study area for a given month. Various exploratory data analysis methods such as variography, kriging, and cluster analysis were used. The study attempts to quantify the second order (local) effects of the spatial variation of precipitation as a means to provide insight into the prediction of precipitation randomness. This task can be …
