My purpose for writing this commentary is to reflect on how one teacher attempted to utilize the philosophies and practices of Paolo Freire, Augusto Boal, and Myles Horton in a graduate level, educational foundations classroom. I take as my premise the view that pedagogical practice is political and that the processes of studying and changing practice are also political (Kemmis and McTaggart, 2000). Less As More: Rethinking Supernational Litigation Of Economic And Social Rights In The Americas, James L. Cavallaro, Emily J. Schaffer

Over the last few decades, scholars and activists have attacked the conceptual division of human rights into justiciable civil and political rights on the one hand, and largely non-justiciable economic, social and cultural rights on the other. Academics and practitioners have defended the extension of supranational judicial oversight to individual instances of economic and social rights abuse, on the premise that international litigation of these rights would promote their recognition in practice. California's experiment with electricity deregulation is the most recent example of the State's willingness to be an energy policy maverick. Rolling blackouts and expensive long-term contracts are some of the constant reminders of this failed experiment. But another dramatic legacy of deregulation, one which is littleknown beyond inside players in regulation and industry, relates to the planning and licensing of California's system of highpower transmission lines. Thousands of miles of copper and steel wires supply families and businesses with the electricity they need to light their homes, water their crops, and manufacture their silicon chips. The efficacy of direct democracy throughout California's history continues to be a subject of intense debate, a state-wide phenomenon with an international audience. California boasts the world's fifth largest economy, and plays a leadership role in national, and sometimes even international, politics. British scholar Wyn Grant, studying the politics of air quality management in California, succinctly sums up the burning issue for environmentalists worldwide who are striving to understand the efficacy of California's activists' efforts: in "Direct Democracy in California: Example or Warning?" Who Is An Environmentalist? The Polysemy Of Environmentalist Terms And Correlated Environmental Actions, Danielle Tesch, Willett Kempton

Journal of Ecological Anthropology

Conducting and interpreting an interview is more problematic when informants use a word that has multiple meanings and interpretations. In this case, the problematic word, “environmentalist,” labeled several socially-defined identities that were central to the study. The analysis is based on interviews with 156 members of 20 diverse environmental groups (and two comparison groups) in the Eastern United States, including their views on environmentalists, their history with the movement, their self-identification as an environmentalist, and their environmental actions. From these data, principles of classification and naming are used to distinguish the multiple meanings of the identity “environmentalist.” We found that …

Small businesses face many challenges as they strive toward growth and profitability. Adding to this challenge is the demand for improved environmental performance. Pollution prevention is often the most cost effective way to improve environmental performance. Yet, small firms often lack the expertise they need to pursue pollution prevention opportunities. There are a number of state agencies in New York that provide assistance and funding to small businesses to implement pollution prevention strategies. The title of this Essay, "Judging Environmental Law," evokes several different themes. On the one hand, the title presents an occasion to discuss the role of judges in environmental law. On the other hand, it offers an opportunity to judge environmental law itself: whether environmental law is guilty, as charged by some in industry, of overreaching in its regulatory requirements; or, whether environmental law is instead guilty, as charged by some environmentalists, of underreaching, by failing to address pressing pollution control and natural resource management concerns. Environmental Equity: Gradient Measures Of Race And Social Class In The Areas Surrounding Pennsylvania Superfund Sites, Mark A. Jablonski

Electronic Theses and Dissertations

This study examines the socioeconomic and racial characteristics of the areas surrounding the 120 National Priority List Superfund hazardous waste sites in the Commonwealth of Pennsylvania. Using three distinct concentric distance measures, the study uses 1990 census tract data to determine whether Nonwhite and low-income populations live in closest proximity to Pennsylvania's most toxic sites and consequently bear the brunt of the negative externalities associated with having Superfund sites nearby. The results of the study suggest that environmental inequities are not prevalent in the areas surrounding Pennsylvania Superfund sites. Rather, the areas between 1.667 and 3.333 miles away from the …

Foucault's Approach To Power: Its Allure And Limits For Collaborative Lawyering, Ascanio Piomelli

This Article examines the considerable influence that French philosopher Michel Foucault's conceptualization of power has had on U.S. theorists of lawyering for social change. Led by Professors Gerald L6pez of New York University and Lucie White of Harvard, a substantial literature has emerged in the past two decades urging progressive lawyers to reshape their lawyering practices to collaborate more closely with clients and community groups. Proponents of this model of activist law practice have often invoked Foucault and acknowledged that his ideas about power underlie and inform their visions of lawyering.
