Court Delay In Developing Countries With Special References To China, Qing-Yun Jiang Dec 2004

Court Delay In Developing Countries With Special References To China, Qing-Yun Jiang

German Working Papers in Law and Economics

The judiciary in developing countries is troubled with various problems. Specifically, court delays, backlogs and uncertainty associated with unexpected outcomes have diminished the quality of justice and leads to loss of confidence of the general public in judiciary. Court delay is always coupled with impartiality, corruption and low quality of judgment, etc. The reform program needs to address the major causes of the deterioration in the quality of court services and address the root political, economic causes of an inefficient and inequitable judiciary and not simply deal with its symptoms. Like many other judiciaries in developing countries, court delay is …

The Normativity Of Law In Law And Economics, Péter Cserne Dec 2004

The Normativity Of Law In Law And Economics, Péter Cserne

German Working Papers in Law and Economics

The Normativity of Law in Law and Economics Péter Cserne* 1. Introduction This paper is about some theoretical and methodological problems of law and economics (economic analysis of law, EAL). More specifically, I will use game theoretical insights to answer the question, relevant both for law and economics and legal philosophy, how should a social scientific analysis of law account for the normativity of law (the non-instrumental reasons for rule-following) while retaining the observer’s (explanatory or descriptive) perspective. The goal is to offer a constructive critique of both traditional law and economics scholarship and mainstream analytical legal philosophy (the “Jurisprudence …

Recht, Eigentum Und Effizienz: Zu F. A. V. Hayeks Verfassung Der Freiheit*, Dieter Schmidtchen Dec 2004

Recht, Eigentum Und Effizienz: Zu F. A. V. Hayeks Verfassung Der Freiheit*, Dieter Schmidtchen

German Working Papers in Law and Economics

Ein solches findet sich erstmals in Hayeks zweitem großen Werk „The Constitution of Liberty“ (1960), welches aber immer noch wichtige Fragen unbeantwortet ließ: „The first result of the efforts of explaining the nature of an order of freedom was a substantial …

The Quandary Of Serving Multiple Masters: An Institutional Exploratory Analysis Of Publishing In Business Law, Robert S. Rubin, John R. Olson, Laura Hartman, James A. Belohlav Dec 2004

The Quandary Of Serving Multiple Masters: An Institutional Exploratory Analysis Of Publishing In Business Law, Robert S. Rubin, John R. Olson, Laura Hartman, James A. Belohlav

ExpressO

Notwithstanding published articles on the nature and quality of research and scholarship in practically every other business discipline, to date there has been little systematic evaluation of relevant journals in the business law discipline. This deficiency is due, in part, to the fact that business law may still be described as a developing discipline. Thus, the focus of this article is on delineating the nature of research and scholarship within the business law discipline. Specifically, the publishing practices of business law faculty from academic institutions that were members of the Association to Advance Collegiate Schools of Business (AACSB International), the …

The Educational Roots Of Reformed Scholasticism: Dialectic And Scriptural Exegesis In The Sixteenth Century, Amy Nelson Burnett Dec 2004

The Educational Roots Of Reformed Scholasticism: Dialectic And Scriptural Exegesis In The Sixteenth Century, Amy Nelson Burnett

Department of History: Faculty Publications

Over the last twenty years research on later sixteenth- and seventeenth-century theology has led to a reappraisal or Protestant scholasticism and its relation to the Reformation. Earlier historians of doctrine viewed Protestant scholasticism as overly rationalistic at the expense of Reformation biblicism, heavily dependent on Aristotelian philosophy, and organized around a central doctrine such as predestination. The current consensus is that Protestant scholasticism reflected the Orthodox theologians’ deep familiarity with and commitment to the scriptural text; that if it did appropriate Aristotle, such appropriation was eclectic rather than slavish; and that the idea of a central dogma organizing all of …

Equity And Adequacy: A Funding Crisis In The Tennessee Education System., Scott F. Collins Dec 2004

Equity And Adequacy: A Funding Crisis In The Tennessee Education System., Scott F. Collins

Electronic Theses and Dissertations

Tennessee is experiencing a budget crisis related to the dollar amount per-pupil expended on kindergarten- through 12th-grade education when compared to other states. Public schools across America are operating in a time of increased expectations. Recent legislative initiatives at both the state and federal level have created new systems of testing and performance standards that will hold schools and teachers accountable for students' achievement. Given the rapid changes that are being made, many state policymakers have noted the importance of designing better financial schemes for public schools with sufficient resources to meet the demand for better education; however, funding and …

Resorts In Southern Appalachia: A Microcosm Of American Resorts In The Nineteenth And Early Twentieth Centuries., Mary F. Fanslow Dec 2004

Resorts In Southern Appalachia: A Microcosm Of American Resorts In The Nineteenth And Early Twentieth Centuries., Mary F. Fanslow

Electronic Theses and Dissertations

Five resorts in East Tennessee--Montvale Springs and the Wonderland Hotel in the Smokies, Tate Spring in the Holston River Valley, Unaka Springs on the Nolichucky River, and the Cloudland Hotel at the summit of Roan Mountain--stand testament to the proposition that their region engaged fully with areas outside southern Appalachia. Their origins, clientele, and health and leisure offerings followed those of other resorts of the same time period. Moreover, the effects of national socioeconomic trends on the hotels serve as a contradiction to the stereotype of southern Appalachia as an isolated region barricaded from the outside world by mountainous topography. …

Justice For All?: Victim Satisfaction With Restorative Justice Conferences., Sarah Anne Behtz Dec 2004

Justice For All?: Victim Satisfaction With Restorative Justice Conferences., Sarah Anne Behtz

Electronic Theses and Dissertations

While the process of restorative justice is fairly new, several programs have been implemented globally and found to be effective in various aspects over the past 30 years. Very little empirical research has been gathered from these global programs though members of the criminal justice community as well as members of the general public have expressed interest in learning more about the programs and effectiveness and opinions of the programs. This study takes a closer look at what victims have expressed as being important to them regarding the criminal justice system, and satisfaction with how their cases are handled in …

A Bayesian Technique For Task Localization In Multiple Goal Markov Decision Processes, James Carroll, Kevin Seppi Dec 2004

A Bayesian Technique For Task Localization In Multiple Goal Markov Decision Processes, James Carroll, Kevin Seppi

Faculty Publications

In a reinforcement learning task library system for Multiple Goal Markov Decision Process (MGMDP), localization in the task space allows the agent to determine whether a given task is already in its library in order to exploit previously learned experience. Task localization in MGMDPs can be accomplished through a Bayesian approach, however a trivial approach fails when the rewards are not distributed normally. This can be overcome through our Bayesian Task Localization Technique (BTLT).

Requirement Elicitation Of Large Web Projects., David E. Frazier Dec 2004

Requirement Elicitation Of Large Web Projects., David E. Frazier

Electronic Theses and Dissertations

One of the most important aspects of developing a large Web-based project is getting the correct requirements from the client. Time and money can be lost if the requirements are incomplete or inaccurate. Traditional Web design sources tend to gloss over this important activity.

Software engineering is a mature field that can help in the quest for more complete and accurate requirement gathering. This paper explores the ways that traditional software engineering techniques can be applied to Web projects. A methodology is presented based on both existing and new techniques. Several experiments are conducted to determine the usefulness of each …

Eocene Circulation Of The Southern Ocean: Was Antarctica Kept Warm By Subtropical Waters?, Matthew Huber, Henk Brinkhuis, Catherine E. Stickley, Kristofer Döös, Appy Sluijs Dec 2004

Eocene Circulation Of The Southern Ocean: Was Antarctica Kept Warm By Subtropical Waters?, Matthew Huber, Henk Brinkhuis, Catherine E. Stickley, Kristofer Döös, Appy Sluijs

Department of Earth, Atmospheric, and Planetary Sciences Faculty Publications

Near the Eocene's close (∼34 million years ago), the climate system underwent one of the largest shifts in Earth's history: Antarctic terrestrial ice sheets suddenly grew and ocean productivity patterns changed. Previous studies conjectured that poleward penetration of warm, subtropical currents, the East Australian Current (EAC) in particular, caused Eocene Antarctic warmth. Late Eocene opening of an ocean gateway between Australia and Antarctica was conjectured to have disrupted the EAC, cooled Antarctica, and allowed ice sheets to develop. Here we reconstruct Eocene paleoceanographic circulation in the Tasmanian region, using (1) biogeographical distributions of phytoplankton, including data from recently drilled Ocean …

Use Of The Sreb Leadership Development Framework In Preservice Principal Preparation Programs: A Qualitative Investigation., Robert C. Vick Dec 2004

Use Of The Sreb Leadership Development Framework In Preservice Principal Preparation Programs: A Qualitative Investigation., Robert C. Vick

Electronic Theses and Dissertations

Although nearly everyone agrees that principals need formal training to prepare for their positions, few agree on what the nature of this training should be. Advanced university education may teach examples of leadership behaviors, but is it likely to transmit the practical knowledge and behaviors that are the hallmarks of successful principals?

This study focused on the 13 critical success factors for school leaders as created by the Southern Regional Education Board (SREB, 2002). The purpose of the study was to identify the extent to which these 13 standards have been addressed in formal and informal development training experiences of …

The purpose of this research project was to replicate, refine, and extend research by Zinser et al. (in press) of the site-name, associative memory of male and female college students of nearby to very distant geographic sites. A test booklet included eight schematic aerial maps. The maps were of 20 to 50 geographic sites participants attempted to match with their names. The number of campus buildings, campus city sites, regional cities, U.S. cities, U.S. states, world cities, world countries, and world continents/bodies of water matched correctly were determined. A demographic questionnaire was also presented. Overall, men performed significantly better than …

Investigation Of The Relationship Between A Job-Embedded Model Of Professional Development And Reading Achievement Of Elementary School Students., Janet Faulk Dec 2004

Investigation Of The Relationship Between A Job-Embedded Model Of Professional Development And Reading Achievement Of Elementary School Students., Janet Faulk

Electronic Theses and Dissertations

The development of highly effective teachers is of interest to school systems because the quality of the teachers is associated with students' success. This study explored the relationship between teachers' participation in a job-embedded model of professional development and students' achievement in reading.

Teachers in the third grade and fifth grade at five different elementary schools received more than 100 hours of training. The reading achievement scores of students assigned to these teachers were compared to the scores of students whose teachers did not participate in the training. Findings in this study were mixed. Fifth-grade students whose teachers participated in …

This study examined the use of historical names vs. corporate names of stadiums by newspapers in Major League Baseball game stories. The study includes a sample of stories from seven major league teams from the first season that each team played in a corporate-named stadium after playing the preceding year in a historically-named park. A content analysis of 725 newspaper articles was performed. The hypotheses and exploratory questions tested the frequency of use comparing the corporate name to the historical name and also examined where in the sports section the names were appearing and where the names were being used …

Kinetics And Mechanism Of The Catalysis Of The Decomposition Of Hydrogen Peroxide By Schiff Base Complexes Of Copper(Ii)., Timothy Kum Beng Dec 2004

Kinetics And Mechanism Of The Catalysis Of The Decomposition Of Hydrogen Peroxide By Schiff Base Complexes Of Copper(Ii)., Timothy Kum Beng

Electronic Theses and Dissertations

Spectroscopic studies have been used to describe the mechanism of the decomposition of hydrogen peroxide by solutions of a dimeric Cu(II) complex of a dissymetric Schiff base, [CuSALAD]2.H2O, and imidazole or methyl substituted imidazoles, B, which form monomeric CuSALAD.B2 complexes, in aqueous ethanol solvent. Freezing point depression and vapor pressure lowering studies were carried out to confirm the dimeric nature of the [CuSALAD]2.H2O complex that had been previously reported. The stoichiometry of the [CuSALAD]2.H2O-imidazole equilibrium was extensively studied pointing to a 1:4 stoichiometry. The CuSALAD.B2 adducts …

Role Of Macrophage Apoptosis In Atherosclerosis., June Liu Dec 2004

Role Of Macrophage Apoptosis In Atherosclerosis., June Liu

Electronic Theses and Dissertations

The presence of apoptotic cells in atherosclerotic lesions has been broadly reported in the past ten years. The majority of these apoptotic cells are macrophages. However, the pathogenic role of macrophage apoptosis in the development of atherosclerosis remains to be elucidated. Elevated expression of Bax, one of the pivotal pro-apoptotic proteins of the Bcl-2 family, has been found in human atherosclerotic plaques. Activation of Bax also occurs in free cholesterol-loaded and oxysterol treated mouse macrophages. In this study, we evaluated the influence of Bax deficiency on apoptosis in macrophage-like P388D1 cells by using small interfering RNA (siRNA) to suppress Bax …

Variable Resolution Discretization In The Joint Space, Christopher K. Monson, Kevin Seppi, David Wingate, Todd S. Peterson

Faculty Publications

We present JoSTLe, an algorithm that performs value iteration on control problems with continuous actions, allowing this useful reinforcement learning technique to be applied to problems where a priori action discretization is inadequate. The algorithm is an extension of a variable resolution technique that works for problems with continuous states and discrete actions. Results are given that indicate that JoSTLe is a promising step toward reinforcement learning in a fully continuous domain.
