How Do German Contracts Do As Much With Fewer Words?, Claire A. Hill, Christopher King
How Do German Contracts Do As Much With Fewer Words?, Claire A. Hill, Christopher King
Chicago-Kent Law Review
German business contracts are much shorter than their American counterparts. They also avoid the worst excesses of legalese that American contracts are known for. But they seem to work as well as United States contracts. We seek to understand how German business contracts could do as much with fewer words. Our explanation is predicated on an account of what contracting does. Contracting aims to create a bigger transactional pie in a world where parties' incentives are misaligned and they need to coordinate the production of information, specify future rights, duties and procedures, and allocate risks. The task of contracting thus …

Assessment Of A Body Composition-Focused Approach To Obesity Treatment, Beverly D. Hall
Assessment Of A Body Composition-Focused Approach To Obesity Treatment, Beverly D. Hall
Loma Linda University Electronic Theses, Dissertations & Projects
Obesity is a significant United States’ public health concern. However, high relapse rates continue to be a problem for obesity treatment programs while the focus remains on weight loss, not body composition change. This study examined whether a clinic-based obesity treatment program, focused on body composition change through resistance training, lead to improved body composition, exercise behaviors, and attitude change from focus on weight loss to body composition change. Improvements in self efficacy, outcome expectations and stages of change were also examined. Forty-eight physician-referred overweight or obese adult women (mean body fat 41%, SD = 6.65%), completed assessments and questionnaires …

Mercer Kernels For Object Recognition With Local Features, Siwei Lyu
Mercer Kernels For Object Recognition With Local Features, Siwei Lyu
Computer Science Technical Reports
In this paper, we propose a new class of kernels for object recognition based on local image feature representations. Formal proofs are given to show that these kernels satisfy the Mercer condition and reflect similarities between sets of local features. In addition, multiple types of local features and semilocal constraints are incorporated to reduce mismatches between local features, thus further improve the classification performance. Experimental results of SVM classifiers coupled with the proposed kernels are reported on ecognition tasks with the standard COIL-100 database and compared with existing methods. The proposed kernels achieved satisfactory performance and were robust to changes …
Efficient Wait-Free Implementation Of Multiword Ll/Sc Variables, Prasad Jayanti, Srdjan Petrovic
Efficient Wait-Free Implementation Of Multiword Ll/Sc Variables, Prasad Jayanti, Srdjan Petrovic
Computer Science Technical Reports
Since the design of lock-free data structures often poses a formidable intellectual challenge, researchers are constantly in search of abstractions and primitives that simplify this design. The multiword LL/SC object is such a primitive: many existing algorithms are based on this primitive, including the nonblocking and wait-free universal constructions of Anderson and Moir (1995), the closed objects construction of Chandra et al.(1998) and the snapshot algorithms of Jayanti (2002, 2004). In this paper, we consider the problem of implementing a W-word LL/SC object shared by N processes. The previous best algorithm, due to Anderson and Moir (1995), is time optimal …
Automatic Image Orientation Determination With Natural Image Statistics, Siwei Lyu
Automatic Image Orientation Determination With Natural Image Statistics, Siwei Lyu
Computer Science Technical Reports
In this paper, we propose a new method for automatically determining image orientations. This method is based on a set of natural image statistics collected from a multi-scale multi-orientation image decomposition (e.g., wavelets). From these statistics, a two-stage hierarchal classification with multiple binary SVM classifiers is employed to de- termine image orientation. The proposed method is evaluated and compared to existing methods with experiments performed on 18040 natural images, where it showed promising performance.

Cleveland was the site of one of the seminal events in environmental history. On the morning of June 22, 1969, a stray spark ignited oil and debris on the surface of the Cuyahoga River. The resulting fire attracted relatively little local attention in Cleveland, but became a national event. Subsequently, Time, National Geographic, and The New York Times all wrote about the fire. It even inspired a song by Randy Newman. By many accounts, it lit the spark that led to the passage of the Federal Clean Water Act.
There are some problems with the traditional story of the Cuyahoga …

An Examination Of The 1829 “Articles Of The Church Of Christ” In Relation To Section 20 Of The Doctrine And Covenants, Scott H. Faulring
BYU Studies
The 1829 "Articles of the Church of Christ" is a little-known antecedent to section 20 of the Doctrine and Covenants. This article explores Joseph Smith's and Oliver Cowdery's involvement in bringing forth these two documents that were important in laying the foundation for The Church of Jesus Christ of Latter-day Saints.

The Past, Present And Future Of Community Reinvestment Act (Cra): A Historical Perspective, Akm Rezaul Hossain
The Past, Present And Future Of Community Reinvestment Act (Cra): A Historical Perspective, Akm Rezaul Hossain
Economics Working Papers
This paper takes a historical approach to understand the evolution of one of the most controversial banking regulations in recent history, the Community Reinvestment Act (CRA) of 1978 and its effects on access to credit and banking services to community borrowers. The paper lays out the historical milieu of credit markets in the late seventies and describes the early justification of this legislation. The paper explores the implementation of the act through regulations on lending institutions and the effects of the regulations on depository lenders and community borrowers. Detailed description of the reactions to CRA regulations by different parties involved …
Liberalization, Ownership, And Efficiency In Indian Banking: A Nonparametric Approach, Abhiman Das, Ashok Nag, Subhash C. Ray
Liberalization, Ownership, And Efficiency In Indian Banking: A Nonparametric Approach, Abhiman Das, Ashok Nag, Subhash C. Ray
Economics Working Papers
This paper empirically estimates and analyzes various efficiency scores of Indian banks during 1997-2003 using data envelopment analysis (DEA). During the 1990s India's financial sector underwent a process of gradual liberalization aimed at strengthening and improving the operational efficiency of the financial system. It is observed, none the less, that Indian banks are still not much differentiated in terms of input or output oriented technical efficiency and cost efficiency. However, they differ sharply in respect of revenue and profit efficiencies. The results provide interesting insight into the empirical correlates of efficiency scores of Indian banks. Bank size, ownership, and the …
Punishing The Innocent Along With The Guilty: The Economics Of Individual Versus Group Punishment, Thomas J. Miceli, Kathleen Segerson
Punishing The Innocent Along With The Guilty: The Economics Of Individual Versus Group Punishment, Thomas J. Miceli, Kathleen Segerson
Economics Working Papers
Standard models of law enforcement involve the apprehension and punishment of a single suspect, but in many contexts, punishment is actually imposed on an entire group known to contain the offender. The advantages of .group punishment. are that the offender is punished with certainty and detection costs are saved. The disadvantage is that innocent individuals are punished. We compare individual and group punishment when social welfare depends on fairness, and when it depends on deterrence. We show that group punishment may dominate in the former case if the detection technology is ineffective but never in the latter case. We discuss …
Phylogenetic Signal In Nucleotide Data From Seed Plants: Implications For Resolving The Seed Plant Tree Of Life, J. Gordon Burleigh, Sarah Mathews
Phylogenetic Signal In Nucleotide Data From Seed Plants: Implications For Resolving The Seed Plant Tree Of Life, J. Gordon Burleigh, Sarah Mathews
Faculty Publications
Effects of taxonomic sampling and conflicting signal on the inference of seed plant trees supported in previous molecular analyses were explored using 13 single-locus data sets. Changing the number of taxa in single-locus analyses had limited effects on log likelihood differences between the gnepine (Gnetales plus Pinaceae) and gnetifer (Gnetales plus conifers) trees. Distinguishing among these trees also was little affected by the use of different substitution parameters. The 13-locus combined data set was partitioned into nine classes based on substitution rates. Sites evolving at intermediate rates had the best likelihood and parsimony scores on gnepine trees, and those evolving …

The Folk Theorem In Dynastic Repeated Games, Luca Anderlini, Dino Gerardi, Roger Lagunoff
The Folk Theorem In Dynastic Repeated Games, Luca Anderlini, Dino Gerardi, Roger Lagunoff
Cowles Foundation Discussion Papers
A canonical interpretation of an infinitely repeated game is that of a “dynastic” repeated game: a stage game repeatedly played by successive generations of finitely-lived players with dynastic preferences. These two models are in fact equivalent when the past history of play is observable to all players. In our model all players live one period and do not observe the history of play that takes place before their birth, but instead receive a private message from their immediate predecessors. Under very mild conditions, when players are sufficiently patient, all feasible payoff vectors (including those below the minmax) can be sustained …

Rejecting The Marie Antoinette Paradigm Of Prejudgment Interest, Royce De R. Barondes

This paper examines principles for properly computing prejudgment interest by examining the impact on different corporate constituencies. This paper concludes that prejudgment interest at a promisor's cost of funds can undercompensate promisees, by shifting value from the promisee's equityholders to its creditors through a forced investment that decreases the risk of the promisee's portfolio of assets.

This Article is, in effect, the second half of the author's argument against the Supreme Court's interpretation of the Sixth Amendment in Blakely v. Washington. The first half appeared in "Train Wreck? Or Can the Federal Sentencing System Be Saved? A Plea for Rapid Reversal of Blakely v. Washington," 41 American Criminal Law Review 217 (2004), and made a pragmatic, consequentialist argument against the Blakely result. This Article takes the next step of providing an alternative constitutional model of criminal sentencing to that offered by Justice Scalia in Blakely. The model emphasizes that a good constitutional model should pay particular …

There comes a time when every law school dean questions just why she or he has chosen to serve as dean. Deans experience both very high highs and very low lows. The dean often sees faculty, staff, and students at their best but just as often sees these same individuals at their worst. Regardless of the mix of highs to lows in any deanship, decanal service--if taken seriously-- demands a tremendous commitment of time and energy. Thus the question is posed: Why devote such a significant portion of one's professional time to such service?

Encouraging Courage: Law's Response To Fear And Risk, William B. Fisch

Our three papers provide a helpful review of the many things that can go wrong with our system for the protection of civil liberties under the pressures of war or other emergencies. Professor Winfield focuses on the U.S. Attorney General, the non-judicial officer from whom the public might expect the highest fidelity to the law and the constitution. She offers a sobering perspective on the ways in which those expectations can be and have been disappointed. The star of her taxonomy, I take it, is the Leveler, who reaches an independent (and rights-protective!) view of the law and works to …
