Refreshing Contractual Analysis Of Adr Agreements By Curing Bipolar Avoidance Of Modern Common Law, Amy J. Schmitz Oct 2004

Refreshing Contractual Analysis Of Adr Agreements By Curing Bipolar Avoidance Of Modern Common Law, Amy J. Schmitz

Faculty Publications

Law governing enforcement of ADR agreement not governed by the Federal Arbitration Act (FAA) has been uncertain, and often aimless. This Article therefore calls for clarification of this law, through development of a modern contractual approach for enforcing these non-FAA ADR procedures. Although courts may look to the FAA as a resource for evaluating and developing an enforcement approach, they also should employ modern contract and remedy tools that are more adaptive than the Act's summary enforcement because it allow courts to consider contextual, relational, and equitable factors when determining application of specific enforcement remedies. This allows courts to apply …

Interdisciplinary Program Designed To Prepare Student Health Professionals For The Cultural Aspects Affecting Medical Service Develivery In Rural Areas, Denise G. Bender, Brett R. Braziel

Internet Journal of Allied Health Sciences and Practice

Minorities are significantly underrepresented in the medical professions as compared to the US population as a whole. This discrepancy highlights the need to prepare students to practice in a culturally competent manner. This is especially true for those students who plan to practice in rural areas. Rural practice requires not only the skill of cultural competence, but also the ability to work with other disciplines as part of a team, due to the shortage of health professionals. This article outlines a month-long clinical rotation developed by the health professions programs in Oklahoma and funded through a grant to Oklahoma’s Area …

Toward An Economic Theory Of Dysfunctional Identity, Hanming Fang, Glenn C. Loury Oct 2004

Toward An Economic Theory Of Dysfunctional Identity, Hanming Fang, Glenn C. Loury

Cowles Foundation Discussion Papers

We advance a novel choice-theoretic model of “identity” based on the notions of categories and narratives. Identity is conceived as a matter of “reflexive perception” — how people understand themselves. Choosing an identity is equivalent to making a generalization about one’s past that highlights the most salient aspects of experience. When many individuals make a common choice in this regard, they embrace a collective identity which is dysfunctional if it is Pareto dominated by an alternative self-classificatory schema. Using a simple multi-stage risk sharing game, we explore conditions under which dysfunctional collective identities might be expected to emerge.

Rationality Of Belief. Or: Why Bayesianism Is Neither Necessary Nor Sufficient For Rationality, Itzhak Gilboa, Andrew Postlewaite, David Schmeidler Oct 2004

Rationality Of Belief. Or: Why Bayesianism Is Neither Necessary Nor Sufficient For Rationality, Itzhak Gilboa, Andrew Postlewaite, David Schmeidler

Cowles Foundation Discussion Papers

Economic theory reduces the concept of rationality to internal consistency. The practice of economics, however, distinguishes between rational and irrational beliefs. There is therefore an interest in a theory of rational beliefs, and of the process by which beliefs are generated and justified. We argue that the Bayesian approach is unsatisfactory for this purpose, for several reasons. First, the Bayesian approach begins with a prior, and models only a very limited form of learning, namely, Bayesian updating. Thus, it is inherently incapable of describing the formation of prior beliefs. Second, there are many situations in which there is not sufficient …

Math Anxiety: Causes, Effects, And Preventative Measures, Megan R. Smith Oct 2004

Math Anxiety: Causes, Effects, And Preventative Measures, Megan R. Smith

Senior Honors Theses

Math anxiety is a real problem facing students and teachers today. The mathematics teacher especially needs to understand the causes and effects of math anxiety as well as ways to help students overcome it. There are many symptoms of math anxiety including an unwillingness to attempt mathematics problems, a fear of taking advanced mathematics classes, and being unusually nervous when in mathematics class. Math anxiety hinders students' working memory (Perina, 2002). It occurs at different ages in different people for different reasons. The main cause of math anxiety is the teacher himself It has been shown that students tend to …

The Yucca Mountain repository configuration consists of waste packages stored inside of underground tunnels, or drifts. The waste packages generate heat due to radioactive decay, and moisture flows into and out of the drifts in liquid and vapor form. Heat and mass transfer within the drifts, including interaction with the surrounding rock, are potentially important processes for the performance of the repository. The present report documents models for in-drift heat and mass transfer during the post-closure period. Pre-closure, or ventilated, conditions are documented in a separate report (BSC 2004 [DIRS 169862]).

Dissolution, Reactor, And Environmental Behavior Of Zro2-Mgo Inert Fuel Matrix: Neutronic Evaluation Of Zro2-Mgo Inert Fuels, E. Fridman, A. Galperin, E. Shwageraus

Fuels Campaign (TRP)

Second task of the BGU part of “Dissolution, Reactor, and Environmental Behavior of ZrO2-MgO Inert Fuel Matrix” project aims at evaluation of the fertile free fuel matrix composition effect on the fuel reactivity and corresponding reactivity limited burnup. Fertile free fuel with different MgO to ZrO2 ratio in the matrix will require different PuO2 loading in order to assure certain fuel cycle length. This is due to the fact that absorption cross section of Zr is slightly higher than that of Mg, although absorption in both of these elements is small compared to Pu. Therefore, the …

Towards Scalable Linear-Optical Quantum Computers, J. P. Dowling, J. D. Franson, H. Lee, G. J. Milburn

Faculty Publications

Scalable quantum computation with linear optics was considered to be impossible due to the lack of efficient two-qubit logic gates, despite the ease of implementation of one-qubit gates. Two-qubit gates necessarily need a non-linear interaction between the two photons, and the efficiency of this non-linear interaction is typically very small in bulk materials. However, it has recently been shown that this barrier can be circumvented with effective non-linearities produced by projective measurements, and with this work linear-optical quantum computing becomes a new avenue towards scalable quantum computation. We review several issues concerning the principles and requirements of this scheme. © …

Accelerated Maintenance Painting – Jefferson County Federal Aid Research Task No. 135, Sudhir Palle, Theodore Hopwood Ii Oct 2004

Accelerated Maintenance Painting – Jefferson County Federal Aid Research Task No. 135, Sudhir Palle, Theodore Hopwood Ii

Kentucky Transportation Center Research Report

The Kentucky Transportation Cabinet (KYTC) conducted an experimental project to investigate the use of accelerated maintenance painting on several overpass and elevated steel structures (74,000 ft2) in Louisville. Accelerated maintenance painting procedures specified for this project entailed limited access for the painting contractor coupled with incentives/disincentives to complete each phase of the work involving traffic closures on the underlying roadways. The approach was coupled with the use of abrasive blasting for surface preparation and the application of a rapid-cure 2-coat paint system to facilitate the work.

The project was let for $402,800. The contractor proceeded to paint 4 spans designated …

Cuba And Good Governance, Berta E. Hernández-Truyol Oct 2004

Cuba And Good Governance, Berta E. Hernández-Truyol

UF Law Faculty Publications

The idea of “good governance” embraces the concept that economic success is inextricably linked to democratic and just governance. This essay explores how Cuba fares in light of good governance standards. At the outset, an overall observation is appropriate: if one considers the traditional criteria, to talk about Cuba and good governance might simply be an impossible task-- indeed an oxymoron--if we use as the starting point of analysis the existing definitions of governance. Therefore, in order to engage this thesis, I will deconstruct the idea of good governance into two parts--processes and outcomes. First, I explore the theoretical origins, …

Hanford Action of Oregon

Printed in the Fall 2004 issue of the Cascadia Times.

Althea Halvorson was a young woman at the time of the world's first nuclear blast. Now 88, she finds it deplorable that the U.S. is at war in Iraq over a nuclear threat that wasn't real, yet has made little progress at removing a nuclear threat close to the Columbia River that is very real.

Situated next to the Columbia in Eastern Washington, the Hanford Nuclear Site is one of the world's most contaminated places and will be dangerous forever. Hanford produced the plutonium that leveled the city of …
