Command-and-control regulations are generally thought to be inferior to incentive-based alternatives. This essay proposes an incentive-based approach for regulating campaign finance. In place of our current regime of contribution ceilings, the essay calls for a graduated system of contribution taxes. Rather than capping the size of political donations at a specified dollar level, we should tax donations based on a schedule of graduated rates - the larger the size of a contribution, the higher the level of taxation.

Contribution taxes generate two primary advantages over contribution ceilings. First, contribution taxes preserve more total surplus. This surplus can be shared by …

In this Article, Professor Beazley proposes that a Legal Writing revolution is the next revolution in legal education, and that the revolution is not just coming, it has begun. The marshland upwelling system (MUS) was installed in a floatation marsh along the banks of the Bayou Segnette Waterway, Louisiana. This site was characterized by native groundwater of low salinity regime. Previous studies focused on the removal of fecal pathogens from settled/raw and secondarily treated wastewater under high saline groundwater conditions. The objectives of this research were to: 1) quantify the impact of natural die-off on bacterial removal within the MUS, 2) determine bacterial retardation rates in laboratory-repacked sandy loam soil columns, and 3) evaluate the effectiveness of the MUS in removing fecal pathogens from settled, raw wastewater. In this article, I explore the contention of Jeffrey Skilling, former Enron CEO, that Enron's debacle was due to a perfect storm of events. I reject his contention, arguing instead that Enron's downfall was more like Titanic's - hubris and an over-reliance on checks and balances led to Enron's downfall. I then explore how character (especially of those at the top of an organization) can lead to Enron-like disasters, and I talk about how cognitive dissonance can lead to very smart people making very stupid decisions. I end with some musings about how lawyers can learn from Enron.

Many food recovery agencies depend on donated food, and its safety is critical for the health of vulnerable populations. A food safety curriculum was developed for agency volunteers and paid staff of the Lower Mississippi Delta region. Examples of topics in the curriculum included: personal hygiene, food storage, transporting food safely, and HACCP. Food Safety Knowledge Pre- and Posttests (20 questions) were identical, and validity and reliability were established prior to use. Paired t-tests were performed to determine the effectiveness of the curriculum (n=190). The use of high-speed data acquisition systems, inexpensive and reliable transducers, and better models of interpretation have combined to make elastic wave tomographic imaging of geotechnical engineering systems easier to accomplish both in the laboratory and in the field. An important application of these developments is that the evaluation of states of effective stress in soils using images of elastic wave velocity distribution. As a consequence, it is possible to experimentally estimate the state of induced and in-situ effective stresses and to compare these results with established models of stress distribution based on the theory of elasticity (e.g., Boussinesq’s solution). …

Mental health placement rates by the juvenile justice system differ by race. However, it is unknown whether mental health needs differ by race. This study attempted to investigate potential differences in mental health needs and service utilization among Caucasian, African American, and Hispanic juvenile justice involved youth. A stratified random sample of 473 youth petitioned, adjudicated, and incarcerated from 1995-1996 was examined using a standard chart review protocol and the Childhood Severity of Psychiatric Illness measure for mental health needs. The most common predaceous Histeridae (Coleoptera) found associated with Ips engraver beetles (Coleoptera: Scolytidae) in Louisiana were Platysoma attenuata LeConte, Pla. cylindrica (Paykull), Pla. parallelum (Say), and Plegaderus transversus (Say). Seasonal abundance of histerids in flight traps coincided with Ips spp. activity in the area. Histerid adults arrived at loblolly pine (Pinus taeda L.) logs one wk after Ips attacks had begun. As a group, histerids exhibited a bimodal emergence pattern with the first peak occurring during Ips emergence and a second four wks later, indicating that they fed on bark beetles and associated organisms arriving later in the colonization …

The interest in preserving endangered species has increased the amount of attention lent to the recovery of functional sperm from the epididymides of deceased males (Foote, 2000). Postmortem specimens have a finite time period before decomposition affects functionality. A unique biocide composition (patent pending) that is formed from a hydrogen peroxide and sodium hypochlorite mixture was investigated. A biocidal "complex" is formed by adding the peroxide to the hypochlorite in an amount so that the weight ratio of the peroxide to the hypochlorite is no less than 1:10. The chemical structure of this biocidal "complex" is uncertain but we postulate that it is a semi-stable complex, whose stability is disrupted by heat, acid, U/V exposure and the presence of organic matter (i.e., microbes) The antimicrobial activity of the biocidal "complex" is most likely a combination effect between oxidation …

Case law and commentators sometimes speak as if all income-producing activities are taxed similarly. However, that simply is not true for individuals. Although the expenses and losses of business activities generally are deductible from income of any source and net losses can be carried to other tax years, individuals' investment expenses and losses generally are deductible only from investment income. Although many of the provisions restricting investment-related deductions were enacted at different times, and each one has its own rationale, the combined effect of these provisions on individual investors is a systematic preference for business losses over investment losses.

Molecular evolution recovers the history of living species by comparing genetic information, exploring genome structure and function from an evolutionary perspective. Here we infer substitution rates and ancestral reconstructions, to better understand mutation responses to some known biochemical phenomena. Mutation processes are commonly inferred using parsimony, maximum likelihood and Bayesian. Parsimony is not explicitly model-based, and is statistically biased due to unrealistic assumptions. The model-based maximum likelihood approaches become computationally inefficient while analyzing large or high-dimensional datasets, leaving little opportunities to incorporate complex evolutionary models. A case study framework was used to study the competitiveness of Honduran coffee with major importing partners, along with an import demand analysis. Several important points summarize the findings. First, trends in green coffee supply and consumption continue to depress world coffee prices, making the production of coffee less attractive. Since small coffee producing countries, like Honduras, cannot affect the international price, they must improve efficiency, productivity, employ cost reduction techniques, and rely on the promotion of specific product attributes to remain competitive. Generalized mixed model methodology and MCMC simulations were used to estimate genetic parameters for calving rate and calf survival with the normal, probit, and logistic models. Calving rate and calf survival were defined as 0 each time a cow failed to calf or a calf failed to survive to weaning age, otherwise they were set to 1. Data were available on 1,458 cows and on 5,015 calves. Cows produced a total of 4,808 records over 4 discrete generations of rotational crosses between Angus, Brahman, Charolais, and Hereford from 1977 to 1995. In his account of intentional interpretation, Donald Davidson assumes that people are mostly rational. Several psychological experiments though, reveal that human beings deviate drastically from the normative standards of rationality. Therefore, some psychologists arrive to the conclusion that humans are mostly irrational. In this thesis, I raise some objections to both points of view. On the one hand, ascribing rationality to humans in an a priori manner seems a suspicious position to adopt, considering the empirical data that show otherwise. Our humanity is bound to perennial themes in drama, so when a classic play is adapted to 'suit' contemporary audiences, the revised version will often reflect the zeitgeist of the times in which it was produced. This study examined the perceptions of year three children of their first experience of the Sacrament of Penance within the Archdiocese of Perth in light of contemporary developmental research. In the Archdiocese of Perth, the Catholic Church's present practice is to prepare students to receive Penance in Year 3 when they have reached the "age of reason' (7 years). The theology behind the Catholic Church's decision to administer Penance at the age of reason is also investigated. The acquisition of social competence is an important developmental task for children. This review examines how child effects and environmental effects contribute to children's achievement of social competence. Environmental factors are addressed through Bronfenbrenner's (1999) ecological systems model of the microsystem, mesosystem and exosystem, The microsystem includes the home environment with parent-parent, parent-child and sibling relationships. The mesosystem includes the school environment with peer and teacher relationships. Finally, the exosystem incorporates indirect environments such as parent work, economic status and the media. This manuscript describes the development and preliminary validation of a new assessment procedure called the Young School-age Assessment of Attachment (YSAA). The tool has clinical as well as research relevance in that it identifies the attachment strategies of children aged 5-7 years as well as recognising attachment related problems for this age group. The YSAA is a representational procedure that uses line drawings of a child teddy in attachment-related situations.
