Death Penalty Law, Holly Geerdes, David Lawless

Mercer Law Review

This Article surveys the death penalty decisions of the Georgia Supreme Court from June 1, 2003, through May 31, 2004. The cases discussed include those heard by the supreme court on interim appeal, on direct appeal, and on review of habeas corpus decisions. Focusing on the court's decisions that affect the trial and appeal of death penalty cases, this Article, with some exceptions, does not discuss holdings in capital cases that are common to all criminal appeals. Four United States Supreme Court decisions are included in this survey because of their salience to Georgia death penalty law.

Torts, Deron R. Hicks

Mercer Law Review

In Music v. Steamco, Inc., the Georgia Court of Appeals affirmed the trial court's grant of summary judgment in favor of a restaurant in a slip and fall action. The action was filed by a patron of the restaurant who suffered injuries when she fell down a set of stairs while exiting the restaurant. Plaintiff, after having lunch with her friends at defendant's restaurant, prepared to leave the restaurant by way of the same stairs she used to enter the restaurant. As she stood at the top of the stairs, plaintiff noticed water on the steps; however, the steps …

Sharing Sovereignty: Non-State Associations And The Limits Of State Power, Franklin G. Snyder Dec 2004

Sharing Sovereignty: Non-State Associations And The Limits Of State Power, Franklin G. Snyder

Faculty Scholarship

The subject of mediating associations and voluntary associations have received much attention in recent years. Both conservative and liberal scholars have invoked the idea that certain institutions that fall somewhere on the spectrum between the State and the Individual play a significant role in society and that they therefore ought to be protected and even cultivated. But much of this work proceeds from a flawed premise, and leads to an instrumental view of these non-State associations that requires that these institutions be justified based on their social utility. This view means that the utility of any given institution usually seems …

Hydrogeologic Model Of A Leachate Plume In An Unconfined Coastal Plain Aquifer And Chemical Transport Mechanisms Of Metals And Dense Non-Aqueous Phase Liquids, Thomas Lindblad Dec 2004

Hydrogeologic Model Of A Leachate Plume In An Unconfined Coastal Plain Aquifer And Chemical Transport Mechanisms Of Metals And Dense Non-Aqueous Phase Liquids, Thomas Lindblad

Theses and Dissertations

Groundwater contamination is of increasing environmental concern as many aquifers across the globe have experienced a decrease in water quality in recent time. The growth of the world's population over the last couple of decades has caused a dramatic increase in the rate of groundwater use. One potential source of groundwater contamination is waste material in landfills. The 1 st Division Road Sanitary landfill at Fort Benning Military Reservation was studied to evaluate the potential effect on local groundwater and a leachate plume was recognized using data from 16 groundwater monitoring wells located around the facility. The study site is …

Pathways To Self-Esteem In Late Adolescence: The Role Of Parent And Peer Attachment, Empathy, And Social Behaviors, Deborah J. Laible, Gustavo Carlo, Scott C. Roesch Dec 2004

Pathways To Self-Esteem In Late Adolescence: The Role Of Parent And Peer Attachment, Empathy, And Social Behaviors, Deborah J. Laible, Gustavo Carlo, Scott C. Roesch

Department of Psychology: Faculty Publications

The goal of this study was to examine both the direct and indirect relations of parent and peer attachment with self-esteem and to examine the potential mediating roles of empathy and social behavior. 246 college students (Mage = 18.6 years, s.d. = 1.61) completed self-report measures of parent and peer attachment, empathy, social behavior, and self-esteem. Structural equation modeling revealed that parental attachment had mostly direct effects on self-esteem. Among females, the links between peer attachment and self-esteem, however, were entirely mediated by empathy and prosocial behavior. The findings from this study suggest that although close supportive relationships with parents …

Self-Regulation In A Web-Based Course: A Case Study, Joan Whipp, Stephannie Chiarelli Dec 2004

Self-Regulation In A Web-Based Course: A Case Study, Joan Whipp, Stephannie Chiarelli

College of Education Faculty Research and Publications

Little is known about how successful students in Web-based courses self-regulate their learning. This descriptive case study used a social cognitive model of self-regulated learning (SRL) to investigate how six graduate students used and adapted traditional SRL strategies to complete tasks and cope with challenges in a Web-based technology course; it also explored motivational and environmental influences on strategy use. Primary data sources were three transcribed interviews with each of the students over the course of the semester, a transcribed interview with the course instructor, and the students’ reflective journals. Archived course documents, including transcripts of threaded discussions and student …

Using Fine-Grained Cycle Stealing To Improve Throughput, Efficiency And Response Time On A Dedicated Cluster While Maintaining Quality Of Service, Gary Stiehr Dec 2004

Using Fine-Grained Cycle Stealing To Improve Throughput, Efficiency And Response Time On A Dedicated Cluster While Maintaining Quality Of Service, Gary Stiehr

All Computer Science and Engineering Research

For various reasons, a dedicated cluster is not always fully utilized even when all of its processors are allocated to jobs. This occurs any time that a running job does not use 100% of each of the processors allocated to it. Keeping in mind the needs of both the cluster’s system administrators and its users, we would like to increase the throughput and efficiency of the cluster while maintaining or improving the average turnaround time of the jobs and the quality of service of the “primary” jobs originally scheduled on the cluster. To increase the throughput and efficiency of the …

Mobile Agent Middleware For Sensor Networks: An Application Case Study, Chien-Liang Fok, Gruia-Catalin Roman, Chenyang Lu Dec 2004

Mobile Agent Middleware For Sensor Networks: An Application Case Study, Chien-Liang Fok, Gruia-Catalin Roman, Chenyang Lu

All Computer Science and Engineering Research

Agilla is a mobile agent middleware that facilitates the rapid deployment of adaptive applications in wireless sensor networks (WSNs). Agilla allows users to create and inject special programs called mobile agents that coordinate through local tuple spaces, and migrate across the WSN performing application-specific tasks. This fluidity of code and state has the potential to transform a WSN into a shared, general-purpose computing platform capable of running several autonomous applications at a time, allowing us to harness its full potential. We have implemented and evaluated a fire tracking application to determine how well Agilla achieves its goals. Fire is modeled …

Supporting Live Development Of Soap And Corba Servers, Sajeeva Pallemulle, Kenneth J. Goldman, Brandon E. Morgan Dec 2004

Supporting Live Development Of Soap And Corba Servers, Sajeeva Pallemulle, Kenneth J. Goldman, Brandon E. Morgan

All Computer Science and Engineering Research

We present middleware for a Server Development Environment that facilitates live development of SOAP and CORBA servers. As the underlying implementation platform, we use JPie, a tightly integrated programming environment for live software construction of Java applications. JPie provides dynamic classes whose signature and implementation can be modified at run time, with changes taking effect immediately upon existing instances of the class. We extend this model by automating the server deployment process, allowing developers to devote their full attention to the implementation of server logic. Moreover, the live development model enables the construction of server applications while they are running, …

Comparing State Vocational Rehabilitation Agencies With High Verses Low Rates Of Competitive Employment For Blind Consumers: Defining Quality Employment And Describing Effective Service Patterns, Edward Bell Dec 2004

Comparing State Vocational Rehabilitation Agencies With High Verses Low Rates Of Competitive Employment For Blind Consumers: Defining Quality Employment And Describing Effective Service Patterns, Edward Bell

Graduate Theses and Dissertations

State vocational rehabilitation (VR) agencies were rank ordered by their rate of competitive employment for consumers who are legally blind. Based on each state's competitive closure rate (CCR), the top six- and bottom six-ranked agencies were identified and formed two groups of high- and low-performing states. Top- versus bottom-ranked agencies were compared by quality of jobs obtained, services offered, consumer characteristics, and geographic/economic differences. The quality of jobs obtained was assessed via three indices: average wage, medical insurance, and selfsupport. Six services were hypothesized to explain differences between high- and lowranked states: cost of case services, adjustment training, college education, …

Commitment And Cognitive Reinforcement In Workplace Values-Oriented Ethics Programs, Robert M. Krug Dec 2004

Commitment And Cognitive Reinforcement In Workplace Values-Oriented Ethics Programs, Robert M. Krug

Student Scholarship

Organizations requiring their employees to maintain consistent standards of ethical behavior have need of a means of disseminating the required standards throughout the organization. The use of selected workplace programs\, such as workplace ethics programs\, has been found to fulfill that requirement. The creation of certain types of workplace ethics programs requires the establishment of employee commitment to those programs\, as well as a means of reinforcing that commitment. This paper provides a preliminary conceptual framework for identifying and studying those elements that aid in the long-term sustainability of workplace ethics programs. Two related theories\, work commitment theory and innovation …

The Java Cog Kit Grid Desktop : A Simple And Central Approach To Grid Computing Using The Graphical Desktop Paradigm., Pankaj R. Sahasrabudhe 1980- Dec 2004

The Java Cog Kit Grid Desktop : A Simple And Central Approach To Grid Computing Using The Graphical Desktop Paradigm., Pankaj R. Sahasrabudhe 1980-

Electronic Theses and Dissertations

Grid computing is evolving as a service based, flexible and secure resource sharing environment. Currently, with the help of Grid middleware toolkits, Grids are exposing their services through programming models and command line interfaces, requiring much technical knowledge of the backend Grid systems. Grid portals also exist, but fall short on integrating with native environments and maintaining a uniform user interface from portal to portal. In order to gain wider acceptance within the large and less technical oriented user communities, we need a homogeneous graphical user environment that supports the challenging task of providing Grid users an easy to use, …

Analyzing Traditional-Based Teaching Methods Versus Technology-Based Teaching Methods In Collegiate Aviation Classrooms, Robert Rhett Coleman Yates Dec 2004

Analyzing Traditional-Based Teaching Methods Versus Technology-Based Teaching Methods In Collegiate Aviation Classrooms, Robert Rhett Coleman Yates

Graduate Student Dissertations, Theses, Capstones, and Portfolios

This study is a comparative analysis of traditional-based teaching methods versus technology-based teaching methods in collegiate aviation classrooms. Education is in a transformational period. Technology use in the classroom is a major part of this transformation. However, this change in pedagogy is not occurring as rapid as one might believe. Out of ten undergraduate professors in the United States teaching in higher education, fewer than two seriously use computers and other technologies in their classrooms. Of the ten, four to five professors never use the machines at all. The same is true in collegiate aviation classrooms; technology-based teaching methods and …

The Effects Of Exposure To Images Of The Male Muscular Ideal On Body Image And Muscularity Concerns In Men, Jason Alan Mccray Dec 2004

The Effects Of Exposure To Images Of The Male Muscular Ideal On Body Image And Muscularity Concerns In Men, Jason Alan Mccray

Theses and Dissertations

Though body-image has been well-researched in women for more than 40 years, theoretical discussions and empirical investigations addressing male body-image have only recently began to emerge. Work by Pope, Phillips and Olivardia (2000) has begun to identify the dynamics of male body-image distortions and the role media depictions of muscular men may play in their pathogenesis. The empirical literature is curiously devoid of experimental investigations of male responses to media and advertising depictions of muscular men.

The present study was designed to parallel the well-established literature examining women’s responses to fashion images in terms of changes in body-image and mood …
