History, Concepts, And Normativity In Hegel, Dario Perinetti Dec 2004

History, Concepts, And Normativity In Hegel, Dario Perinetti

Cardozo Public Law, Policy & Ethics Journal

The article challenges the perception of Hegel's originality in linking history and logic, arguing that this connection was a common endeavor in the 18th century. It situates Hegel's work within a broader historical context, emphasizing that his contribution lies in his unique conceptual history, which describes how concepts acquire meaning through inferential relations rather than naturalistic or psychological processes. The analysis highlights Hegel's departure from Kant and others, asserting that his logic is both descriptive and normative, offering a non-referential theory of concepts that emphasizes their role in generating logical space.

Uberregulation Without Economics: The World Trade Organization's Decision In The U.S.-Mexico Arbitration On Telecommunications Services, General Agreement On Trade In Services, Gats, J. Gregory Sidak, Hal J. Singer

Federal Communications Law Journal

In April 2004, a World Trade Organization ("WTO") arbitration panel found that Mexico had violated its commitments under the Annex on Telecommunications to the General Agreement on Trade in Services ("GATS") by failing to ensure that Telmex, Mexico's largest supplier of basic telecommunications services, provide interconnection to U.S. telecommunications carriers at international settlement rates that were costoriented. The WTO panel deemed long run average incremental cost ("LRAIC") to be the appropriate cost standard for setting settlement rates. Mexico thus became obliged to change its domestic telecommunications regulations or face trade sanctions. The decision is the first WTO arbitration to deal …

The Road Not Yet Traveled: Why The Fcc Should Issue Digital Must-Carry Rules For Public Television "First", Andrew D. Cotlar Dec 2004

The Road Not Yet Traveled: Why The Fcc Should Issue Digital Must-Carry Rules For Public Television "First", Andrew D. Cotlar

Federal Communications Law Journal

After having recently adopted a variety of complex decisions concerning the digital television transition, the Federal Communications Commission ("FCC") may be poised in the next year to address the issue of mandatory cable carriage of digital broadcast television signals. In this regard, it may reasonably consider the possibility of crafting digital carriage rules for public television stations first without ruling positively or negatively on carriage of commercial stations. This action may legitimately be based on the unique legislative and factual differences between the noncommercial and commercial service and would be constitutionally permissible. This Article sets forth the legal basis for …

Nonprofit Solicitation Under The Telemarketing Sales Rule, Rita Marie Cain Dec 2004

Nonprofit Solicitation Under The Telemarketing Sales Rule, Rita Marie Cain

Federal Communications Law Journal

In 2003, the Federal Trade Commission ("FTC") revised its Telemarketing Sales Rule ("TSR") to establish a national Do-Not-Call Registry for commercial telemarketing. Congress directed the Federal Communications Commission ("FCC") to coordinate its telemarketing regulations under the Telephone Consumer Protection Act ("TCPA") of 1991 to achieve maximum consistency between the two agencies' telemarketing restrictions. Nonprofit solicitation is exempt from the national Do-Not-Call Registry, but is covered by other provisions of the FTC rule. The TSR created a new in-house no-call list requirement and imposed additional restrictions not previously known for nonprofit solicitors. The separate nonprofit provisions of the TSR raise unique …

Competition Versus Regulation: "Mediating Between Right And Right'* In The Wireless And Wireline Telephone Industries, Benjamin Douglas Arden Dec 2004

Competition Versus Regulation: "Mediating Between Right And Right'* In The Wireless And Wireline Telephone Industries, Benjamin Douglas Arden

Federal Communications Law Journal

The wireline telephone industry in the United States is the most complete and sophisticated system in the world, built under 100 years of strict government regulation. While the wireline telephone industry was built under a scheme emphasizing regulatory control, the infancy of the wireless telephone industry has been subject to increasing deregulation and reliance on free market forces to guide the industry's development. It has been suggested that this shift in policy reflects the acknowledged failure of strict government regulation. This Note argues that the shift in regulatory policy reflects a difference in circumstances between the development of the wireless …

Sergi Belbel's Theatre Of Pain, Sharon G. Feldman Dec 2004

Sergi Belbel's Theatre Of Pain, Sharon G. Feldman

Latin American, Latino and Iberian Studies Faculty Publications

Dins la seva memoria ("Within his Memory"), a Catalan play written by Sergi Bel-bel in 1986, begins in total darkness, an imprecise empty void in which the spectator hears only the deep, rhythmic gasps and sighs of the anonymous protagonist. ' As the stage lights slowly rise during this "preliminary" scene, Ell (or, "He," as the protagonist is generically called) is depicted on his knees, masturbating with his back to the audience. At first glance, his violent, self-inflicted pleasure may be interpreted as an ultimate affirmation of life; yet, his autoerotic gestures are also imbued with memories that carry …

Algorithmic Estimation Of Pauses In Extended Speech Samples Of Dysarthric And Typical Speech, Jordan R. Green, David R. Beukelman, Laura J. Ball

Department of Special Education and Communication Disorders: Faculty Publications

The aim of this study was to evaluate the validity and performance of an algorithm designed to automatically extract pauses and speech timing information from connected speech samples. Speech samples were obtained from 10 people with amyotrophic lateral sclerosis (ALS) and 10 control speakers. Pauses were identified manually and algorithmically from digitally recorded recitations of a speech passage that was developed to improve the precision of pause boundary detection. The manual and algorithmic methods did not yield significantly different results. A stepwise analysis of three different pause detection parameters revealed that estimates of percent pause time were highly dependent on …

Dealers took turns hosting the meetings and having the attending dealers analyze their business. A detailed list of problems and solutions was provided to each host business.

Slope Stability Analysis Of A Lake Michigan Coastal Bluff, Gregory Carlton Young Dec 2004

Slope Stability Analysis Of A Lake Michigan Coastal Bluff, Gregory Carlton Young

Masters Theses

Bluff failure along the Lake Michigan coast can be produced primarily by increased pore pressure from perched water tables above lacustrine clay deposits. To test this theory, a site in Allegan County, Michigan with alternating layers of sand, clay and glacial till was chosen for bluff failure monitoring. Historically, the site experiences sporadic massive failures as opposed to neighboring sites that show more regular and uniform displacements. Four pole and cable monitoring lines were measured bi-weekly from December 2001 to October 2003. Lake levels were low and no erosion of material at the base of the slope occurred. Slumps above …

Techniques For Processing Tcp/Ip Flow Content In Network Switches At Gigabit Line Rates, David Vincent Schuehler Dec 2004

Techniques For Processing Tcp/Ip Flow Content In Network Switches At Gigabit Line Rates, David Vincent Schuehler

All Computer Science and Engineering Research

The growth of the Internet has enabled it to become a critical component used by businesses, governments and individuals. While most of the traffic on the Internet is legitimate, a proportion of the traffic includes worms, computer viruses, network intrusions, computer espionage, security breaches and illegal behavior. This rogue traffic causes computer and network outages, reduces network throughput, and costs governments and companies billions of dollars each year. This dissertation investigates the problems associated with TCP stream processing in high-speed networks. It describes an architecture that simplifies the processing of TCP data streams in these environments and presents a hardware …

An Architecture For Spam Regulation, David Dickinson Dec 2004

An Architecture For Spam Regulation, David Dickinson

Federal Communications Law Journal

Junk email, commonly referred to as "spam," is the current scourge of the Internet. In late 2004, unwanted email messages were being delivered at a rate of 12.4 billion per day. The variety of tools used to combat spam have failed to make a significant impact. Legislative efforts, such as the CAN-SPAM Act of 2003, met with substantial enforcement complications. The communications industry responded with a variety of technical advances, such as filters and blacklists, but those innovations are still unable to reliably distinguish between wanted and unwanted messages. Real coordination between legislative and technical spam control tactics has yet …
