The President's Power To Detain "Enemy Combatants": Modern Lessons From Mr. Madison's Forgotten War, Ingrid Wuerth

This article uses three sets of cases from the War of 1812 to illustrate three problems with how modern courts have approached the detention of "enemy combatants" in the United States. The War of 1812 cases show that modern courts have relied too heavily on deference-based reasoning, and have failed to adequately consider both international law and congressional authorization when upholding the detentions as constitutional. The War of 1812, termed "Mr. Madison's War" by contemporary opponents, was fought largely on our own territory against a powerful foreign enemy, making it an especially rich source for comparison to the modern war …

As apology advocates have previously emphasized, much of the civil litigation that clogs court dockets in America today could be avoided with a simple heartfelt apology. Although sometimes difficult to offer, these expressions of remorse are profoundly powerful and valuable for humans as social animals. Nevertheless, apologies can be problematic. This Article used evolutionary theory as a tool to explore the costs of apology in two areas-spouse abuse and medical malpractice-to suggest that excessive victim forgiveness can, in some contexts, cast doubt on the effectiveness of a purely private litigation system for creating appropriate behavioral incentives. Jury sentencing in non-capital cases is one of the least understood procedures in contemporary American criminal justice. This Article looks beyond idealized visions of jury sentencing to examine for the first time how felony jury sentencing actually operates in three different states - Kentucky, Virginia, and Arkansas. Dozens of interviews with prosecutors, defenders, and judges, as well as an analysis of state sentencing data, reveal that this neglected corner of state criminal justice provides a unique window through which one can observe some of the most fundamental forces operating in criminal adjudication today. In the late 1970s and early 1980s, the grassroots environmental movement brought national attention to the issues related to inequities in environmental quality. Previous research addressing these environmental inequities has progressively increased and advanced methodologically. However, the arguments and focus have been primarily limited to examining the socio-demographics in an ongoing debate of race and class. This thesis extends past the methodological stalemate focusing on the application of Geographic Information Systems (GIS) using survey data in an environmental justice case study of a community in south Florida. Epithelial morphogenesis is contingent upon cell shape changes. Cell shape changes are the driving force for the metamorphosis of the adult Drosophila leg from the leg imaginal disc precursor. Genetic analysis has identified several Drosophila genes involved in regulating cell shape changes during leg disc morphogenesis. These include members of the RhoA signaling pathway and the product of the Stubble-stubbloid (Sb-sbd) locus, a transmembrane serine protease. Mutations in the Sb-sbd gene interact genetically with the members of the RhoA signaling pathway, however the nature of the relationship between Sb-sbd serine protease activity and RhoA signaling is not understood. This study examined the effects and efficacy of two vocational instructional interventions - a Hand-Held Computer intervention versus a Staff Model intervention - as vocational instructional tools for high school students with autism and mental retardation. Specifically, the study analyzed the effects of these two treatments on the completion of authentic novel job tasks within a local department store. This research indicated the provision of specific technology as an instructional model positively influenced participants' ability to: accurately complete tasks, exercise increased independence during task completion, reduce problematic behavior during task completion, and lower necessary staff prompts during task completion. At the turn of the century, the City of Orlando initiated the "Neighborhood Horizon Program." This program involved local citizens to help improve their community resources by engaging in a process of planning where the problems associated with the communities were identified. Many residents favored to bring back the brick roads that were overlaid with asphalt concrete to provided better transportation in the mid 1900s. The purpose of this study is to investigate the relationships between effective school characteristics and norm referenced standardized test scores in American-style international schools. In contrast to schools in traditional effective schools research, international schools typically have middle to high SES families, and display average to above average achievement. Eleven effective school characteristics were identified and correlated with standardized test scores for grades 4, 6, and 8 and high school SAT scores. Data was gathered from an online teacher questionnaire designed for this study. An intensive, replicated monthly sampling of snake communities inhabiting four habitat types was conducted at John F. Kennedy Space Center, Brevard County, Florida from November 2002 through October 2003. Thirteen species (580 individuals plus 74 recaptures) plus one hybrid were captured. The three most commonly captured species, Coluber constrictor, Thamnophis sirtalis, and Thamnophis sauritus, combined made up 85% of the sample. These three species were active during every month of the year, but showed modal activity patterns typical of Temperate Zone snakes. Monthly snake captures were correlated with monthly captures of potential prey species and with mean monthly temperature. Species …

As digital images become ubiquitous in many applications, the need for efficient and effective retrieval techniques is more demanding than ever. Query by Example (QBE) and Query by Concept (QBC) are among the most popular query models. The former model accepts example images as queries and searches for similar ones based on low-level features such as colors and textures. Anthrax, a fatal bacterial infection is caused by Bacillus anthracis, a gram-positive, spore forming, capsulated, rod shaped organism. Centers for Disease Control (CDC) lists anthrax as Category A biological agent due to its severity of impact on human health, high mortality rate, acuteness of the disease and potential for delivery as a biological weapon. In this thesis, we aim at modeling some aspects of the functional role of emotions on an autonomous embodied agent. We begin by describing our robotic prototype, Cherry--a robot with the task of being a tour guide and an office assistant for the Computer Science Department at the University of Central Florida. Despite the chronic debate in the etiology of crohn's disease (cd), a debilitating inflammatory bowel disease (ibd) closely related to ulcerative colitis (uc), an emerging interest in a possible mycobacterial role has been marked. Granuloma and pathologic manifestations in cd resemble aspects found in tuberculosis, leprosy and paratuberculosis. The latter, a chronic enteritis in cattle, goat, sheep and primates, which is similar to human enteritis, also known as cd, is caused by a fastidious, slow growing mycobacterium avium subspecies paratuberculosis (map). The perfect man must be aggressive but not violent, sensitive but not emotional, healthy, active and smart without being an idealist, overachiever or too bookish. Heterocentric male focused lifestyle magazines rival women’s magazines in number and availability. Some men look to these images as a tool by which to gauge their masculinity and learn their social role performance. The purpose of this study was to investigate the effects of voice production and perception of dyspnea in aerobic instructors during simultaneous tasks of exercise and speech production. The study aimed to document changes that occur during four conditions: 1) voice production without exercise and no use of amplification; 2) voice production without exercise and the use of amplification; 3) voice production during exercise without the use of amplification; 4) voice production during exercise with the use of amplification. The name of the world's largest hydroelectric dam, Brazil's Itaipu Binacional, comes from an Ava-Guarani word meaning "singing stone." Before Itaipu became affiliated with dams it represented a smaller, but no less significant monument: a large rock formation in the middle of the Parana River that produced song when struck by water.₂ Today, neither the rock nor the Ava-Guarani tribe remain. In their place is a gargantuan hydroelectric dam that produces sounds more like a thunderous engine than song. In species with complex life cycles, stage-specific effects of environmental conditions combine with factors regulating stage-specific recruitment to determine population-level response to habitat disturbance. The abundance of the stream salamander Gyrinophilus porphyriticus(Plethodontidae) is negatively related to both logging-associated sedimentation and brook trout (Salvelinus fontinalis) in headwater streams throughout New Hampshire, USA. To understand the mechanisms underlying these patterns, we investigated stage-specific and interactive effects of sedimentation and brook trout on G. porphyriticus. We conducted quantitative surveys of salamanders, brook trout, and substrate embeddedness in 15 first-order streams and used a controlled experiment to test the direct and interactive effects of …

A remotely accessible solar energy laboratory has been developed for real-time experimentation using solar heating and photovoltaic equipment that is physically located at Purdue University. Indiana high school students are the first customers for this on-line resource. In addition to sensor data, the web-based laboratory includes lesson plans, tutorials, assessment questions, and a feedback utility. This project is helping science teachers meet new state science standards from the Indiana Department of Education, which call for hands-on laboratory activities and real time data analysis. Though 3D computer graphics has seen tremendous advancement in the past two decades, most available mechanisms for computer interaction in 3D are high cost and targeted for industry and virtual reality applications. Recent advances in Micro-Electro-Mechanical-System (MEMS) devices have brought forth a variety of new low-cost, low-power, miniature sensors with high accuracy, which are well suited for hand-held devices. The International Space Station (ISS) requires a substantial amount of potable water for use by the crew. The economic and logistic limitations of transporting the vast amount of water required onboard the ISS necessitate onboard recovery and reuse of the aqueous waste streams. Various treatment technologies are employed within the ISS water processor to render the waste water potable, including filtration, ion exchange, adsorption, and catalytic wet oxidation. The ion exchange resins and adsorption media are combined in multifiltration beds for removal of ionic and organic compounds.

Long-term exposure to diabetes mellitus is associated with metabolic abnormalities such as chronic hyperglycemia and redox imbalance. Uncontrolled hyperglycaemia and genetic factors are implicated in the pathogenesis of diabetic microvascular diseases. Genetic mutation through the genes coding for enzymes involved in glucose metabolism and immuno-regulatory mechanisms may contribute to the susceptibility to type I diabetes mellitus (TIDM) and its chronic microvascular diseases. Previous studies have shown that the transcription factor, nuclear factor kappa 8 (NFκB) and heat shock proteins (HSPs) are two redox-sensitive cellular responses of most immune and inflammatory diseases including diabetes and its late vascular complications.
