Through The Lens Of Diversity: The Fight For Judicial Elections After Republic Party Of Minnesota V. White, Sherrilyn A. Ifill

This Article is directed at the ongoing discussion taking place in many states and among members of the bench and bar about whether states that elect judges should switch to appointment in light of White. The author argues that states should resist what he regards as the Court's heavy-handed dicta denouncing judicial elections in White. It will focus on the Western Shoshone land claims before the Indian Claims Commission, and the federal government's trespass claims against the ranching operations of the redoubtable, irrepressible Dann sisters. The Education Of Joseph Prince: Reading Adolescent Culture In Eighteenth-Century New England, Douglas L. Winiarski

Among the earliest extant manuscripts composed by a New England adolescent, Prince's commonplace book both confirms and modifies existing studies of the transition from childhood to adulthood in early America. Unlike the night-walking youths who appear in revisionist scholarship, Prince never was haled before the Plymouth County court to answer charges of "frolicking" with his cronies. Instead, this dutiful scion of a wealthy and politically powerful southeastern Massachusetts clan spent most of his free time perusing the books in his father's extensive library. The Catholic tradition in the Latin West grew up on the foundations laid by Rome. It accepted as fact the urban establishments that had started as colonial settlements and the need for such settlements to safeguard the imperial order. Thus in Catholic religious thought colonization and colonialism have no independent status; they are matters for legal and political reflection. Nonetheless, Catholic moral theology, particularly as it dealt with mission and conquest, had much to say about the activities that made colonization possible.

Modern, scientific, man doesn't see miracles, only odd phenomena that call out for more thorough study. Ethics, like the miraculous, doesn't defy scientific explanation; it just doesn't exist. In what follows I hope to do two things., On the one hand, I want to embrace Wittgenstein's rejection of ethics as theory, in the sense of a systematic body of knowledge about the world. On the other, I hope to suggest that this rejection opens up conceptual space for understanding ethics as a critical human enterprise.

A reliable supply of water is required to maintain virtually all forms of life. Plants, which lack the ability to migrate away from harsh environments, have evolved numerous mechanisms to cope with natural fluctuations of water availability. One type of modification is known as stomata, taken from the Greek word for “mouth”. Stomata resemble tiny mouths on the underside of leaves, opening and closing to regulate cellular water loss. Research has shown that over expression of NADP Malic Enzyme in transgenic plants causes the stomata to remain more closed. This decreases the amount of organismal water loss via transpiration, …

There is an inherent quality of interaction in functional objects; my goal is to enhance this relationship between object and user. Through this I will pursue the investigation of portability as it applies to objects in domestic settings. This thesis aims to provide a novel framework for a multiagent system implementation. The major feature of the proposed architecture is the introduction of the biological concept of hormones. The hormones are passed via the communication network to convey limited global system state knowledge. The agents' response to a hormone is interpreted depending on its own local agent state. The purpose of this research was to evaluate an alternative to polyvinyl chloride based packaging materials for pharmaceutical blister packaging that is neither harmful to the environment nor corrosive to the equipment used in pharmaceutical packaging. Diepoxybutane (DEB), a known industrial carcinogen, reacts with DNA primarily at the N7 position of deoxyguanosine residues and creates interstrand cross-links at the sequence 5'-GNC. Since N7-N7 cross-links cause DNA to fragment upon heating, quantative polymerase chain reaction (QPCR) is being used in this experiment to measure the amount of DEB damage (lesion frequency) with three different targets-mitochondrial (unpackaged), open chromatin region, and closed chromatin region. Initial measurements of DEB damage within these three targets were not consistent because the template DNA was not the limiting reagent in the PCR. Novel N-Body Orbits For Constrained Potentials Including The Unusual Figure Eight Three Body Orbit, Jan M. Dudzik

Recently new n-body planar orbits have been discovered which are known as choreographies. These orbits correspond to small n, generally n<20, and exhibit unexpected patterns with respect to given initial conditions. Here we shall examine numerical solutions to the three-body problem and the restricted three-body problem for three body potentials that are the sum of three two-body potentials. Then for an everywhere attractive three body potential with non-collinear and collision-less orbits with a strictly monotone decreasing potential function there exist bound states that are not chaotic that are choreographies. For the right initial conditions these orbits can be mapped numerically and visualized. We will display a number of these cases corresponding to the three body problem, restricted three body problem, the chaotic restricted three body problem and the new figure eight bound state choreography for the Kazalov potential orbits to exhibit some of their special features and to take note of a number of open questions dealing with simple orbital problems.

A Similarity Based Concordance Approach To Word Sense Disambiguation, Ramakrishnan B. Guru

This study attempts to solve the problem of Word Sense Disambiguation using a combination of statistical, probabilistic and word matching algorithms. These algorithms consider that words and sentences have some hidden similarities and that the polysemous words in any context should be assigned to a sense after each execution of the algorithm. The algorithm was tested with sufficient sample data and the efficiency of the disambiguation performance has proven to increase significantly after the inclusion of the concordance methodology.

Distinct Group Differences And Discriminant Validity Of The Adjustment Scales For Children And Adolescents: Attention Deficit Hyperactive Disorder Versus Conduct Disorder, James Richard White

The present study examined the distinct group differences and discriminant validity of the Adjustment Scales for Children and Adolescents (ASCA; McDermott, Marston, & Stott, 1993). Participants included 37 children in kindergarten through twelfth grade. Thirty children met DISC-IV/DSM-IV criteria for Attention Deficit Hyperactivity Disorder and 7 met DISC-IV/DSM-IV criteria for Conduct Disorder. Participants were classified based on the results of the DISC-IV parent interview administered by school psychology interns. The teacher completed the ASCA when the student was initially referred. This article outlines a dialogical approach to understanding how South Asian-American women living in diasporic locations negotiate their multiple and often conflicting cultural identities. We specifically use the concept of voice to articulate the different forms of dialogicality--polyphonization, expropriation, and ventriloquation--that are involved in the acculturation experiences of two 2nd-generation South Asian-American women. In particular, we argue that it is important to think of acculturation of the South Asian-American women as essentially a contested, dynamic, and dialogical process. Not so long ago, in 1998, the world acknowledged both the fiftieth anniversary of the Universal Declaration of Human Rights and the 350th anniversary of the Peace of Westphalia. The Universal Declaration was celebrated in the popular press, by thousands of activists, and at well attended open forums at schools and universities. Westphalia was noted almost exclusively at academic conferences. But public obscurity is an undeserved fate for Westphalia, for its legacy in organizing our political world vies with that of the American and French revolutions. Can the exercise of any of the key provisions in investment agreements lead to rights and practices that deviate from the terms of the TRIPS Agreement? This issue is specifically explored in relation to compulsory licenses, one of the "safeguards" contemplated in the TRIPS Agreement that developing countries have actively tried to preserve in order to mitigate the powers conferred to patent owners. Despite this attention and interest, no single compulsory license has been granted in a developing country after the adoption of the TRIPS Agreement.
