In the face of required expenditures for competitive higher education and the growing challenges of quality Christian training, the Seventh-day Adventist (SDA) Church is concerned about accountability in spiritual development and outcomes assessment. The General Conference Annual Council of 1996 voted the “Total Commitment to God” document. Portland needs to plan for broadband development and take steps to ensure these plans are implemented. In order to implement Portland's land use and economic development goals, broadband must be accessible to all users. This means that any home or business must have access to the best available network technology to meet their needs. Currently, broadband service is not provided at uniform levels City-wide. It must be affordable, which requires real competition among providers. Portland's market presently offers too few choices outside the central business district to meet this criterion. SE Clinton is a popular bicycle route for commuter, utilitarian and recreational bicyclists that fails to provide a safe and direct connection to the Eastbank Esplanade and downtown Portland. Furthermore, residents in the Hosford-Abernethy and Brooklyn neighborhoods do not have a safe bicycle and pedestrian connection to access the Eastbank Esplanade. This gap in the bicycle and pedestrian network must be removed to serve the needs of bicyclists and pedestrians.

This project presents four alternative bicycle and pedestrian routes that connect the Eastbank Esplanade and the SE Clinton bikeway through the Central Eastside Industrial District. Each alternative, with improvements, is …

On The Proper Motives Of Corporate Directors (Or, Why You Don't Want To Invite Homo Economicus To Join Your Board), Lynn A. Stout

One of the most important questions in corporate governance is how directors of public corporations can be motivated to serve the interests of the firm. Directors frequently hold only small stakes in the companies they manage. Moreover, a variety of legal rules and contractual arrangements insulate them from liability for business failures. Why then should we expect them to do a good job?

Conventional corporate scholarship has great difficulty wrestling with this question, in large part because conventional scholarship usually adopts the economist's assumption that directors are rational actors motivated purely by self-interest. This homo economicus model of behavior may …

Designing Judicial Review: A Comment On Schauer, Emily Sherwin

In his characteristically lucid paper, Neutrality and Judicial Review, Frederick Schauer revisits the meaning and plausibility of Herbert Wechsler’s argument for neutral principles in constitutional adjudication. Unlike some critics, Schauer takes the argument seriously, on its own terms, and does an excellent job of sorting through the different ideas that lie behind it. Schauer identifies four different versions of the argument for neutrality. At least three of these are drawn from Wechsler’s 1959 article. Schauer is particularly interested in a fourth version, which favors neutrality in the design and management of the institution of judicial review.

How Employment-Discrimination Plaintiffs Fare In The Federal Courts Of Appeals, Kevin M. Clermont, Theodore Eisenberg, Stewart J. Schwab

Employment-discrimination plaintiffs swim against the tide. Compared to the typical plaintiff, they win a lower proportion of cases during pretrial and after trial. Then, many of their successful cases are appealed. On appeal, they have a harder time in upholding their successes, as well in reversing adverse outcome.

This tough story does not describe some tiny corner of the litigation world. Employment-discrimination cases constitute an increasing fraction of the federal civil docket, now reigning as the largest single category of cases at nearly 10 percent.

A Mind To Blame: New Views On Involuntary Acts, Deborah W. Denno

This article examines the legal implications linked to recent scientific research on human consciousness. The article contends that groundbreaking revelations about consciousness expose the frailties of the criminal law's traditional dual dichotomies of conscious versus unconscious thought processes and voluntary versus involuntary acts. These binary doctrines have no valid scientific foundation and clash with other key criminal law defenses, primarily insanity. As a result, courts may adjudicate like individuals very differently based upon their (often unclear) understanding of these doctrines and the science that underlies them. Why The Model Penal Code's Sexual Offense Provisions Should Be Pulled And Replaced, Deborah W. Denno

By all accounts, the Model Penal Code is enormously respected and influential. Yet, relatively soon after the Code's 1962 publication, the Code's sexual offense provisions and even its 1980 revised Commentaries were already considered outdated. The rapid onslaught of the sexual and feminist revolutions of the 1960s and 1970s brought an intense momentum to change rape laws that the Code had, in part, either mirrored or inspired. Only because of the passage of time, the Code's sexual offense provisions and Commentaries now misrepresent the progressive thinking of the Code's reporters. This paper describes the process of developing an Electronic Performance Support System (EPSS) for AutoTutor 3D. The new architecture of AutoTutor 3D has four models: Domain model, Student model, Tutor model and Interface model. To date, the complexity of authoring the scripts used by AutoTutor has presented a significant challenge. Creation of a tool to simplify this process gives us the ability to disseminate AutoTutor across many different domains. The tool was created using a rapid prototyping approach and incorporates real world case based scenarios based on actual teacher experience with the tool, and a point-and-query help system.
