Intimate Affiliation And Democracy: Beyond Marriage?, Linda C. Mcclain

Hofstra Law Review

This article takes up the question: Should family law and policy move beyond marriage? It assesses a spectrum of answers to that question. Rejecting proposals, on the one hand, to shore up traditional marriage, and, on the other, to abolish marriage, it argues that family law and policy should not move wholly beyond marriage, but should support marriage in a way that better fosters greater equality within and among families. The article is part of a symposium on "Marriage, Families, and Democracy," published in 32 Hofstra Law Review 23-421 (2003).

"The interest in the ability to monitor a structure and detect damage at the earliest possible stage is pervasive throughout the civil, mechanical and aerospace engineering communities. The thesis focuses on the application of a finite element model updating technique to monitor and detect damage in beams. A Sensitivity Based Element-by- Element (SBEBE) methodology is chosen as the finite element model updating technique. "Groundwater circulation wells (GCWs) allow for the in situ treatment of contaminated water resources. Focused remediation with a GCW could be used to treat groundwater before it enters an existing domestic well already in use. GCWs have been installed at the former Nebraska Ordnance Plant; the model originally developed for these was slightly modified and used to perform a feasibility study of a focused remediation system.

If the focused remediation system works properly, the capture zone of the domestic well should be within the recharge zone of the GCW. Deterministic modeling with capture zone analysis indicated that a GCW installed …

"Student design competition teams present a valuable research possibility in the field of work group research. They are widely available and present greater learning opportunities than do class project groups. This study intended to create an instrument to measure the level of project spirit and team performance in order to establish a link between these two concepts. In the present study, nine student design competition teams from the University of Missouri - Rolla (UMR) campus (n = 186) were surveyed. "Common-mode chokes are widely used as suppression filters against interference of common-mode noise in high-speed differential signaling. This thesis focuses on investigating the characteristics of common-mode chokes. Mixed-mode S-parameters are presented as a useful concept for explaining the modal operation of differential circuits.

Three methods for measuring common-mode and differentia-mode S-parameters of common-mode chokes are demonstrated. The three methods involve (1) ABCD chain matrix, 2) using hybrid couplers and 3) modal decomposition. Each measurement method provides a specific level of accuracy. The modal decomposition method can work up to 10GHz.

Harriet Martineau (1802-1876) was the first significant woman sociologist, and was also the first methodologically competent sociologist to make systematic observations throughout the American South. Martineau’s writings on American society in the 1830s provide an enduring model of observational dedication and perseverance. Of the two and a half years that Martineau devoted to data collection in the U.S., she allotted six months to direct observation and face-to-face interviews in the southern states. From late December 1834 to early July 1835, Martineau completed first-hand observations in Maryland, the District of Columbia, Virginia, North Carolina, South Carolina, Georgia, Alabama, Mississippi, Tennessee, and …

A Coyote In Sheep's Clothing: Predator Identification From Saliva, Christen Lenney Williams, Karen Blejwas, John J. Johnston, Michael M. Jaeger

We used polymerase chain reaction (PCR)-based RFLP (restriction fragment length polymorphism) and microsatellite analyses to identify canid species, gender, and individual genotype in samples containing a large excess of domestic sheep DNA. These methods were then used to investigate the feasibility of identifying predators from saliva on predation wounds. We analyzed predation wound samples from 19 sheep carcasses. Coyote DNA was identified in 18 samples (95%), of which 17 contained male coyote DNA (94%) and 11 (61%) yielded heterozygous microsatellite genotypes at 21 locus. These methods have promise for genetic identification of individual predators.

Birds pose serious hazards at U.S. airports because of the potential for collisions with aircraft. Raptors, in particular, are hazardous to aircraft safety due to their size, hunting behavior, and hovering/soaring habits. Reduction of rodent populations at an airport may decrease raptor populations in the area and therefore, reduce the risk that raptors pose to aircraft. Rodent populations can be reduced by population management (i.e., use of rodenticides) or by habitat management (i.e., vegetation management, barriers, and land uses) that reduces the area’s carrying capacity for rodents. Self-mutilation, which is the act of deliberately harming oneself, has been overlooked in studies of homeless and runaway youth. Given their high rates of abuse and mental health disorders, which are associated with self-mutilation, homeless and runaway youth provide an ideal sample in which to investigate factors associated with self-mutilation among a nonclinical population. Based on interviews with 428 homeless and runaway youth aged 16 to 19 years in 4 Midwestern states, the current study revealed widespread prevalence of self-mutilation among these young people. We compared the hemodynamic and respiratory effects, recovery time, and cost of two gas inhalants (isoflurane and sevoflurane) for anesthetic induction and maintenance of beaver (Castor canadensis) during surgery to implant radio transmitters in the peritoneal cavity. Heart rate, respiratory rate, relative hemoglobin saturation with oxygen (SpO2), and body temperature were measured every 5 min for the first 45 min, and arterial blood gas was measured once, 25 min into the anesthetic procedure. Induction for either agent was smooth and rapid. Heart rate and respiratory rate both decreased during the procedure though neither was lower than …

Some of those steps build on previous Security Council counterterrorism efforts; others represent significant innovations. Can Federal Agencies Authorize Private Suits Under Section 1983 - A Theoretical Approach, Brian Galle

This Article offers a few thoughts on the theory of regulatory enforcement under § 1983. Section 1983, I argue, itself authorizes federal agencies to make their regulations privately enforceable. In recent years, the Supreme Court has announced that federal norms are unenforceable in the absence of clear statutory authorization - a "clear statement rule" for private rights of action. Drawing on key tenets of modern statutory interpretation, I claim that the plain text of § 1983 allows many federal regulations to meet this test. On July 1, 2002, the Rome Statute of the International Criminal Court ("ICC") entered into force, establishing the first permanent international criminal tribunal. Although seventy-six countries had ratified the Rome Statute by that date, the United States was not among them. Instead, Congress responded to the creation of the ICC by passing a bill sponsored by House Majority Whip Tom DeLay (R-Tex.) that Republican legislators had been trying to get through the House and Senate for several years. This report presents the results of an investigation of the performance of a variety of materials added to asphalt binders and mixtures to change their properties, particularly with respect to rutting and cracking. The approach included a field trial of seven polymer and particulate modifiers, supplemented by laboratory characterization of the materials used in the field. The modifiers evaluated included PAC, Novophalt, Multigrade asphalt cement, polyester fibers, Neoprene, SBR and asphalt rubber. The field trial showed that different modifiers do yield different performance. Modifiers are not essential to ensure that the pavement will not rut. None of the mixtures evaluated …

Extensive accumulation of large woody debris at bridge piers poses a chronic and sometimes quite severe problem at several bridge crossings in Indiana. This study, involving both laboratory and field components, examines the factors contributing to the initiation and development of such debris piles. The laboratory study, performed in a rectangular channel with a single model pier (and in some cases with an upstream vertical cylinder modeling a debris deflector, as well as a model sand bar) and both dowels and twigs as model logs, considered the effects of velocity and depth. Since the 1980s, traffic volumes have experienced a rapid growth of approximately 30% in Indiana. Traffic data indicates that more than 70% of vehicles travel in platoons on Indiana highway corridors in the vicinity of urban areas. At a rural highway intersection consisting of a major road with high traffic volume and a minor road with low traffic volume, it is very common that the green time cannot be used efficiently, especially when the vehicle detectors on the major road are imbedded close to the intersection. In-situ penetration tests have been widely used in geotechnical and foundation engineering for site investigation in support of analysis and design. The standard penetration test (SPT) and the cone penetration test (CPT) are two typical in-situ penetration tests. The dynamic cone penetration test shows features of both the CPT and the SPT. The DCPT is performed by dropping a hammer from a certain fall height and measuring penetration depth per blow for each tested depth. The DCPT is a quick test to set up, run, and evaluate on site. Red light running (RLR) is a dangerous act. Approximately 22% of urban crashes at signalized intersections are caused nationwide by RLR. Nearly 1,036 deaths were caused nationwide by RLR in the year 2000. Indiana had no previous research conducted in this area; therefore, this research was aimed at estimating the RLR problem in Indiana.
