The U.S. government maintains a vast amount of personally-identifiable information on millions of American citizens. Much of this information is contained in electronic databases maintained by federal agencies. Various Freedom of Information Act (FOIA) requesters, such as journalists, marketers, and union organizers seek this information for different purposes including investigative reporting and targeted solicitations. These kinds of uses are known as "derivative uses" because this government-compiled information is requested for purposes other than the official purposes for which the information was originally gathered. These and other derivative uses of personally-identifiable information often implicate privacy concerns. Conversely, restrictions on public access …

Diversity Matters: Race, Gender And Ethnicity In Legal Education., Nancy E. Dowd, Kenneth B. Nunn, Jane E. Pendergast

This Article presents more evidence of the inequality that persists in legal education for students. Based on a survey of University of Florida law students conducted in 2001, this study reaffirms the existence of differential experience and an inegalitarian culture in legal education. However, it also demonstrates the importance of diversity and the recognition by a significant majority of students of the value of race and gender pluralism. These competing findings provide a clear guide to the future direction of legal education.

Hardiness As A Career Transition Resource, Katherine Lee Rathburn

The relationship of hardiness to career transition resources was examined. Hardiness scores were obtained through the use of the Cognitive Hardiness Scale (CHS)(Nowack, 1996) and transition resources were measured by the Career Transitions Inventory (CTI) (Heppner, Multon, & Johnston, 1994). The study included 120 male and female adult participants from multiple settings (primarily from a local university, technical college, and job agency) who had a career transition in the last 15 months. Most participants had experienced multiple career-related changes. Coping With Stressful Situations: The Use Of Humor As A Preventative Coping Mechanism For Preceived Stress In Public Speaking, Randall J. Smies

This study attempted to determine the effects of using a humorous intervention as a preventative coping mechanism to lower the perceived stress that can be associated with public speaking. Further, it examined the effects that the humorous intervention would have on both the perceived self-efficacy for the current public speaking and for future public speaking situations. It was hypothesized that a humorous intervention administered before an actual stressful situation in an individual's life would lower stress and also increase their perceived self-efficacy regarding the stressor in the present and in the future.

Throughout the past 20 years, a growing emphasis on client competence building within the psychotherapy literature has led to the creation of specific therapeutic interventions, such as narrative therapy and solution-focused therapy. These interventions offer a distinct alternative to traditional deficit-based interventions, where clients are viewed as having a dysfunction that is causing specific symptoms. This study indirectly compared the experiences of a client undergoing a competence model of helping, solution-focused therapy, with the experiences of the same client undergoing a deficit model of helping, cognitive therapy. Instead of a direct transfer of public funds from government to higher education institutes, a student-centred funding method termed education voucher system is used. The core idea of a voucher system is that the public funding for tuition is being driven by student choice. This change of path of funding has two significant effects, students now have choices and institutes now have to compete for students.

The article argues that the president does not require congressional authorization under the Declare War Clause to engage in hostile acts, as the Constitution's sparse language on war powers intentionally allows flexibility in foreign affairs. It contends that the Declare War Clause is a juridical act, not a prerequisite for initiating hostilities, and that the war powers are fundamentally political rather than legal in nature.

The article discusses the unique ethical and legal challenges faced by criminal defense attorneys in terrorism cases, particularly highlighting the impact of Special Administrative Measures (SAMs), the Foreign Intelligence Surveillance Act (FISA), and the Classified Information Procedures Act (CIPA). The article argues that post-9/11 laws, particularly the Antiterrorism and Effective Death Penalty Act (AEDPA) and the USA PATRIOT Act (USAPA), have dangerously expanded governmental power at the expense of civil liberties. These laws, through provisions like material support for terrorism and the designation of Foreign Terrorist Organizations (FTOs), enable prosecutions that often violate due process and First Amendment rights. The article contends that sacrificing civil liberties for national security is both unnecessary and harmful, part of a historical pattern that undermines democracy and the rule of law.

To predict how species establish and disperse within novel communities, the spatial scale at which competition, predation, and habitat interact must be understood. We explored how these factors affect the distribution and abundance of the exotic crayfishes Orconectes rusticus and O. propinquus and the native O. virilis at both the site-specific and whole-lake scales in northern Wisconsin lakes. During summer 1990, we quantified crayfish, fish predators, and fish diets in cobble and macrophyte sites in Trout Lake, comparing resulting patterns to those in 21 lakes surveyed during summer 1987. Within and across lakes, fish abundance was unrelated to habitat. Within …

Agricultural Experiment Station Circulars (1920-1915)

This publication reports the performance of entries in the 2003 South Dakota corn hybrid performance trials for both non-Roundup-Ready and Roundup-Ready hybrids. Information includes both the most recent 2-year and 1-year grain yields in bushels per acre; and 1-year bushel weight, moisture percentages of shelled corn at harvest, acre harvest population, and stalk lodging percentages. These performance trials are conducted by the South Dakota Crop Performance Testing ( CPT) program at South Dakota State University.

Is Federal Preemption Efficient In Cellular Phone Regulation, Thomas W. Hazlett

While many recent state-level efforts to regulate various aspects of the cellular phone industry have been abandoned in favor of federal regulations, other attempts by state regulators still exist. For this reason, Thomas Hazlett proposes that federal regulation is generally more appropriate than state-level action, due to the nature of the cellular industry. After a brief history of the industry, the author analyzes the pros and cons associated with state and federal regulation. New technological devices which allow consumers to skip commercials are driving corporations to engage in alternative advertising. The development of more “organic” methods of integrating products into the content of television programs makes those advertisements much more difficult to detect. As it becomes more difficult to divorce the product being sold from the content of the program, it also becomes more difficult to determine whether or not an advertisement actually exists.
