Recent Changes To Washington's Jury Trials: A Great System Made Even Better, Jeffrey C. Grant

It was in this spirit that the Board of Judicial Administration created the Washington State Jury Commission in June 1999. The Commission's mandate was to "conduct a broad inquiry into the jury system and examine issues including ... juror responsiveness, citizen satisfaction from jury service, adequacy of juror reimbursement, and improving juror participation in trials." This Article sets forth a brief summary of the Commission's work and examines, in more detail, certain, specific recommendations of the Commission, including those that have been implemented and those that have not. Self-Defense And The Use Of Force: Breaking The Rules, Making The Rules, Or Both?, Mark A. Drumbl

This article examines shifts in international law regarding the use of force -- the jus ad bellum -- that emerged in the wake of the September 11, 2001, terrorist attacks and subsequently were invoked in part by the United States and United Kingdom to justify military intervention in Iraq. These shifts import some elasticity -- in time, space, and place -- into the preexisting legal understanding of self-defense. To be sure, the general consensus that supported the use of force in Afghanistan as a legitimate exercise of self-defense has diluted as the use of that force expanded into other theaters …

This Article explores the appropriateness of preemptive strategies in international law. Are preemptive actions approved by the international community lawful? Can States act unilaterally or in a coalition of the willing to preempt terrorism, the development and transfer of WMD, or other threats? If so, under what circumstances and based on what quantum and quality of evidence? When can preemptive actions be taken against non-State actors such as terrorists who are based in other States?

Enforcement Of Foreign Judgements, The First Amendment, And Internet Speech: Notes For The Next Yahoo! V. Licra, Molly S. Van Houweling

Michigan Journal of International Law

The Article begins with a review of the relevant rules governing enforcement of foreign judgments in the United States. Part II explains how courts have unpersuasively applied these rules when refusing to enforce foreign libel judgments. Part III then explains how the Yahoo! court adopted much of this faulty reasoning. Finally, Part IV explains the considerations that better justify judicial refusal to enforce speech-restrictive foreign judgments, especially those triggered by Internet speech. The Article concludes that the prospect that U.S. Internet speakers will choose to speak only to a U.S. audience-even when their speech would be legal everywhere-is the most …

No Woman Is An Object: Realizing The Feminist Collaborative Video, Alexandra Juhasz

Feminist video does collectivity exceedingly well. Certainly other politicized cultural movements and individuals work through this method, and, of course, feminists also produce work in collaboration in film and other media (as Julia Lesage testifies above). However, I assert that there is a profound natural mechanics to women's work in video that makes the medium's method, theory, and theme the interactive and politicized subjectification of the female sex. Film and patriarchy share the project of women's objectification-they make victims. Video and feminism see women as complex, worthy selves-they produce subjects. The discussion in this Article is divided into four parts. Part I summarizes the landscape, past and present, with respect to insurer collaboration in underwriting. Part II considers whether, absent an antitrust exemption, multiinsurer agreements and collaborative insurer standard-setting with respect to underwriting violate federal antitrust law. This Part also evaluates whether insurers, to the extent potential federal liability exists, enjoy any kind of statutory or judicial exemption from federal law for such activities. This paper is a study of effective competition in the United States Economy, for Sector NAICS 51 -Information. The purpose of the study is to learn current competitive conditions of the U.S. economy, since the last study on this subject is at least 20 years old. It is impossible to do the entire economy in one semester, so one sector was decided upon as a start. Prayer As Interpersonal Coping In The Lives Of Mothers With Hiv, E. James Baesler, Valerian J. Derlega, Barbara A. Winstead, Anita Barbee

Communication & Theatre Arts Faculty Publications

The spirituality of 22 mothers diagnosed with HIV was explored through face-to-face interviews and revealed that 95% of the mothers pray. Active prayers (e.g., talking to God by adoring, thanking, confessing, and supplicating) were more frequently reported than receptive prayers (e.g., quietly listening to God, being open, surrendering). Supplicatory or petitionary prayers for help and health were the most frequent type of prayer, and adoration was the least frequent. The majority of mothers in the sample perceived prayer as a positive coping mechanism associated with outcomes such as: support, positive attitude/affect, and peace. Background: Allogeneic transfusion confers a risk to the recipient and the recent introduction of leucocyte depleted blood has increased cost pressure on health resources. Colorectal surgery is a high blood usage field with 43% of all patients in our unit being transfused, over a three year period. Patient perceptions: Despite the risks associated with transfusion, a majority of patients are willing to have an allogeneic transfusion (85%) and think it is safe (89%), which may have implications in the uptake of alternatives available. JSU Yearbooks

The JSU Yearbook Collection spans the years from 1926 to the present. The publication began in 1926 as the Teacola (some volumes spelled "Teacoala") and continued under this title through 1933. The yearbook appears to have ceased printing after that year; the student newspaper took the name Teacola (later changed to the Collegian and finally the Chanticleer) and began publication in 1934. The yearbook started up again in 1947 under the name Mimosa. The Library holds all volume years that were printed: 1926-1933, 1947-1950, 1952-present.

Americans love to complain about the jury. They complain about being called for jury duty. They complain about jury verdicts in highly publicized cases. They are outraged by the failure to convict "obviously guilty" criminals, such as the police officers in the cases of Rodney King and Amadou Diallo, the Menendez brothers in their first trial, and of course O.J. Simpson. In civil cases, they are appalled when plaintiffs win huge damage awards in "obviously frivolous" lawsuits.
