The Forseeability Of Transference: Extending Employer Liability Under Washington Law For Therapist Sexual Exploitation Of Patients, Timothy E. Allen

Transference, or the idealization of therapists, is a phenomenon that is foreseeable in every relationship between a therapist and a patient, and makes patients uniquely vulnerable to sexual exploitation by therapists. Transference has been recognized as a basis for finding therapists directly liable for harm resulting from sexual relations with patients. However, limitations on damages directly available from therapists lead patients to seek redress from therapists' employers under theories of employer liability. Washington courts generally deny victimized patients relief from the employers of sexually exploitative therapists. In Europe, 6 of the 11 genospecies of Borrelia burgdorferi sensu lato are prevalent in questing Ixodes ricinus ticks. In most parts of Central Europe, B. afzelii, B. garinii, and B. valaisiana are the most frequent species, whereas B. burgdorferi sensu stricto, B. bissettii, and B. lusitaniae are rare. Previously, it has been shown that B. afzelii is associated with European rodents. Therefore, the aim of this study was to identify reservoir hosts of B. garinii and B. valaisiana in Slovakia. External egg morphology of ten species of Lower Rio Grande Valley (LRGV) mayflies are compared using scanning electron microscopy (SEM) and a taxonomic key to the eggs is provided. The eggs of five species are described here for the first time. Preserved female adults or subadults were critical-point dried using liquid CO2 . The eggs were removed and placed on metal stubs for sputter coating with gold/palladium. The coated eggs were then observed and photographed by SEM. The morphological features described were the chorionic sculpturing, polar caps, accessory attachment structures, and micropyles. This is the first mayfly egg comparison and …

Habitat Associations Of Rare Species: A Case Study Using Columbia Spotted Frogs (Rana Luteiventris) In Utah, Nathan E. Welch

Conservation plans benefit from basic ecological information about factors that limit the distribution of focal species. This study illustrates two observational approaches used to investigate the ecology of the Columbia spotted frog (Rana luteiventris), a rare species in Utah. First, hypothesized frog-habitat associations were evaluated by comparing occupied and apparently unoccupied ponds. Data were analyzed using Akaike's Information Criterion to quantify evidence for hypotheses and to select predictive models. Although variable, results suggest frogs are more likely to be found in ponds that do not shrink in size seasonally, maintain a relatively constant seasonal water temperature, and have …

The Common Garter Snake (Thamnophis sirtalis) preys upon the Rough-skinned Newt (Taricha granulosa), which contains tetrodotoxin (TTX). I investigated how snakes consume potentially deadly newts and the consequences thereof. Individual snakes assess their resistance relative to newt toxicity and reject prey too toxic to consume. Behavioral moderation of toxin exposure provides the association between individual resistance and fitness necessary for the coevolution of lethal toxins and resistance. After newt consumption, snakes experience tremendous toxin loads. Because TTX is extremely toxic, present in large quantities in newts, and highly resistant snakes ingest multiple newts, snakes can harbor …

Using properties of moment stationarity we develop exact expressions for the mean and covariance of allele frequencies at a single locus for a set of populations subject to drift, mutation, and migration. Some general results can be obtained even for arbitrary mutation and migration matrices, for example: (1) Under quite general conditions, the mean vector depends only on mutation rates, not on migration rates or the number of populations. (2) Allele frequencies covary among all pairs of populations connected by migration. As a result, the drift, mutation, migration process is not ergodic when any finite number of populations is exchanging …

The Persistence Of Ecological-Economic Systems: Alternate Measures And Their Properties, Amitrajeet A. Batabyal

A number of ecologists and some economists have commented on the significance of persistence as a stability concept for jointly determined ecological-economic systems. This notwithstanding, the economics and the regional science literatures have paid scant attention to the problem of computing an ecological-economic system’s persistence. As such, this paper has two objectives. First, we derive three measures of the persistence of a jointly determined ecological-economic system whose temporal behavior is governed by the presence of thresholds. Next, we compare and contrast these three measures. Finally, we discuss their theoretical properties and their practical uses.

This report is submitted to Florida Department of Environmental Regulation (FDER) to satisfy the requirements set forth in specific condition No. 10 of Howard F. Curren WWTP permit FL0020940-001-DW1P. The report is based on data obtained by the City of Tampa (COT) surface water compliance monitoring program approved on August 14, 2000 by the FDEP. The report also includes examination of long-term trends for water quality parameters and biological indicators collected by the City of Tampa Bay Study Group and the Environmental Protection Commission of Hillsborough County (EPC).

Breaking The Cycle Of Defeat For 'Deadbroke' Noncustodial Parents Through Advocacy On Child Support Issues, Daniel L. Hatcher, Hannah Lieberman

The child support system is not serving low-income families well. Custodial parents are not receiving the child support they need. Enforcement of child support for lowincome parents receiving welfare primarily benefits the state because the payments are owed to the government. Low-income noncustodial parents face unrealistically high child support orders and large arrearages take so much of their wages that they cannot support themselves. They go to jail-often recurrently-because they cannot meet their obligations and thereby lose the opportunity to keep a job. Their driver's licenses are suspended because they have not paid their support. To evade this punitive cycle, …

Forensic DNA testing suggests that potentially large numbers of innocent persons are being convicted of crimes. Case studies conducted both prior to and following the advent of DNA testing indicate that eyewitness error is at least partially responsible for the majority of wrongful convictions. Empirical research has shown which factors contribute to eyewitness error and has identified procedural changes that could be made in the criminal justice system to significantly reduce the number of erroneous eyewitness identifications. We report the results of a brief survey of what U.S. judges know and believe about eyewitness testimony. The present survey highlights what …

In the 1880s a curious phenomena was observed: when a ray of light, no matter how weak, hit certain metals; electrons were emitted from the surface. Called the “photoelectric effect”, this puzzle was never explained until much later. In 1905, Albert Einstein put forth one possible explanation, which is currently accepted as correct. Einstein proposed that light propagated in discrete energy packets rather than as a continuous wave. While most scientists disbelieved Einstein theory, it was later proved in detail by Robert Milikan.1 Rays of light traveling in discrete packets hit metal surfaces, depositing energy. As population increases, so does the need to improve and augment the road network. Construction of new roadways or modification of existing roads often requires diversion or modification of streams. If a stream is disturbed, government regulations require mitigation or compensatory replacement of the affected area in a similar environment. Stream mitigation is of particular importance in Kentucky, as Kentucky ranks second in the United States for having the most miles of waterways. Consequently, stream mitigation has become a significant factor in roadway construction costs. To date, no studies have been made to assess the execution of the mitigation plans …

The purpose of this project is to investigate the distribution and anti-herbivore impact of extra-extrafloral nectaries (EEFNs) and leaflet pair number on Inga sierrae (Fabacaeae: Mimosaceae) in Monteverde, Costa Rica. I recorded the number of EEFNs and leaflet pairs per leaf for forty leaves collected from sixty trees from three different locations. EEFNs, though not commonly found on I. sierrae, did significantly reduce the percent herbivory on leaves (1-way ANOVA, P < 0.0001 and Exponential Regression Analysis; R2 = 0.0001). The most commonly encountered leaflet pair number was three. However, when the number of leaflet pairs decreased, percent herbivory increased (Exponential Regression Analysis, R2 = 0.9905, P < 0.0001 and 1-way ANOVA, P < 0.0001). Heavy herbivory pressure could be causing a species change toward increased production of EFNs.

Pedicel and style lengths of fig flowers were measured in order to determine their role in regulating seed and wasp production within a Ficus tuerkheimii fig. Figs were collected in two groups at two different stages in development. Foundress number, foundress ovipositor length, pedicel lengths, and style lengths were measured (to the nearest micrometer) in the younger figs. Flower pedicel lengths were measured (to the nearest micrometer) and flower occupancy was recorded in mature, but unripe figs. Young figs: In a sample size of 10 young figs, 60% had two foundresses, 20% had one, and 20% had three. The average …

Tree Size And Habitat Effects On Stream Gall Abundance In Conostegia Oerstediana (Melastomataceae), May 2003, Priya Shashidharan

The moth Mompha sp. (Coleophoridae, Lepidoptera) is known to induce a stem gall on the tree Conostegia oerstediana (Melastomataceae). There is little known about the distribution and abundance of galls. This study tested the difference in stem gall abundance between varying tree sizes and between two different habitats- pasture and secondary forest. Trees from each habitat were sampled and measured for diameter at breast height (DBH), height, number of branches, and number of galls. A significant difference was found between pasture and forested areas (unpaired t-test, p < 0.0001), with pasture trees having more galls. No relation was found relating tree size (DBH, height, number of branches) to gall abundance. I conclude from these results that tree size is not directly related to stem gall abundance. Instead, differences in habitats, such as predator and parasite abundance and host density, may be important factors that influence gall abundance.
