Asylum, Social Group Membership And The Non-State Actor: The Challenge Of Domestic Violence, Michael G. Heyman Jun 2003

Asylum, Social Group Membership And The Non-State Actor: The Challenge Of Domestic Violence, Michael G. Heyman

University of Michigan Journal of Law Reform

This Article argues that the current approaches to asylum claims based on "social group" membership under the U.N. convention Relation to the Status of Refugees are deeply flawed. The Refugee Convention confers asylum on persons persecuted for their membership in a particular social group. Courts have struggled with the boundaries of the social group definition, and there appears to be no coherent way to reconcile all of the court decisions on what groups qualify as social groups under the Refugee Convention.

This Article suggests that courts adopt a consistent definition of what constitutes a social group. The definition proposed in …

Transforming Nato Command And Control For Future Missions, Charles L. Barry Jun 2003

Transforming Nato Command And Control For Future Missions, Charles L. Barry

Defense Horizons

No military function is more critical to operational success than effective command and control (C2). There also is no more daunting military function to get right when it comes to the employment of complex multinational formations in the fast-paced arena of crisis response. Since the Cold War, the North Atlantic Treaty Organization (NATO)—unique as an alliance with a permanent standing C2 structure—has ventured into a broader spectrum of missions and across a wider geographical area of operations, posing far greater C2 challenges than the single mission, fixed-territory defense of the past. Threats to NATO interests have increased, demanding military structures …

Brood Parasitism, Egg Transfer, And Egg Destruction In Cave Swallows And Cliff Swallows Of South Texas, Heath Weaver, Charles R. Brown Jun 2003

Brood Parasitism, Egg Transfer, And Egg Destruction In Cave Swallows And Cliff Swallows Of South Texas, Heath Weaver, Charles R. Brown

Bulletin of the Texas Ornithological Society

We studied the frequency and ecological correlates of intraspecific brood parasitism, physical transfer of eggs between nests, and destruction of eggs by conspecifics in colonially nesting Cave Swallows (Petrochelidon fulva) and Cliff Swallows (P. pyrrhonota) in south Texas in 2001. Brood parasitism was detected in 4.6–5.0% of Cave Swallow nests and in 10.7–11.9% of Cliff Swallow nests. Brood parasitism was not significantly related to colony size in either species, to eventual success of the host nest, to overall colony nesting success, or to date of clutch initiation. Brood parasitism was more common than expected in nests with larger clutches. Physical …

Age Classes Of The White-Tailed Hawk, William S. Clark Jun 2003

Age Classes Of The White-Tailed Hawk, William S. Clark

Bulletin of the Texas Ornithological Society

The White‑tailed Hawk (Buteo albicaudatus) is unusual for a Buteo in having three immature plumages: juvenile, Basic I, and Basic II. Most buteos have only one immature plumage, juvenile, and no others have three. I will show and describe the differences in these plumages, including that of adults, using slides of hawks in hand, perched, and flying. Juveniles are overall dark, quite different from adults. They could be mistaken for dark Swainson’s Hawks (Buteo swainsoni). Basic I birds have white breasts and dark belly bands, appearing somewhat similar to some Red-tailed Hawks (Buteo jamaicensis). Basic II birds are nearly adult …

Investigating The Geoelectrical Response Of Hydrocarbon Contamination Undergoing Biodegradation, D. Dale Werkema, Estella A. Atekwana, Anthony L. Endres, William August Sauck, Daniel P. Cassidy Jun 2003

Investigating The Geoelectrical Response Of Hydrocarbon Contamination Undergoing Biodegradation, D. Dale Werkema, Estella A. Atekwana, Anthony L. Endres, William August Sauck, Daniel P. Cassidy

Geosciences and Geological and Petroleum Engineering Faculty Research & Creative Works

A newly proposed geoelectrical model for hydrocarbon contaminated sites predicts high conductivities coincident with the contaminated zone as opposed to the traditionally accepted low conductivity. The model attributes the high conductivities to mineral weathering resulting from byproducts of microbial redox processes. To evaluate this conductive model, in situ vertical conductivity measurements were acquired from a light non-aqueous phase liquid (LNAPL) contaminated site. The results showed high conductivities coincident with the zone of contamination and within the smear zone influenced by seasonal water table fluctuations. We infer this zone as an active zone of biodegradation and suggest significant microbial degradation under …

The Quality Of Mercy Is Strained: How The Procedures Of Sexual Harassment Litigation Against Law Firms Frustrate Both The Substantive Law Of Title Vii And The Integration Of An Ethic Of Care Into The Legal Profession, Jay Marhoefer Jun 2003

The Quality Of Mercy Is Strained: How The Procedures Of Sexual Harassment Litigation Against Law Firms Frustrate Both The Substantive Law Of Title Vii And The Integration Of An Ethic Of Care Into The Legal Profession, Jay Marhoefer

Chicago-Kent Law Review

Despite the Supreme Court's clarification of substantive sexual harassment law in Faragher and Ellerth, achievement of remedies remains problematic because of the at times labyrinthine procedures of Title VII litigation. This is especially true when sexual harassment occurs in the legal profession because defendant law firms understand how to frustrate substantive outcomes and plaintiffs must look to the same system that engendered the harassment to provide them with remedies. Female plaintiffs that apply a feminist ethic of care to the dispute by seeking an in-house remedy first are likely to be further disadvantaged because of procedural requirements like mandatory …

Integrating Biological Principles In Environmental Engineering Education: Summary Results Of A Three-Year Pilot Study, Daniel B. Oerther Jun 2003

Integrating Biological Principles In Environmental Engineering Education: Summary Results Of A Three-Year Pilot Study, Daniel B. Oerther

Civil, Architectural and Environmental Engineering Faculty Research & Creative Works

Teaching biology to engineers is a challenge. For environmental engineers, biological principles are necessary to understand microorganisms that are removed from drinking water as well as microorganisms that treat waste in sewage treatment plants and bioremediation field sites. At the University of Cincinnati, we integrated state-of-the-art research in environmental microbiology within our graduate and undergraduate environmental engineering curricula. For the past three years, we taught a novel course entitled, "Molecular Biology in Environmental Engineering." Course evaluations over the past three years suggested that the course was successful for primarily two reasons, namely: (1) the course employed a problem-based learning approach …

White-Winged Dove Expansion Across Texas And Beyond, Gary Waggerman Jun 2003

White-Winged Dove Expansion Across Texas And Beyond, Gary Waggerman

Bulletin of the Texas Ornithological Society

White‑winged Doves (Zenida asiatica) are becoming common place in many urban areas of Texas. In Texas these doves historically used to be restricted to South and West Texas. Some of the historical habitat changes and human population shifts may have brought about this shift further north. A brief summary of the past 50 years of population estimates and habitat development and preservation will be presented to bring the audience up to date on the history of this bird.

Morphological Biosignatures And The Search For Life On Mars, Sherry L. Cady, Jack D. Farmer, John P. Grotzinger, J. William Schopf, Andrew Steele Jun 2003

Morphological Biosignatures And The Search For Life On Mars, Sherry L. Cady, Jack D. Farmer, John P. Grotzinger, J. William Schopf, Andrew Steele

Geology Faculty Publications and Presentations

This report provides a rationale for the advances in instrumentation and understanding needed to assess claims of ancient and extraterrestrial life made on the basis of morphological biosignatures. Morphological biosignatures consist of bona fide microbial fossils as well as microbially influenced sedimentary structures. To be recognized as evidence of life, microbial fossils must contain chemical and structural attributes uniquely indicative of microbial cells or cellular or extracellular processes. When combined with various research strategies, high-resolution instruments can reveal such attributes and elucidate how morphological fossils form and become altered, thereby improving the ability to recognize them in the geological record …

Chromatin Of Endoreduplicated Pavement Cells Has Greater Range Of Movement Than That Of Diploid Guard Cells In Arabidopsis Thaliana, Naohiro Kato, Eric Lam Jun 2003

Chromatin Of Endoreduplicated Pavement Cells Has Greater Range Of Movement Than That Of Diploid Guard Cells In Arabidopsis Thaliana, Naohiro Kato, Eric Lam

Faculty Publications

In the current model of chromatin organization in the interphase cell nucleus, chromosomes are organized into territories. Although constrained diffusion of chromatin in interphase cells has been confirmed in all cell types examined, little is known about chromatin dynamics in plant interphase cells. In this work, we measured for the first time interphase chromatin dynamics in plants using the green-fluorescent-protein-mediated chromatin-tagging system. Moreover, we compared the dynamics of diploid guard cells and endoreduplicated pavement cells. The movement of tagged loci in live seedlings shows constrained behavior in both types of nuclei. However, we found that the apparent confinement area for …

Predicting Severe Wildfire Years In The Florida Everglades, Brian Beckage, William J. Platt Jun 2003

Predicting Severe Wildfire Years In The Florida Everglades, Brian Beckage, William J. Platt

Faculty Publications

© 2003 The Ecological Society of America. Wildfires result in important ecological benefits to many ecosystems, but have costs associated with fire fighting and property loss. Accurate, timely forecasts of the severity of upcoming wildfire seasons could facilitate wildfire management, limiting the most destructive aspects of fires, while preserving their ecological benefits. We demonstrate an approach where time series models are used to predict the severity of the wildfire season in Everglades National Park in southern Florida 3 months and 1 year beforehand. Model predictions contained all obserations within a 90% credible interval and also anticipated severe wildfire seasons. These …

A Research Agenda For Political Personality And Leadership Studies: An Evolutionary Proposal, Aubrey Immelman, Theodore Millon Jun 2003

A Research Agenda For Political Personality And Leadership Studies: An Evolutionary Proposal, Aubrey Immelman, Theodore Millon

Psychology Faculty Publications

Despite major neuroscientific advances in the past two decades and parallel conceptual refinement in evolutionary theory, personality-in-politics inquiry remains adrift, divorced from these broader spheres of scientific knowledge. This paper reviews the neurobiological substrates of three major domains of evolutionary biology and behavioral ecology relevant to political personality assessment and the psychological examination of political leaders; furnishes a context and set of guiding ideas to revitalize the study of the person as biopsychosocial entity in politics; advances a generative theory of personality and political leadership performance; and proposes an agenda for advancing personality-in-politics and leadership inquiry, informed by insights derived …
