Problem-Solving Courts: From Innovation To Institutionalization, Michael C. Dorf, Jeffrey A. Fagan
Problem-Solving Courts: From Innovation To Institutionalization, Michael C. Dorf, Jeffrey A. Fagan
Faculty Scholarship
The phenomenal growth of drug courts and other forms of "problem-solving" courts has followed a pattern that is characteristic of many successful innovations: An individual or small group has or stumbles upon a new idea; the idea is put into practice and appears to work; a small number of other actors adopt the innovation and have similar experiences; if there is great demand for the innovation – for example, because it responds to a widely-perceived crisis or satisfies an institutional need and resolves tensions within organizations that adopt it – the innovation rapidly diffuses through the networks in which the …
Blaming Youth, Elizabeth S. Scott, Laurence Steinberg
Blaming Youth, Elizabeth S. Scott, Laurence Steinberg

In March of 2001, a fourteen-year-old Florida boy named Lionel Tate was sentenced to life in prison without parole for killing six-year-old Tiffany Eunick during a wrestling match that took place when Lionel was twelve years old. Lionel was convicted of first degree murder on the ground that the killing was the result of aggravated child abuse, a crime that contemplates injury of a child by an adult caretaker. His conviction and sentence have prompted much debate and discussion – about his case and, more generally, about the criminal punishment of young offenders. Although the verdict and Lionel's sentence received …
Contract Theory And The Limits Of Contract Law, Alan Schwartz, Robert E. Scott
Contract Theory And The Limits Of Contract Law, Alan Schwartz, Robert E. Scott
Faculty Scholarship
Contract law has neither a complete descriptive theory, explaining what the law is, nor a complete normative theory, explaining what the law should be. These gaps are unsurprising given the traditional definition of contract as embracing all promises that the law will enforce. Even a theory of contract law that focuses only on the enforcement of bargains must still consider the entire continuum from standard form contracts between firms and consumers to commercial contracts among businesses. No descriptive theory has yet explained a law of contract that comprehends such a broad domain. Normative theories that are grounded in a single …
When Code Isn't Law, Tim Wu
When Code Isn't Law, Tim Wu

When the Supreme Court upheld extended copyright terms in Eldred v. Ascroft, many Internet activists called for renewed political action in the form of appeals to Congress or even a campaign to amend the Constitution. But others suggested a very different course: They argued that it would be wiser to forgo institutions controlled by the powers of the past, and to return instead to the keyboard to write the next generation of "lawbusting" code. In the words of one observer, "tech people are probably better off spending their energy writing code than being part of the political process" because …
Whom (Or What) Does The Organization's Lawyer Represent?: An Anatomy Of Intraclient Conflict, William H. Simon
Whom (Or What) Does The Organization's Lawyer Represent?: An Anatomy Of Intraclient Conflict, William H. Simon
Faculty Scholarship
Professional responsibility issues involving organizational clients are distinctively difficult because organizations consist of constituents with conflicting interests. Legal doctrine has only recently begun to address the effect of internal conflict on a lawyer's responsibilities to an organizational client. Under current doctrine, the lawyer's responsibilities differ strongly depending on whether the representation is characterized as 'joint" representation of the organization 's constituents or "entity" representation. This Article argues that the choice between the two characterizations often has been arbitrary and that the underlying differences between them have been misunderstood. With respect to entity representation, it criticizes a prominent tendency in the …
Criminal Defenders And Community Justice: The Drug Court Example, William H. Simon
Criminal Defenders And Community Justice: The Drug Court Example, William H. Simon
Faculty Scholarship
The Community Justice idea and its core institution – the Community Court – is an ambitious innovation intended to generate new solutions and practices. It thus inevitably calls for adaptation of the established roles associated with the court system, and especially the criminal justice system. It asks practitioners to learn new skills, to accept new conventions, and to participate in the elaboration of a rapidly evolving experiment.
It is thus not surprising that many lawyers are anxious about the system. It remains an interesting question, however, whether their anxiety represents something more than the discomfort that change and challenge typically …
Who Needs The Bar?: Professionalism Without Monopoly, William H. Simon
Who Needs The Bar?: Professionalism Without Monopoly, William H. Simon
Faculty Scholarship
Professionalism has an idealistic dimension and an institutional one. The idealistic dimension is the notion of voluntary commitment to both client interests and public values. The institutional dimension is the ideal of self-regulation by the bar.
The idealistic dimension remains powerful. However disappointed we are by the distance between the profession's ideals and its members' practices, these ideals continue to inspire valuable efforts. Various professional organizations are making admirable contributions through pro bono representation of disadvantaged people, public education, and disinterested law reform efforts in a range of areas, such as litigation procedure, prisons, and judicial selection. Moreover, the bar's …

Agent Chameleons: Agent Minds And Bodies, Brian Duffy, Gregory O'Hare, Alan Martin, John Bradley, Bianca Schoen-Phelan
Conference papers
Agent design has to date concerned itself with the issues pertaining to a single body embedded in a single environment, whether virtual or real. This paper discusses the notion of an agent capable of migrating between information spaces (physical worlds, virtual reality, and digital information spaces). An architecture is presented that facilitates agent migration and mutation within such environments. This will in turn support agent
evolution the ultimate in agent adaptivity

The Efficiacy Of The Mmpi-2 Lees-Haley Fake Bad Scale (Fbs) For Differentiating Neurocognitive And Psychiatric Feigners, Victoria Louise Vagnini
The Efficiacy Of The Mmpi-2 Lees-Haley Fake Bad Scale (Fbs) For Differentiating Neurocognitive And Psychiatric Feigners, Victoria Louise Vagnini
University of Kentucky Doctoral Dissertations
The FBS (Lees-Haley, 1992) is a relatively new validity scale for the MMPI-2 designed specifically to detect feigned neurocognitive deficit. The aim of the present study was to examine the FBSs efficacy in differentiating psychiatric and neurocognitive feigners using a known-groups design. Malingering tests were administered to 180 individuals undergoing forensic neuropsychiatric evaluations. Based on the malingering test results, participants were classified as honest responders, psychiatric feigners, neurocognitive feigners, or feigning both psychiatric and neurocognitive deficits. The FBS significantly differentiated the 3 feigning groups from the honest group, but it did not discriminate effectively between neurocognitive and psychiatric feigners.
The Independent Rep As A Source Of Competitive Advantage: An Actionable Scale For Rep Selection, Kathleen H. Gruben, Barbara J. Coe
The Independent Rep As A Source Of Competitive Advantage: An Actionable Scale For Rep Selection, Kathleen H. Gruben, Barbara J. Coe
Marketing: Faculty Publications
This study develops a scale that offers an actionable approach for suppliers’ use in selecting their reps. Rep selection is the critical first step suppliers take in developing profitable, long-term relationships with retailers. Retailers’ loyalties are often bestowed on the rep, rather than the supplier. As identified in the study, the rep needs to be professional, accommodating, ethical, sensitive, and compassionate to satisfy the retailer. The scale provides suppliers a technique for measuring these characteristics. Prior to this scale, no instrument was available to measure these characteristics, which increase the retailer’s likelihood of developing loyalty.
The Infusion Of Higher Education In The U.S. Army: A Sociolinguistic Study Of An Organizational Information Dissemination Process, Gerald Allen Kehr
The Infusion Of Higher Education In The U.S. Army: A Sociolinguistic Study Of An Organizational Information Dissemination Process, Gerald Allen Kehr
College of Graduate Studies: Theses & Dissertations (1964–2006)
The present research was dedicated to uncovering sociolinguistic coupling mechanisms, specifically the metaphor, and their role in the infusion of higher education in the U S .Army It was argued that levels of ambiguity connected to inter-sociolect lexicons embedded within sociolect-specific metaphors may impede effective communication between officers and senior enlisted personnel regarding the role of higher education in the overall U. S. Army mission Information gained from this research is dedicated to the development of how the U.S military can better infuse higher education into its ongoing professional development programs. A qualitative interview method was used to conduct the …

A qualitative analysis was used to examine the life values gained and enhanced through participation in youth soccer from the player, coach, and parent perspectives. Nine players, nine coaches, and nine parents were interviewed for this study. Participants were placed in groups according to classification and availability, and participants not available for the group times, were individually interviewed. The interview guides consisted of 11 questions, and two separate guides were used, one for players and one for coaches and parents. All interviews were hand, audio, and video recorded. Triangulation, involving the primary researcher and two additional researchers familiar with qualitative …
An Inquiry Into Gardner's Theory Of Multiple Intelligences And Strengths Of Students Placed In Special Education Under Mildly Disabled Categories, Kathryn Sandiford Harrell
An Inquiry Into Gardner's Theory Of Multiple Intelligences And Strengths Of Students Placed In Special Education Under Mildly Disabled Categories, Kathryn Sandiford Harrell
College of Graduate Studies: Theses & Dissertations (1964–2006)
This study explored the strengths displayed by 4th-5th grade students placed in special education under mildly disabled categories as compared to the intelligences defined by Howard Gardner in his Theory of Multiple Intelligences (Gardner, 1983, 1999). These categories consist of Specific Learning Disabilities (SLD) and Mildly Intellectually Disabled (MUD). Critics maintain that special education has been focused on the weaknesses of students while overlooking their strengths (Miller, 1993; Armstrong, 2000). Under new legislation and new performance goals for special education, the time has come to focus on students' strengths and equal opportunities for students to learn the curriculum mandated by …

Effectiveness Of Education On Diabetes Control, Irene Nganga
College of Graduate Studies: Theses & Dissertations (1964–2006)
The purpose of this study was to examine the effect of a diabetes education intervention strategy on the clinical and biochemical status of patients in the Diabetes Complications Prevention Study (DCPS) at Candler County Hospital in Metter, Georgia. The participants in this study were all active members in the DCPS program. This intervention group was paired to control group members of a similar age and race. A sample size of 18 participants and an equal number of controls was chosen for this evaluative study. The sampling method utilized for participants in the study was non-probability quota sampling. Medical records were …
The Prevalence Of Disordered Eating Behaviors Among Sorority Versus Non-Sorority Women, Angela Lynn Guzman
The Prevalence Of Disordered Eating Behaviors Among Sorority Versus Non-Sorority Women, Angela Lynn Guzman
College of Graduate Studies: Theses & Dissertations (1964–2006)
Eating disorders among college women is a serious psychological problem. Disordered eating behaviors were examined and diagnosed at a mid-sized university in southeast Georgia. The target group of this study was university sororities. The purpose of this study was to examine sorority versus nonsorority women to determine if there was a higher prevalence for those involved in sororities to develop disordered eating behaviors.
Surveys were distributed to both sorority and non-sorority women to determine the prevalence of disordered eating behaviors among each group. A quantitative, quasi-experimental design was used in conjunction with the Eating Attitudes Test (Gamer & Garfmkle, 1979). …

An Army Of One... With Dependents: A History Of The Army Family, Stacey Lynne Brown
College of Graduate Studies: Theses & Dissertations (1964–2006)
Family members have accompanied the army for the entire 227-year history of the organization. This thesis outlines the formation of the army family and its continuation through times of peace and war. It establishes the army family as a community based on the existence of three elements: geographic location, social interaction, and common ties. The results of the research for this paper establish a common experience among the members of the army family that exists throughout history and is a vital part of the success and continuation of the community.
The Predictive Utility Of Competitive Trait Anxiety, Social Support, And Daily Hassles For Athletic Injury, Joseph M. Mannion
The Predictive Utility Of Competitive Trait Anxiety, Social Support, And Daily Hassles For Athletic Injury, Joseph M. Mannion
College of Graduate Studies: Theses & Dissertations (1964–2006)
The purpose of this study was to examine the predictive utility of competitive trait anxiety, using a multidimensional measure (Sport Anxiety Scale, Smith, Smoll, & Schutz, 1990) with an added directional component (Jones & Swain, 1992), social support (Social Provisions Scale, Russell & Cutrona, 1984), daily hassles (Daily Hassles Scale, Kanner, Coyne, Schaefer, & Lazarus, 1981), and gender for athletic injury frequency and severity. Questionnaires were administered to 10 male and female high school basketball teams (N= 103) at the beginning of the 2000 - 2001 season, and injury data was collected from that point throughout the regular season. Lists: Starting Points For Researching And Writing The Histories Of Academic Departments, Michael R. Hill
Lists: Starting Points For Researching And Writing The Histories Of Academic Departments, Michael R. Hill
Department of Sociology: Faculty Publications
The discovery, imaginative construction, and methodical compilation of lists is a productive initial strategy for researching and writing the histories of academic department and small professional organizations. When purposefully conceptualized as inclusive, list construction provides a methodological framework that curtails the seemingly inherent tendency of historical writers to overlook the contributions and participation of minority members of professional organizations – I use the term “minority” here in the widest possible sense, to indicate virtually anyone who by one criterion or another has come to be defined or perceived as somehow “marginal” or “unimportant” to the historical record you are documenting.

Cad Associate Degree Programs In Public Post-Secondaryeducation, Xin-Ran Duan
All-Inclusive List of Electronic Theses and Dissertations
This study investigated what community colleges were teaching in CAD associate degree programs in manufacturing and construction fields, and what knowledge and skills were required to empower CAD students to become successful in the workplace. In order to better meet business and industry needs, a model curriculum for CAD associate degree programs was developed and presented. This model curriculum could more effectively prepare students with the required knowledge and skills for successful employment. A three-round Delphi technique was used to collect data from CAD professors at community colleges and experts in industry. A total of 32 members in the Panel …
