Miranda'S Poisoned Fruit Tree: The Admissibility Of Physicial Evidence Derived From An Unwarned Statement, Kirsten Lela Ambach Aug 2003

Miranda'S Poisoned Fruit Tree: The Admissibility Of Physicial Evidence Derived From An Unwarned Statement, Kirsten Lela Ambach

Washington Law Review

Miranda v. Arizona created an exclusionary rule that prohibits using, as part of the prosecution's case in chief, evidence that is obtained as the result of unwarned custodial interrogation. In Michigan v. Tucker and Oregon v. Elstad, the United States Supreme Court narrowed the scope of this rule in relation to the "fruit of the poisonous tree" doctrine that excludes all evidence derived from constitutional violations. The Tucker Court held that the testimony of a witness identified from an unwarned statement should be admitted, and the Elstad Court held that a warned statement following an unwarned statement should also …

A Study Of The Perceptions Of Female Displaced Workers In A Community College Regarding Their Educational Expectations And Barriers To Their Achievement., Pashia H. Hogan Aug 2003

A Study Of The Perceptions Of Female Displaced Workers In A Community College Regarding Their Educational Expectations And Barriers To Their Achievement., Pashia H. Hogan

Electronic Theses and Dissertations

Adult women enter or reenter college for a variety of reasons, one of which is because of the loss of a job and the need to retrain for reentry into the workforce. The purpose of this phenomenological study was to investigate the actual experiences of female displaced workers entering community college, as compared with their initial expectations as adult learners. Data were collected through interviews with 23 displaced workers age 25 or older who were either enrolled in or had graduated from an associate of applied science degree program at Northeast State Technical Community.

Interview transcripts were analyzed using Glaser …

Southern Star., Shanda Schrae Miller

Electronic Theses and Dissertations

“Southern Star” follows protagonist Sally Gayle through the cycle of maturation. Complex family relationships and secrets hinder Sally as she searches for her identity in this bidungsroman set in a small, rural area of Southern Appalachia. Taking a minimalist, cinematic approach, “Southern Star” experiments with form and technique in an attempt to convey pure story to the reader. The work particularly focuses on character development, authentic dialogue, and a sense of place.

What Is Known About Testing For Discrimination: Lessons Learned By Comparing Across Different Markets, Stephen L. Ross Aug 2003

What Is Known About Testing For Discrimination: Lessons Learned By Comparing Across Different Markets, Stephen L. Ross

Economics Working Papers

The paper provides a fairly comprehensive examination of recent empirical work on discrimination within economics. The three major analytical approaches considered are traditional regression analysis of outcomes, paired testing or audits, and finally analysis of performance where higher group performance suggests that a group has been treated disfavorably. The review covers research in the labor, credit, and consumption markets, as well as recent studies of discrimination within the legal system. The review suggests that the validity of interpreting observed racial differences as discrimination depends heavily on whether the analysis is based on a sample that is representative of a population …

Perception Of The Treatment Efficacy Of Therapeutic Magnets On Pain Control Of Exercise Induced Muscle Soreness In The Non-Dominant Wrist And Forearm In High School Athletes, Stacy L. Schlumbohm Aug 2003

Perception Of The Treatment Efficacy Of Therapeutic Magnets On Pain Control Of Exercise Induced Muscle Soreness In The Non-Dominant Wrist And Forearm In High School Athletes, Stacy L. Schlumbohm

Masters Theses

The purpose of the study was to determine if patient perceptions had a significant influence on the perceived success of therapeutic magnets. Volunteer subjects included 33 (14=Female, 19=Male) high school athletes. The subjects were divided into a control group and two treatment groups. Treatment group 1 received Nikken-Kenko Magnetic Promo Pad (2.15"x 3.23") and treatment group 2 received a placebo magnet. Treatment groups underwent an exercise induced muscle soreness protocol for the non-dominant wrist. The test groups completed a pain questionnaire every 12 hours for 96 hours. A post-test questionnaire was administered to the test groups at the conclusion of …

"Paper Sack Brown" : Effects Of Age, Skin Tone, And Stereotype Threat On Cognitive Performance And Self-Efficacy Among African Americans, Breonte Stephan Guy Aug 2003

"Paper Sack Brown" : Effects Of Age, Skin Tone, And Stereotype Threat On Cognitive Performance And Self-Efficacy Among African Americans, Breonte Stephan Guy

Master's Theses

Divergent African American skin tones have led to negative stereotypes and outcomes regarding darker-skinned African Americans in many domains, including educational and occupational (Hill, 2002). This study assessed the effects of skin tone and stereotype threat (Steele and Aronson, 1995; Steele, 1997) on cognition in younger and older African Americans. A 2(Skin Tone: light, dark) X 2(Age: young, old) X 2(Stereotype Threat: Threat, Non-Threat) between subjects design was used. Seventy-four African American adults ranging in age from 18 to 86 years completed a battery of cognitive measures. Darker-skinned adults performed more poorly on three tests of intelligence, a paired-associates memory …

The Presence Of Pups After Birth : Effects On Spatial Memory And The Pre-Synaptic Protein Synaptophysin, Abbe Hoffman Macbeth Aug 2003

The Presence Of Pups After Birth : Effects On Spatial Memory And The Pre-Synaptic Protein Synaptophysin, Abbe Hoffman Macbeth

Master's Theses

A newly maternal rat goes through many changes when she gives birth, mostly due to prolonged elevation of hormones, particularly estrogen. Estrogen has been shown to increase memory capabilities by increasing synaptic activity in the CA1 hippocampus, but exactly how is still unknown. The current project uses reproductive experience to determine whether high hormone levels experienced during pregnancy and lactation affect spatial memory and synaptophysin, a pre-synaptic protein that controls vesicle exocytosis and thus may be responsible for enhanced synaptic connectivity. We found that reproduction itself does not affect memory of a spatial task, but the presence of pups has …

Brain-Derived Neurotrophic Factor And Maternal Behavior : Neuronal Alterations In The Medial Preoptic Area And Suppression Of Pup Attacks, Lillian Flores Stevens Aug 2003

Brain-Derived Neurotrophic Factor And Maternal Behavior : Neuronal Alterations In The Medial Preoptic Area And Suppression Of Pup Attacks, Lillian Flores Stevens

Master's Theses

Brain-derived neurotrophic factor (BDNF), by virtue of its relationship to various neurotransmitter systems, hormones, and to estrogen in particular, may play a role in maternal behavior. To explore this possible role, female virgin Sprague Dawley rats received continuous intracerebroventricular infusions ofBDNF sense oligonucleotide and were exposed to pups for maternal behavior testing. Behaviorally, BDNF sense had no effect on maternal behavior but did significantly suppress pup attacks during the first 24 hours of exposure. BDNF had a significant effect on neuronal morphology in the medial preoptic area (mPOA) as well, such that neurons in this region exposed to BDNF had …

A Study On Tolerable Waiting Time: How Long Are Web Users Willing To Wait?, Fiona Fui-Hoon Nah

Research Collection School Of Computing and Information Systems

The WWW has become an important channel for information access, electronic commerce, and publication. With an exponential increase in the number of Web users and the popularity of multimedia technology, users often face a long waiting time for downloading Web pages. Although various technologies and techniques have been implemented to alleviate the situation and to comfort the impatient users, little research has been done to assess what constitutes an acceptable and tolerable waiting time for Web users. This research reviews the literature on computer response time and users’ waiting time, and assesses Web users’ tolerable waiting time in information retrieval. …
