The New Economic Constitution In China: A Third Way For Competition Regime?, Youngjin Jung, Qian Hao

Northwestern Journal of International Law & Business

This article will discuss the basic features of the competition regime China is ready to set up, as envisioned in its draft of the anti-monopoly law. By comparing different antimonopoly systems worldwide and their relevance to China's idiosyncrasies in its antimonopoly law, this article intends to promote a better understanding of China's emerging antitrust regime by providing illustrative comments and legislative suggestions. Part II of this article will focus on the economic and legal contexts of the drafting of the antimonopoly law in order to illuminate the unique priorities of the Chinese lawmakers. Part III will highlight the distinctive traits …

Enforcement Of Foreign Judgements, The First Amendment, And Internet Speech: Notes For The Next Yahoo! V. Licra, Molly S. Van Houweling

Michigan Journal of International Law

The Article begins with a review of the relevant rules governing enforcement of foreign judgments in the United States. Part II explains how courts have unpersuasively applied these rules when refusing to enforce foreign libel judgments. Part III then explains how the Yahoo! court adopted much of this faulty reasoning. Finally, Part IV explains the considerations that better justify judicial refusal to enforce speech-restrictive foreign judgments, especially those triggered by Internet speech. The Article concludes that the prospect that U.S. Internet speakers will choose to speak only to a U.S. audience-even when their speech would be legal everywhere-is the most …

Introduction To The Refugee Law Forum, Joan Fitzpatrick Jan 2003

Introduction To The Refugee Law Forum, Joan Fitzpatrick

Washington International Law Journal

The ripple effects on refugee protection from the events of August and September 2001, arising out of the rescue at sea of 433 asylum seekers by the M/V Tampa, have been substantial. It is too early to determine whether they will be as profound and as corrosive as the impact of the terrorist attacks of September 11, 2001 on other intemational legal norms, including those relating to preventive detention and to "securitizing international migration."' Australia's actions with respect to the Tampa and subsequent intercepted vessels, and its September 2001 legislation, establish a framework in which asylum seekers who arrive …

Explaining, Assessing, And Changing High Consumption, Harry Van Der Linden

Scholarship and Professional Work - LAS

These writings reflect the renewed interest in the 1990s of scholars and the public in questioning the consumer society, an interest that the political crises engendered by 9/11 have overshadowed but not eliminated. In The Overspent American, Schor explains the emergence of strong doubts about high consumption by arguing that a “new consumerism” of escalating desires has evolved that is increasingly costly to the American high consumers themselves.

Examining The Evidence: Post-Verdict Interviews And The Jury System, Nicole B. Casarez Jan 2003

Examining The Evidence: Post-Verdict Interviews And The Jury System, Nicole B. Casarez

UC Law SF Communications and Entertainment Journal

Although jury deliberations are kept secret, jurors sometimes speak out to the press after the conclusion of a trial about the rationale for their verdict, what pieces of evidence were important to their decision, and similar issues. Some argue that post-verdict juror interviews are harmful to the very foundation of the jury system, because they endanger defendants' fair trial rights, invade jurors' privacy, and distort public perception of jury verdicts. However, others, such as the author, consider these post-verdict interviews important, because they permit the public to gain a better understanding of the verdicts as well as the nature of …

File-Sharing Copyright, And Privacy, Stephen Keating Jan 2003

File-Sharing Copyright, And Privacy, Stephen Keating

UC Law SF Communications and Entertainment Journal

Lawsuits brought by the recording industry against Internet users accused of illegal file sharing raise provocative questions about legal tactics, the piracy of copyrighted material, the openness of the Internet, and the future of peer-to-peer (P2P) file sharing. The history of satellite TV piracy may provide a key to understanding what comes next.

Sexism Is A "Family Value", Kimberly Charles Jan 2003

Sexism Is A "Family Value", Kimberly Charles

Cardozo Journal of Equal Rights & Social Justice

The article argues that sexism is an inherent and underlying value in the discourse of the Christian Coalition of America, a prominent Right-Wing group. Rooted in Fundamentalist Christianity, the Coalition's "family values" agenda perpetuates a society of domination, where male authority and control over women are justified as natural and ordained by God. This ideology is evident in their political activism, legal advocacy, and social policies, which systematically undermine women's rights and reinforce gender inequality.

Hockey-Boys, Ice Princesses, Gender Values & The Practice Of Equality, Karin Grahn Jan 2003

Hockey-Boys, Ice Princesses, Gender Values & The Practice Of Equality, Karin Grahn

Cardozo Journal of Equal Rights & Social Justice

The article explores the persistence of gender inequalities in traditionally male-dominated fields, drawing parallels between law and sports. It highlights how gender values and norms perpetuate disparities, even in female-dominated activities like figure skating, despite formal commitments to equality. The author argues that while structural changes have increased women's participation, qualitative equality remains elusive due to entrenched male norms and values.

Supreme Court Voting Behavior: 2001 Term, Richard G. Wilkins, Scott Worthington, Adam Becker, Sara Becker Jan 2003

Supreme Court Voting Behavior: 2001 Term, Richard G. Wilkins, Scott Worthington, Adam Becker, Sara Becker

UC Law Constitutional Quarterly

This Study, the sixteenth in a series, tabulates and analyzes the voting behavior of the United States Supreme Court during the 2001 Term. The analysis is designed to determine whether individual Justices and the Court as a whole are voting more "conservatively," more "liberally," or about the same when compared with past Terms. This Study attempts to remove subjectivity by applying a consistent classification scheme to ten categories of cases over time. This Term's data strongly suggests that the present Court stands in an uneasy ideological balance. The Court's voting behavior during the 2001 Term reverses the modest liberal trend …

Zo1 As A Factor In The Remodeling Of Myocardial Gap Junctions, Ralph John Barker Jan 2003

Zo1 As A Factor In The Remodeling Of Myocardial Gap Junctions, Ralph John Barker

MUSC Theses and Dissertations

The remodeling of connexin43-containing gap junctions (GJs), as defined by changes in size, distribution, or function, is a prominent feature of both the developing and diseased myocardium. During postnatal development of the mammalian ventricle, there is a progressive remodeling of GJs into intercalated disks. This change in GJ quantity and distribution is correlated with alterations in the velocity and anisotropy of impulse spread within differentiating myocardium. Orderly distribution of GJs is perturbed in many cardiac diseases, and reemergence of immature patterns of myocyte coupling may be a factor in the arrhythmogenic potential attending such pathologies. Although mechanisms responsible for this …

No Woman Is An Object: Realizing The Feminist Collaborative Video, Alexandra Juhasz Jan 2003

No Woman Is An Object: Realizing The Feminist Collaborative Video, Alexandra Juhasz

Publications and Research

Feminist video does collectivity exceedingly well. Certainly other politicized cultural movements and individuals work through this method, and, of course, feminists also produce work in collaboration in film and other media (as Julia Lesage testifies above). However, I assert that there is a profound natural mechanics to women's work in video that makes the medium's method, theory, and theme the interactive and politicized subjectification of the female sex. Film and patriarchy share the project of women's objectification-they make victims. Video and feminism see women as complex, worthy selves-they produce subjects. In feminist collaboration: video, the medium (inexpensive, debased, nonprofessional), the …

Cytotoxic Effects Of Electron Carriers Are Inhibited By Hsp27 In Breast Cancer Cell Lines, Yvonne Carina Giraud Jan 2003

Cytotoxic Effects Of Electron Carriers Are Inhibited By Hsp27 In Breast Cancer Cell Lines, Yvonne Carina Giraud

UNLV Retrospective Theses & Dissertations

Human breast cancer cell lines DC4, DB46, MCF-7, MDA-MD-435 were incubated with cytochrome c at 5 x 10-7M, 5 x 10 -6M and 5 x 10-5M. Human colon cancer cell line, RKO, and normal human lung fibroblast cell line, HFL1, were incubated with cytochrome c at 5.6 x 10-8M, 5.6 x 10-7M and 5.6 x 10-6M. Cytochrome c exposure showed a dose response including cell death in breast cancer cell lines. RKO showed no sensitivity to cytochrome c exposure at any of the concentrations and HFL1 showed sensitivity only at the highest concentration. FAD, NADH, Q10 and ATP were incubated …

Platelets Stimulate Fibroblast-Mediated Contraction Of Collagen Gels, Ulrika Zagai, Karin Fredriksson, Stephen I. Rennard, Joachim Lundahl, C. Magnus Sköld Jan 2003

Platelets Stimulate Fibroblast-Mediated Contraction Of Collagen Gels, Ulrika Zagai, Karin Fredriksson, Stephen I. Rennard, Joachim Lundahl, C. Magnus Sköld

Journal Articles: Pulmonary & Critical Care Med

BACKGROUND: Platelets are thought to play a role in a variety of inflammatory conditions in the lung, some of which may lead to fibrosis. In the current study we tested the hypothesis that whole platelets and platelet lysate can mediate remodelling of extracellular matrix in vitro by affecting fibroblast-mediated contraction of a collagen gel. We also sought to determine to what extent platelet-derived growth factor (PDGF) and transforming growth factor-beta (TGF-beta) contribute to this effect.

METHODS: Washed platelets, isolated from healthy blood donors, and platelet lysate (freezing and thawing), were cast together with human lung fibroblasts in three-dimensional collagen gels. …
