City University of New York Law Review
The following symposium at the Association of the Bar of the City of New York explores the predicament posed by the surge of child removals through neglect petitions, and the subsequent placement of those children in foster care. The panel, whose comments are published here, offer some poignant reflections on the crisis of the child welfare system.

Context, Yes - And Theory, Yes, Morton Deutsch
Context, Yes - And Theory, Yes, Morton Deutsch
Journal of Dispute Resolution
I admire Carrie Menkel-Meadow's article very much.' It reveals her deep and broad knowledge of the field of conflict resolution. It also represents an important and valid emphasis on the necessity of a rich knowledge of specific contexts for applied work in those contexts. However, the article implicitly constructs a false opposition between contextual knowledge and theoretical knowledge; in reality, both are needed. I understand that "practitioners" and "theorists" commonly misunderstand one another because of their different orientations and social roles. In this article, I will discuss these differences and then briefly consider the integration of theory and practice.

Problem-Solving Negotiation: Northern Ireland's Experience With The Women's Coalition, Jacqueline Nolan-Haley, Bronagh Hinds
Journal of Dispute Resolution
Women's peacemaking skills have long empowered them as voices for reconciliation in divided societies 8 and therefore, the role of women in preventive diplomacy, conflict resolution, and post conflict reconstruction is widely advanced today. Although historically women are credited with being actively involved in peacemaking efforts at the grassroots level during periods of conflict,' ° they are not generally considered to play a significant role in formal peace negotiations.' Northern Ireland proved to be an exception.'

Evaluation Dispute Resolution Under Uncertainty: An Empirical Look At Bayes' Theorem And The Expected Value Of Perfect Information, Gregory Todd Jones, Douglas H. Yarn
Journal of Dispute Resolution
To begin, we review a standard model of litigation decision-making in Section I and propose an extension of this model to include ex post evaluative dispute resolution in Section II. Next, in Section III, we review the analytical concept of the expected value of perfect information as a means of placing a theoretical rational maximum on the value of the information provided by evaluative dispute resolution processes. In Section IV, we review Bayes' theorem and propose this as a rational benchmark for the integration of new information with previously existing subjective probabilities. In Section V, we offer a formal statement …
Adr Clause By Any Other Name Might Smell As Sweet: England's High Court Of Justice Queens Bench Attempts And Fails To Define What Is Not An Enforceable Adr Clause - Cable 7 & (And) Wireless Plc V. Ibm United Kingdom Ltd, An, Alyson Carrel
Journal of Dispute Resolution
The High Court of Justice Queens Bench Division in England issued a ruling that provides sweeping support for the use of Alternative Dispute Resolution (ADR) in private pre-dispute contract clauses.' While this support might seem to aid in developing the growing ADR movement in England, the judge may have put the cart before the horse by enforcing a non-descript and broad ADR contract clause that lacks the specificity needed to ensure a fair outcome. This decision could be detrimental for disputing parties and the future of the ADR movement itself.
State Legislative Update, Mark G. Boyko
State Legislative Update, Mark G. Boyko

This bill would have prevented employers from requiring employees to arbitrate disputes arising under the Fair Employment and Housing Act (FEHA). In doing so, it would have changed the established law in California that written agreements to arbitrate disputes are valid and enforceable. Specifically, this bill would have invalidated arbitration agreements between employers and employees if the employer required the employee to sign the agreement as a condition of employment. A.B. 1715 would have applied to employers with five or more employees.

Through its Progress Board created in 1989 and Oregon Benchmarks, Oregon has been a leader in collecting and using data to discern statewide trends in dozens of different economic, environmental, and social arenas. Oregon was among the first U.S. states to set targets for the future in each of these categories, allowing its citizens to see how much farther we have to go to achieve livability goals. These benchmarks are grouped under three major areas of a state strategic plan: quality jobs for all Oregonians; safe, caring and eng aged communities; and healthy, sustainable surroundings. Is there real value in …

Technology Management For Reshaping The World, Dundar F. Kocaoglu, Timothy R. Anderson
Engineering and Technology Management Faculty Publications and Presentations
The world is changing rapidly, and technology is playing the central role in making the changes happen. The events since PICMET '01 have made it clear that every society everywhere in the world is affected not only by the changes, but also by the technology behind them. There are few events in the world today that are not dominated, or at least influenced, by technology. This observation can be explained by recognizing the current period in the history of the world as the "technology era." When technology is properly used and managed, it leads to the reshaping of the world …

Pynchon In Popular Magazines, John K. Young
Pynchon In Popular Magazines, John K. Young
English Faculty Research
Any devoted Pynchon reader knows that “The Secret Integration” originally appeared in The Saturday Evening Post and that portions of The Crying of Lot 49 were first serialized in Esquire and Cavalier. But few readers stop to ask what it meant for Pynchon, already a reclusive figure, to publish in these popular magazines during the mid-1960s, or how we might understand these texts today after taking into account their original sites of publication. “The Secret Integration” in the Post or the excerpt of Lot 49 in Esquire produce different meanings in these different contexts, meanings that disappear when reading …

“Bin Laden’S Brain”: The Abrasively Negativistic Personality Of Dr. Ayman Al-Zawahiri, Aubrey Immelman, Kathryn Kuhlmann
Psychology Faculty Publications
This paper presents the results of an indirect assessment of the personality of Ayman al-Zawahiri, deputy leader of the al-Qaida terrorist network at the time of the September 11, 2001 terrorist attack on the United States and allegedly chief strategist for al-Qaida operations and personal physician to Osama bin Laden.
Al-Zawahiri’s primary personality patterns were found to be Contentious/oppositional and Dominant/controlling, with secondary features of the Dauntless/dissenting and Ambitious/self-serving patterns.
The amalgam of Contentious (negativistic, or passive-aggressive) and Dominant (aggressive, or sadistic) patterns in al-Zawahiri’s profile suggests the presence of the “abrasive negativist” syndrome. For these personalities, minor frictions easily …

The Role Of Ngos In Political Elections In South Korea: The Case Of The Citizens' Alliance For The 2000 General Election, Eui Hang Shin
Faculty Publications
The primary purpose of this study is to investigate the role of civic organizations in political processes in South Korea. More specifically, this article examines the impact of the blacklisting of candidates by the Citizens’ Alliance for the 2000 General Election (CAGE) on the outcomes of the National Assembly election of April 13, 2000. I discuss the relationship between the characteristics of political systems and political culture and the emergence of civic organizations. I analyze the effects of CAGE’s blacklisting of politicians on the nomination processes of candidates by major political parties. I also discuss the long-term effects of CAGE …

Atmospheric Water Vapor Lidar Measurements Using Analog And Photon Counting Techniques, Anuj Maheshkumar Shah
Atmospheric Water Vapor Lidar Measurements Using Analog And Photon Counting Techniques, Anuj Maheshkumar Shah
Electrical & Computer Engineering Theses & Dissertations
Atmospheric water vapor measurements are essential for the understanding of Earth's weather and radiation budget, along with the water cycle. The remote sensing Differential Absorption Lidar (DIAL) technique is a commanding method used for water vapor measurements from aircraft, spaceborne, and ground-based platforms. The new unmanned aerial vehicle (UAV) water vapor DIAL system provides great feasibility due to the weight and size limitations. The system has significantly less weight, power consumption, and noise presence, thus making it great for UAV applications.
This thesis discusses a UAV water vapor DIAL system that was designed, developed, and evaluated. The research effort was …
Piezoelectric Sensor In The Application Of Rolling Bearing Health Monitoring, Yinyin Liu
Piezoelectric Sensor In The Application Of Rolling Bearing Health Monitoring, Yinyin Liu
Mechanical & Aerospace Engineering Theses & Dissertations
A condition-based monitoring concept for rolling element bearings in machinery utilizing a piezoelectric load sensor is investigated in this thesis. The radially polarized cylindrical piezoelectric sensor is modeled in its specific coordinates. The sensor registers the stress occurring in all directions around it. The sensor's behavior due to several typical loads is analyzed. Based on the induced stresses in the sensor, the sensor's output as an electric charge can be obtained using the method of integration.
Considering both the normal and tangential loads distributed on the rolling beating's roller-raceway contact surface, the dynamic stress distribution in the outer raceway was …

The Prediction Of Intra-Individual Variability In The Daily Body-Image Experiences Among College Women, Susan E. Melnyk
Psychology Theses & Dissertations
This investigation examined body-image states in the context of daily life. There were 108 women who completed all three phases of this study. First, a battery of body image trait measures and an eating attitudes measure were completed. Second, participants called an automated telephonic response system twice daily for six days and recorded their current body-image states, from the questions on the Body Image States Scale. Finally, a Post-Study Questionnaire was completed. Pearson correlations examined the extent to which the pretest measures predicted the level and variability of body-image states. Consistent with hypotheses, greater satisfaction with one' appearance, less dysfunctional …

Foreword: The Political Geography Of Race Data In The Criminal Justice System, Andrew E. Taslitz
Foreword: The Political Geography Of Race Data In The Criminal Justice System, Andrew E. Taslitz
Law and Contemporary Problems
Several months ago, there was a heated discussion on CrimProf, the listserv for criminal law professors, about the disproportionate representation of minorities in the criminal justice system. Few participants in this online discussion contested the reality that racial and ethnic minorities, especially African Americans, make up a far larger percentage of those arrested and incarcerated than should be expected from their percentage of the country's total population.
The Reality Of Racial Disparity In Criminal Justice: The Significance Of Data Collection, David A. Harris
The Reality Of Racial Disparity In Criminal Justice: The Significance Of Data Collection, David A. Harris
Law and Contemporary Problems
Criminologists have long debated the presence of racial disparity at various places in the criminal justice system, from initial on-the-street encounters between citizens and police officers to the sentencing behavior of judges. What is new is the use of statistics designed to persuade the public, and not just other academics and researchers, that grave racial disparities exist in the system, and that these disparities necessitate significant policy changes.

From The Ne’Er-Do-Well To The Criminal History Category: The Refinement Of The Actuarial Model In Criminal Law, Bernard E. Harcourt
Law and Contemporary Problems
Harcourt discusses three developments in 20th century criminal law: the evolution of parole board decision-making in the early 20th century, the development of fixed sentencing guidelines in the late 20th century, and the growth of criminal profiling as a formal law enforcement tool since the 1960s. In each of these case studies, he focuses on the criminal law decision-making.

Racial Auditors And The Fourth Amendment: Data With The Power To Inspire Political Action, Andrew E. Taslitz
Law and Contemporary Problems
Taslitz discusses the current practice of racial auditing as a method of police regulation. Racial auditing relies on the strategy of using independent investigators to disseminate data about an organization to broader publics. Racial auditors, however, are not accountants but rather human rights organizations.
