This Article investigates why the enforcement of a given legal doctrine may vary with changes in the cultural context in which it is applied. It argues that officials apply the law along an "enforcement practices continuum" in accord with changes in the prevailing articulations of the meaning of cultural identity norms associating particular groups with crime.
Terry v. Ohio doctrine allows police officers to make "stops" and "frisks" of limited scope upon reasonable suspicion of crime rather than requiring the higher standard of probable cause. The Article contends the officer discretion resulting from this "scope continuum" approach permits cultural identity …

The postpartum period has been the focus of numerous studies; however, there is no information available relating to oocyte production in early postpartum cows. Ovaries of early postpartum cows were stimulated with FSH to produce follicular development and oocytes. The article presents a systems perspective on environmental initiatives as they relate to the efforts of firms looking to become environmentally sustainable. To achieve environmental sustainability, firms need to implement principles, policies, and practices (such as budgeting systems, job design, recruitment and selection, and organizational structures) from the standpoint of long-term ecosystem viability. Because this process requires firms to establish challenging goals, managers are often confronted with significant conflicts between the financial and the environmental and social considerations when introducing socially or environmentally oriented decision making. With the coming changes from an empirical to mechanistic-empirical pavement design, it becomes essential to move towards changing the quality control/quality assurance (QC/QA) procedures of compacted materials from a unit weight-based criterion to a stiffness/strength based criterion. The non-destructive in-situ tests such as Geogauge, Dynamic Cone Penetrometer (DCP), and Light Falling Weight Deflectometer (LFWD) can be used as effective tools in the assessment of subsurface conditions and in evaluating the stiffness of pavement materials and embankment. Sugarcane (inter-specific hybrids of Saccharum) is grown largely under long-term monoculture production in Louisiana. This can lead to a complex problem termed "yield decline" that results in poor root health and reduced productive capacity of sugarcane. This problem has been documented to be a limiting factor for sugarcane production in diverse regions, including Louisiana, Hawaii, Jamaica, and Australia. Previous work showed that biological factors affect root health and contribute to yield decline. In this work a finite element model for the human eye presented. Thermal analysis was done in order to capture the temperature variation in the human eye. The model was created using advance finite element program ABAQUS. In the model each of the eye's component (cornea, sclera, lens, iris, aqueous and vitreous humor) has own material property. My body of work, “Spiritual Union,” is an exploration of artistic ideas contrasted with approaches to scientific technology. I investigate diverse physical phenomena and media and examine symbolic structures to express concepts of transcendence and spirituality in Buddhism. On deep levels, I have observed the natural beauty, richness, and complexity of organic forms. This has led to exploration and experimentation in the area where the boundaries between the artistic and the scientific fields converge. In an attempt to streamline the paper supply chain, paper industry vertical business-to-business eMarketplaces were established to help industry players to decrease inefficiencies in their supply chains, to minimize negative effects of economic cyclicality, and to achieve better visibility. eMarketplaces rode the hype of revolutionizing the way in which industries conduct business, citing the cost savings achieved by expanded market reach, operational efficiencies, aggregated purchasing, and finding the least expensive suppliers. Adoption of eIntermediaries has been lower than expected in the paper industry and many of the paper vertical start-ups failed when the economy softened and the dot.com bubble burst. …

The purpose of this study is to examine whether a region's economy has an impact on regional coverage of China's WTO entry. It is predicted that regional newspapers vary in reporting this issue because of variation in the regional economic structure. The findings of the study support this prediction. A content analysis of 282 news articles in the U.S. regional newspapers finds that the regional economy can be a predictor of regional newspaper's coverage. C. C. Pat Fleming practiced landscape architecture in Houston and the surrounding South from the 1920s through the 1990s. He came to be considered one of Houston’s preeminent landscape architects, and his role in the profession cannot be overlooked. This thesis traces the evolution of Fleming’s design style over the course of his career, analyzing a selected cross section of his works against three design movements that occurred during his lifetime: the Beaux-Arts tradition, the Colonial Revival movement, and the Modernist movement. This paper examines the conceptual foundations of civil society and its role in shaping socio-political life in the past decade as well as their prospects and challenges for the next millennium. It argues that civil society is a key mediating force in changing the state- society dynamics, which in turn, is also being reconfigured by the globalization of social life and the rise of identity and resource claims from various groups. What can women's narratives contribute to our understanding of breast cancer and to feminist theories of the body? This thesis explores the meanings women construct to make sense of embodied experiences of breast cancer, and the profound experience of breast loss. Rich contextual data was elicited from in depth, guided conversations with five premenopausal women who have undergone mastectomy. Adopting feminist methodology, biographic-narrative was used to place the body at the heart of inquiry. This thesis explores the personal and theoretical meanings of mastectomy, embedded in the larger story of how these five women experience their breasts, throughout their lives. …

Recent cases, such as that of James Bulger, have provided anecdotal evidence of children's capacities to commit illegal acts. Currently however, the public's attributions of children who engage in antisocial and criminal behaviour, and whether they should be held criminally responsible for their actions, has received little attention in terms of empirical research. Hierarchy of effects models have underpinned the advertising industry for over 100 years. These models are based on an underlying pattern of cognition => affect=> behaviour, in other words: think=> feel=> do, and suggest that consumers process advertising in a linear fashion, in stages. Indigenous identity can only be located within . a framework of historical dislocation from where white notions of assimilation are shattered. Therefore Indigeneity can only be defined in relation to the black experience within colonialism's hegemonic structures. This thesis is about current Centrelink breach and appeal figures. It is also about the current conservative neo-liberalising climate of Australian social policy reforms, with which they are inextricably connected. It shows that while Centrelink breach numbers have increased more than three fold since 1996, formal appeals against Centrelink decisions have not increased similarly. This thesis asks: what might this mean? It answers this question through a single case study of a Centrelink office. Data was collected using individual focused interviews, documents collected from the site, and direct observation (including a map of the office drawn by the researcher). Various …

This applied dissertation was designed to examine a cooperative system to resolve the class-cutting problem of 9th–grade students in an urban high school. The process included teachers, parents, and students. All attendance records at this school were handwritten and manually generated on forms. The process was slow, immediate feedback was difficult, and the system was cumbersome to manage. Teachers did not have a remedy for the situation, parents displayed indifference, and students denied their perpetration.

This study was designed to investigate the effects that resiliency training had upon a selected group of students in a rural school with a student population of approximately 600. Planned solution strategies included staff development training and implementing activities to establish the school climate and student readiness.
Resiliency Skills and Abilities Scale was used as a pretest, a 45-item survey to determine resiliency scores, before implementing resiliency skills. Research indicates that the importance of learning to read is critical. An inability to read stands as an enormous barrier to one’s potential knowledge and social participation. Florida’s System of School Improvement and Accountability Act (1999, F.S.) also known as Florida’s High-Quality Education System rates schools in terms of performance on the Florida Comprehensive Assessment Test (FCAT). Reading is the focal point of this accountability system. This applied dissertation was designed to increase elementary teachers ability to utilize technology to enhance the curriculum and instructional practices for students. Technology was available in the work setting but teachers were not trained to use and integrate technology.
Teachers actively participated in the following activities: reading and discussing professional journal articles, reading and using information provided in digital newsletters, technology training sessions, collaborative planning sessions, and made a conscious effort to include technology as a component of instruction for students.

This practicum report was designed to increase the effective functioning of entry-level psychologists as members of the multidisciplinary team (MDT) through a redefinition and expansion of the traditional role of the school psychologist. A workshop explaining the model was designed and presented to the school psychologists of the writer’s school district, and interviews were conducted individually with both entry-level school psychologists and their members.

This report describes a program for reducing the number of discipline referrals for fighting, threats, and possession or use of weapons. The total school population was involved in this intervention program. All middle schools in the school district had 2 School Resource Officers (SRO) on campus to produce a safer school environment. The problem with the discipline referrals was documented through the archival data of discipline referrals from the 2000-2001 school year.
