Decreasing Liability Contracts, Robert D. Cooter, Ariel Porat Jul 2003

Decreasing Liability Contracts, Robert D. Cooter, Ariel Porat

Coase-Sandor Institute for Law & Economics Research Paper Series

Like constructing a building, performance on many contracts occurs in phases. As time passes, the promisor sinks more costs into performance and less expenditure remains. For phased performance, we show that optimal liability for the breaching party decreases as the remaining costs of completing performance decrease. In brief, efficiency requires a decreasing liability contract. To implement such a contract, we recommend deducting past expenditure on incomplete performance from liability. We show that progress payment contracts, which are commonplace in some industries, are materially equivalent to decreasing liability contracts. Our analysis should prove useful for elucidating progress payment contracts and for …

The concentration of dissolved inorganic nitrogen (DIN), dissolved nitrate-N, Total-N (TN), dissolved inorganic phosphate (DIP), total phosphorus (TP), dissolved silicate-Si (DSi) and their ratios in the world's largest rivers are examined using a global data base that includes 37% of the earth's watershed area and half its population. These data were compared to water quality in 42 subbasins of the relatively well-monitored Mississippi River basin (MRB) and of 82 small watersheds of the United States. The average total nitrogen concentration varies over three orders of magnitude among both world river watersheds and the MRB, and is primarily dependent on variations …

An all-sky charge-coupled device imager capable of measuring wave structure in the OH, O2, and O I (557.7 nm) airglow emissions was operated at Cachoeira Paulista, Brazil (23S, 45W), for 2 years in collaboration with Utah State University, Logan. The dominant quasi-monochromatic gravity wave components investigated over a 1 year period (September 1998 to October 1999) have been extracted, and their seasonal variations have been measured. A total of 283 wave events were measured, exhibiting horizontal wavelengths from 5 to 60 km, observed periods from 5 to 35 min, and horizontal phase speeds of up to 80 m s1. The …

Hydrogeologic Principles Useful In Predicting The Effects Of Stream Flow Alterations On Shallow Groundwater And Associated Riparian Vegetation, Mark Cable Rains Jul 2003

Hydrogeologic Principles Useful In Predicting The Effects Of Stream Flow Alterations On Shallow Groundwater And Associated Riparian Vegetation, Mark Cable Rains

Geology Faculty Publications

Numerous studies have shown that stream water and shallow groundwater are tightly linked in alluvial settings, and that changes in stream stage are propagated rapidly across alluvial aquifers (Castro and Hornberger 1991, Sophocleous 1991). Thus, many researchers have assumed that stream stages approximate water tables in alluvial aquifers (Auble et al. 1994, Stromberg and Patten 1996). This assumption is valid in some cases but invalid in other cases, particularly in arid basin terrain and more humid mountain terrain. Even when this assumption is valid, this relationship only implies correlation and not causation so the potential effects of stream flow alterations …

Validation Of Imaging Doppler Interferometer Winds Using Meteor Radar, G. O.L. Jones, C. S. Fish, W. K. Hocking, Michael J. Taylor

All Physics Faculty Publications

There has been some debate over the years concerning the accuracy of mesospheric wind observations made using the imaging Doppler interferometer (IDI) technique. The high potential and increasing use of IDI wind data in joint studies with spaced-antenna MF and meteor radar systems make it important to quantify the IDI results. This paper presents a novel comparison of wind measurements between a dynasonde implementation of IDI and winds derived from an all-sky meteor radar system, a widely-accepted standard for such measurements. Both radars were located at the USU Bear Lake Observatory and operated almost continuously for a four-month period. The …

The Effect Of Cooperative Learning And Traditional Instruction On The Spelling Performance Of Third Grade Students, Tracey Patella Jul 2003

The Effect Of Cooperative Learning And Traditional Instruction On The Spelling Performance Of Third Grade Students, Tracey Patella

Theses and Dissertations

The purpose of this research was to determine the effect of cooperative learning and traditional instruction on the spelling test performance of twenty-six third grade students from a southern New Jersey school district. It was hypothesized that students who were taught using cooperative learning strategies during spelling instruction would score significantly higher on their weekly spelling post-tests than students who were taught using traditional spelling instruction.

A one group, pretest/posttest, pre-experimental design was utilized to determine whether students who are randomly grouped in cooperative learning pairs will have higher achievement levels in spelling than students who are taught using traditional …

Journal of Women in Educational Leadership

Twenty-six women with professor rank at a large, public, research extensive university were interviewed for this study in which respondents discussed the meanings and significance associated with full professorship. Major themes included: the promotion event and the accompanying title of professor, anticipated and actual changes in their status and working conditions, and their identities, goals, and contributions as professors. Conclusions address issues such as dilemmas of senior professorship, effective participation in institutional governance, and progress of women through the faculty ranks.

The Effect Of An Unconscious Auditory Stimulus On Pilot Performance Under Varying Instrument Flying Conditions, Christina Eleni Christakou Jul 2003

The Effect Of An Unconscious Auditory Stimulus On Pilot Performance Under Varying Instrument Flying Conditions, Christina Eleni Christakou

Master's Theses - Daytona Beach

Human error remains a significant contributing factor with respect to accidents in civil air transportation. It is therefore crucial to establish avenues by which performance on the flightdeck can be enhanced under conditions of distress. The purpose of this study was to examine whether an unconscious auditory stimulus (UAS) could enhance pilot performance under varying instrument flight (IFR) conditions on the aircraft flightdeck. Forty IFR student pilots underwent two eight-minute simulated flights, whereupon they were presented with different IFR weather conditions. During the trial, the experimental group listened to a UAS, whereas the control group listened to white noise (WN). …

Numerical Analysis Of An Airfoil Response To An Impinging Gust, Claire M. Lessiau

Master's Theses - Daytona Beach

The BASS code, a nonlinear high-order prefactored compact code is validated on a benchmark problem. The nonlinear response of a loaded airfoil to an impinging vertical gust is investigated in the parametric space of gust intensity and frequency. Computational resources, involving a Linux cluster, were set up and maintained. The code was corrected and adapted to this particular problem. Results are compared with linear solution from the GUST3D solver.

Study Of The Distribution And Variation Of The Herbicide Atrazine In Finished Drinking Water At A Small Community Water System In Kentucky, Vijay Golla

Masters Theses & Specialist Projects

This study examines the variation in the distribution of the concentration of atrazine, a triazine herbicide used in Kentucky to control weeds primarily in corn fields. Atrazine is known to have carcinogenic properties and is an endocrine disruptor in aquatic species even at low concentrations. Atrazine has the ability to be transported through the environment into water bodies due to its physical and chemical properties favoring its occurrence and distribution. Raw and Finished drinking water samples were collected from the Lewisburg water treatment plant which derives its drinking water supplies from a source water intake namely Spa Lake, which has …

Stock Options And Child Support: The Price Of Accuracy, Susan Isard Jul 2003

Stock Options And Child Support: The Price Of Accuracy, Susan Isard

UC Law SF Journal on Gender and Justice

Stock options present difficult problems for family law judges attempting to value parents' wealth for the purpose of creating an equitable child support order. Because markets fluctuate and the value of options before they are exercised and sold is speculative, they do not fit neatly into child support systems. Consequently, appellate courts in several states have struggled with two issues: First, whether a noncustodial parent's stock options should rightly factor into his or her child support obligation. Second, if stock options are relevant, how they should be valued. As courts wrestle with these questions, there is another important non-financial consideration …

Market Incentives, Farmers’ Response And A Policy Dilemma: A Case Study On Expansion Of Chat Production As A Cash Crop In The Eastern Ethiopian Highlands.\, Tesfaye Lemma Tefera, Johann Kirsten, Sylvain Perret

International Conference on African Development Archives

This paper discusses the reasons for and effects of the dramatic expansion of chat production as a cash crop in the Hararghe Highlands of Ethiopia. Despite the Ministry of Agriculture’s deliberate attempt to marginalize and openly discourage chat production, farmers continue shifting their scarce resources to chat production. Using data generated by a rural livelihood survey from 197 randomly selected households, economic and non-economic factors contributing to the expansion of chat production are identified and its food and nutritional security impact was analyzed. The case study confirms once more again the power of market incentives in encouraging agricultural activity of …

Li-Yorke Sensitivity, Ethan Akin, Sergiǐ Kolyada Jul 2003

Li-Yorke Sensitivity, Ethan Akin, Sergiǐ Kolyada

Mathematics and Statistics Faculty Research & Creative Works

We introduce and study a concept which links the Li-Yorke versions of chaos with the notion of sensitivity to initial conditions. We say that a dynamical system (X, T) is Li-Yorke sensitive if there exists a positive ε such that every x ∈ X is a limit of points y ∈ X such that the pair (x, y) is proximal but not ε-asymptotic, i.e. for infinitely many positive integers i the distance ρ(Ti(x), Ti(y))is greater than ε but for any positive δ this distance is less than δ for infinitely many i.
