Individual Vulnerability And Cultural Transformation, Eric J. Mitnick
Individual Vulnerability And Cultural Transformation, Eric J. Mitnick
Michigan Law Review
Perhaps the most pressing problem in multicultural theory and practice today is the problem of individual vulnerability. Most interested theorists and multicultural states now accept the basic premise that some degree of state accommodation of minority cultural practice is required as a matter of justice. Debate then shifts to the best justifications for, and the appropriate extent of, such groupdifferentiated policy. Too often lost amid these discussions is the plight of vulnerable members of accommodated cultural groups: individuals subject to repression within their cultural groups, but who lose a critical aspect of their identities upon exit; individuals who would retain …
Meaning's Edge, Love's Priority, Patrick Mckinley Brennan
Meaning's Edge, Love's Priority, Patrick Mckinley Brennan
Michigan Law Review
The story is told of an American wending his way through the British Museum. Reaching the Rosetta Stone, he reached right over the railing, touched the scarred slab, and lamented: "It doesn't feel meaningful." Whereupon an old Briton was heard to mumble: "The poor American's got this old thing confused with the Blarney Stone." A bully presses his case, but meaning is much more modest. Powerless to insist upon itself, meaning lies in wait of discovery. What distinguishes the Rosetta Stone from other rocks of the same kind and size is that it was someone's - or rather a group's …
If History Mattered: John Marshall And Reframing The Constitution, Aviam Soifer
If History Mattered: John Marshall And Reframing The Constitution, Aviam Soifer
Michigan Law Review
What more can there be to learn about John Marshall? We have been blessed recently with a flood of fine books about Marshall and the Supreme Court over which he presided from 1801 until 1835. We also now have readily available an impressive collection of documents concerning the Court before Marshall, as well as a fine series collecting, introducing, and annotating Marshall's papers. With recent bicentennial celebrations marking the beginning of Marshall's career as Chief Justice and the anniversary of Marbury v. Madison, an outpouring of law review articles and scholarly symposia have offered learned exchanges about the great Chief …

Adolescent Peer Perceptions Reflected In The Yearbooks Of Mormon Homosexual And Heterosexual Men, David C. Pruden
All Graduate Theses and Dissertations, Spring 1920 to Summer 2023
This study explored the peer perceptions of adolescent heterosexual males and their homosexual counterparts who had not disclosed their feelings of erotic same-sex attraction to their classmates. The study focused on members of The Church of Jesus Christ of Latter-day Saints, a conservative Christian denomination with clear doctrinal prohibitions against homosexual behavior. The handwritten messages from peers found in the senior high school yearbooks of 30 heterosexual and 30 same-sex attracted adolescent men were content analyzed to examine similarities and differences in the themes that emerged from the data.
The results indicated that there is a difference in the kind …

The Relationship Between Emotional Intelligence And Adolescent Deviant Behavior, Jennifer R. Lance
All Graduate Theses and Dissertations, Spring 1920 to Summer 2023
This thesis summarizes a study conducted to explore the relationship between emotional intelligence and adolescent deviancy. The primary goal of this study was to investigate the relation between 1) overall emotional intelligence plus its subscales and overall normative deviant behavior, and 2) emotional intelligence subscales and subscales of a deviancy measure. Tapia's Emotional Intelligence Inventory (EII) and Vazsonyi's Normative Deviancy Scale (NDS) were used to measure the two variables of this study. Subjects included 152 high school students, aged 14-18, from a small city in Northern Utah. One hundred seventeen students came from a local high school comprising grades 10-12 …

Cape Verde’S Empresarias: Image And Reality, Jean Ludtke
Cape Verde’S Empresarias: Image And Reality, Jean Ludtke
Journal of International Women's Studies
The West African Republic of Cape Verde was under socialist governance from the time of independence in 1975 until its first multi-party government initiated privatization in 1991. The study examines, as of the mid-90s, the emergent entrepreneurial lives of a small group of young women, their views about their work, and their rejection of traditional women’s roles. This lively group has transformed their public image, used it as an organizing principle for action and modified that of the nation. In their revolt against cultural orthodoxy and assumption of new roles this group’s self- and public images have become transformational. What …

Pronunciation Difficulties In The Consonant System Experienced By Arabic Speakers When Learning English After The Age Of Puberty, Ana Marina Do Val Barros
Graduate Theses, Dissertations, and Problem Reports (ETD)
The current study investigates the difficulties Arabic speakers may encounter when pronouncing English consonants. All participants are adults who have been in contact with the American culture for at least four years. The results show that the Arabic speakers in this study had difficulties to pronounce eight English consonants. The results also demonstrate that the difficulties experienced by Arabic speakers may differ depending on the country they come from. For instance, a person from Kuwait may experience different problems with English consonants when compared to a person from Egypt. This study provides insights and assists ESL teachers with the development …
Teachers' Perceptions Of Communicative Language Teaching Use In Brazil, Marina Bandeira Aleixo
Teachers' Perceptions Of Communicative Language Teaching Use In Brazil, Marina Bandeira Aleixo
Graduate Theses, Dissertations, and Problem Reports (ETD)
Communicative Language Teaching (CLT) has been extensively discussed and researched. However little appears in the literature about CLT use in EFL environments, such as Brazil. Few studies explore CLT adaptation in EFL environments, and if they do, such studies are mostly in Asian countries (Li, 1998; Burnaby & Sun, 1998). This research investigates CLT use in high schools and language institutes in Southern Brazil. The data consists of written questionnaires, class observations, and in-depth interviews with teachers. Results showed that there are two main problems with CLT use in Brazil. One relates to the various constraints that exist in each …
How Do Adult Beginning Spanish Students Perceive Their Teacher's Written Feedback On Their Compositions?, Flavia Aoni Costa
How Do Adult Beginning Spanish Students Perceive Their Teacher's Written Feedback On Their Compositions?, Flavia Aoni Costa
Graduate Theses, Dissertations, and Problem Reports (ETD)
Most of the literature on written feedback to date has attended to feedback techniques and the effects of such approaches on students' writing skills. Little emphasis has been placed on students' perspectives on teachers' written feedback. For this reason, the present study investigated how adult beginning students react to their teacher's written feedback on their Spanish compositions. The study used qualitative methods of data collection---questionnaires for the students, interviews with teachers and students and participant observations---in order to explore their reactions and perceptions. The findings show that the general positive reaction students had in relation to their teacher's written feedback …

Meditating Comparisons, Or The Question Of Comparative Law, Igor Stramignoni
Meditating Comparisons, Or The Question Of Comparative Law, Igor Stramignoni
San Diego International Law Journal
Many today claim that, after WWII, the fall of the Berlin wall and, now, September 11, 2001, the changing nature of nation states, democracy, and the law can no longer be sensibly ignored. How can comparative law contribute to such an important debate? In what follows, it is argued that one way to contribute to the debate over the changing nature of nation states, democracy, and the law would be to engage in poetic comparisons of law's many domains. What, then, are poetic comparisons of law, and what do they invite us to do? Learning from Martin Heidegger's life-long advocacy …
Two Case Studies In Self-Determination: The Rock And The Bailiwick, Inge V. Porter
Two Case Studies In Self-Determination: The Rock And The Bailiwick, Inge V. Porter
San Diego International Law Journal
After looking at the concept of self-determination, its history, meaning, and possible future development in Part II, this Paper will develop two case studies. Part III examines the right of self-determination for the people of Gibraltar, analyzing the relevant U.N. resolutions, agreements, treaties, and legislation that have defined the dispute between Great Britain and Spain. For example, Great Britain has ruled the Rock of Gibraltar for 280 years, primarily using it as a military base; but, today, Spain insists that it did not relinquish absolute sovereignty over Gibraltar to the British by the Treaty of Utrecht in 1713. Part IV …
Finding Fundamental Fairness: Protecting The Rights Of Homosexuals Under European Union Accession Law, Travis J. Langenkamp
Finding Fundamental Fairness: Protecting The Rights Of Homosexuals Under European Union Accession Law, Travis J. Langenkamp
San Diego International Law Journal
In tackling the issue of sexual orientation discrimination, the European Union must make significant efforts to conform or, perhaps, eradicate incongruous legislation within Applicant Countries. The difficulty of this endeavor is two-fold: first, in terms of the number and complexity of the laws of each Applicant Country; and, second, in the absence of any detailed and systematic documentation of sexual orientation discrimination within those same Applicant Countries. Compounding, if not confounding, such legitimate endeavors are the inconsistent anti-gay legislation prevalent within the present Member States. The stakes are high for Member States and Applicant Countries alike. Thus, the European Union's …

Hermeneutical Implications Of Certain Pre-Pauline Passages In The Pauline Corpus Of The New Testament, Inta Ivanovska
Hermeneutical Implications Of Certain Pre-Pauline Passages In The Pauline Corpus Of The New Testament, Inta Ivanovska
Master of Art Theology Thesis
Postmodern linguistics and philosophy have challenged the possibility that an author, a text, or a reader of a text possesses or can possess complete objectivity. It claims that an "independent, objective, reason-driven reader" is merely a "communally dependent, subjective, presupposition-bound agent." Similarly, an author is regarded as subject who through the text merely expresses the perspectives he has acquired through his own, contextually-shaped experiences. Moreover, once created, a text is not to be regarded as an entity which bears its own intrinsic meaning; nor is a text the expression of an "original," authorial intent. Rather, a text is merely a …
Judicial Checks And Balances, Rafael La Porta, Florencio Lopez-De-Silanes, Cristian Pop-Eleches, Andrei Shleifer
Judicial Checks And Balances, Rafael La Porta, Florencio Lopez-De-Silanes, Cristian Pop-Eleches, Andrei Shleifer
Dartmouth Scholarship
In the Anglo-American constitutional tradition, judicial checks and balances are often seen as crucial guarantees of freedom. Hayek distinguishes two ways in which the judiciary provides such checks and balances: judicial independence and constitutional review. We create a new database of constitutional rules in 71 countries that reflect these provisions. We find strong support for the proposition that both judicial independence and constitutional review are associated with greater freedom. Consistent with theory, judicial independence accounts for some of the positive effect of common-law legal origin on measures of economic freedom. The results point to significant benefits of the Anglo-American system …

The Race For Globalization: Modernity, Resistance And The Unspeakable In Three African Francophone Texts, Francesca Sautman
The Race For Globalization: Modernity, Resistance And The Unspeakable In Three African Francophone Texts, Francesca Sautman
Publications and Research
The "global village" that media pundits and politicians evoke as general currency might well be visualized, in this onset of the twenty-first century, as a village beset by fires, riot, and rampage, where hunger reigns unopposed. The paradox of the term poorly conceals the untold violence that the violence of rhetoric seeks to erase. Yet, contemporary African Francophone texts have been tearing off this mask for decades, locating themselves less often in idyllic villages, and more frequently, on the cable lines of suffering between dying villages and indigent cities. In the literature of the 1980s, the focus of this essay, …
Artifacts And Cultures-Of-Use In Intercultural Communication, Steven L. Thorne
Artifacts And Cultures-Of-Use In Intercultural Communication, Steven L. Thorne
World Languages and Literatures Faculty Publications and Presentations
This article develops a conceptual framework for understanding how intercultural communication, mediated by cultural artifacts (i.e., Internet communication tools), creates compelling, problematic, and surprising conditions for additional language learning. Three case studies of computer-mediated intercultural engagement draw together correlations between discursive orientation, communicative modality, communicative activity, and emergent interpersonal dynamics. These factors contribute to varying qualities and quantities of participation in the intercultural partnerships. Case one, "Clashing Frames of Expectation -- Differing Cultures-of-Use," suggests that the cultures-of-use of Internet communication tools, their perceived existence and on-going construction as distinctive cultural artifacts, differs interculturally just as communicative genre, pragmatics, and institutional …
Human Reliability Analysis In The Performance Of Advanced Cardiac Life Support Tasks, Lucia Veronica Rosas
Human Reliability Analysis In The Performance Of Advanced Cardiac Life Support Tasks, Lucia Veronica Rosas
Theses and Dissertations - UTB/UTPA
Error reduction in the performance of medical emergency situations is an area of great concern in today's society. This is specially the case when the situation involves a cardiac arrhythmia. These situations are generally categorized as Advanced Cardiac Life Support (ACLS) events. The American Heart Association provides the proper procedures that practitioners of ACLS should follow to provide care to patients presenting heart arrhythmia problems. These situations occur inside and outside the hospital, outside the hospital being the most critical ones considering the limitation of equipment and availability of qualified care. Errors made by the practitioners of ACLS in this …
