Thirty years ago, the Nebraska Supreme Court adopted the American Bar Association's 1969 Model Code of Professional Responsibility. In 1983 the ABA recommended that states abandon its old Model Code and adopt its new Model Rules of Professional Conduct. In 2002 the ABA revised the 1983 version of the Model Rules, and it now recommends states adopt these revisions to the Model Rules. The most important reason Nebraska should adopt the revised Model Rules is they provide a conceptual and linguistic vocabulary for ethics dialogue and education. Among Lutherans liturgical inculturation is not a novelty. When Martin Luther translated the Latin liturgy into German and adopted popular songs for church services, he embarked on liturgical inculturation. The vernacular, unlike Latin, is a living language and is thus a sure vehicle of culture. It expresses the people's thought and behavioral patterns and is an established bearer of their values and institutions. In short, the use of the vernacular in the liturgy is in itself a sign that inculturation has taken place.

'Focused action research' was employed in a teacher inservice program which sought to develop a fusion between trainer-centred input and teacher-centred action research. The areas of input to teachers were learning strategies, thinking skills, questioning skills and the teaching of study skills. During the four months of this action research project of the teacher educators, teachers experienced two cycles of action research, one investigating their students' learning strategies and the second implementing a plan to improve some aspect of their students' learning - such as summary writing, remedial reading, hotseating, introducing group work, vocabulary-learning techniques - and wrote reports on …

Questions : Help Or Hindrance? Teachers' Use Of Questions With Indigenous Children With Conductive Hearing Loss., Ann Galloway
Australian Journal of Teacher Education
The development of oral language skills is an important foundation for written literacy for all children. However, where children have conductive hearing loss and consequent language impairment, the development of good oral language skills, especially those that underlie written literacy, becomes even more important. This paper discusses the use of questions during literacy focus lessons by three teachers of Indigenous students, and the way in which their use of questions serves to support or inhibit children’s opportunities to participate in classroom interaction. The paper concludes with a brief consideration of the implications of the findings for teacher education.

Everything is very simple in war," said Carl von Clausewitz, "but the simplest thing is difficult." This essay will suggest that the resort to the language of war, as "natural" and "starkly simple" as it is, nevertheless has a profound impact on how the law's intervention is shaped, or how the laws governing the transnational use of force are interpreted to accommodate a "war" on terrorism. Shadypine Middle School has recently implemented what they called a Teaching-for-Tolerance initiative designed to help all students become tolerant of cultural perspectives. This initiative involved teachers adding multicultural education to current curricula to show students groups of people who were discriminated and prejudiced against and their reaction to the discrimination and prejudice. Since teachers are using multicultural education as a base for this initiative, this study investigates how the tolerance initiative illustrates or exemplifies levels of multicultural education as described by Sonia Nieto. This essay is an exercise in interpreting a revered, but neglected, text. I take as my object of study the story of Adam and Eve in Eden. My interest in these passages derives in large part from conversations with my mentor, Herb Morris, who taught me to appreciate the beauties and mysteries of this rich tale. For both us, the problem is explicating the deeper meaning of the story. Perhaps I put more emphasis on the original text than Morris does, but we share a common objective of understanding what the story can teach us about the human condition.

In a series of decisions over the last decade, the Supreme Court has reconsidered an aspect of the Seventh Amendment that has been long overlooked: the allocation of particular questions to the judge or the jury in a case where the right to a jury trial applies. Breaking with historical practice, the Court has emphasized considerations other than the fact-law distinction as a basis for identifying the questions that must go to the jury. Most prominently, in Markman v. Westview Instruments, Inc., the Court focused on 'functional considerations" in assigning a question of patent claim construction to the judge. In …

The ways that children implement social and communication skills in peer-group interaction provide the foundation for successful later life adjustment (Rubin, Bukowski, & Parker, 1998). Research findings suggest that a host of variables are involved (Hart, Olsen, Robinson, & Mandleco, 1997). An industrial food processing plant consisting of nonlinear dynamics requires pressure and temperature controllers to be nonlinear. In this paper, nonlinear controllers are designed using fuzzy logic to augment the conventional pressure and temperature PI controllers for an industrial food processing plant. Simulation results are presented to show improvement in the plant response with the hybrid controllers.

Spectral Measures And Perceptual Ratings Of Hypokinetic Dysarthria, Christopher Dromey

Ten individuals with Parkinson disease (PD) and hypokinetic dysarthria were compared with age-matched neurologically normal (NN) speakers on acoustic measures from speaking and vowel phonation tasks as well as on perceptual ratings of connected speech. Listeners identified differences between the groups when asked to judge the severity of vocal and articulatory impairment during reading. Several conventional acoustic measures failed to differentiate speakers with PD from NN speakers. However, measures of the shape (statistical moments) of the long term average spectrum (LTAS) revealed statistically significant differences between the groups across vowel phonation, reading and monologue tasks. Using a response competition paradigm, we investigated the ability to ignore target response-compatible, target response-incompatible, and neutral visual and auditory distractors presented during a visual search task. The perceptual load model of attention (e.g., Lavie & Tsal, 1994) states that task-relevant processing load determines irrelevant distractor processing in such a way that increasing processing load prevents distractor processing. In three experiments, participants searched sets of one (easy search) or six (hard search) similar items. In Experiment 1, visual distractors influenced reaction time (RT) and accuracy only for easy searches, following the perceptual load model. This project is a book-length study of the manifesto, which attempts to trace adaptations writers have made to the genre, beginning with the Luther's "95 Theses." From there I move to political manifestoes, including the "Twelve Articles of the Swabian Peasants and Marx and Engels' "Manifesto of the Communist Party," and then to the aesthetic manifestoes of modernism. Later I treat manifestoes of critique, examining texts by Virginia Woolf, Frank O'Hara, Eve Kosofsky Sedgwick, and Donna Haraway, the Students for a Democratic Society and the Lesbian Avengers.

Historians pose questions regarding film's influence on the public's perception of historical eras and events. One concern is adapting information from written sources into visual discourse. However, they do not discuss how the screenplay holds an intermediary position between these two modes of representation. The Offering: Writing a Historical Screenplay, therefore, explores how a scriptwriter determines his or her use of sources to suit the visual medium of film. Of the estimated 50 million international refugees and displaced persons (U.S. Committee for Refugees, 2003), 80% are mothers with children (Women's Commission for Refugee Women and Children, 2003). There is a paucity of research that explores refugee experiences with organized violence and healing following such events. Available research typically addresses acts of domination and oppression rather than life stories of individuals. Individual health and healing responses are ordinarily examined through the lens of psychotraumatology. As student populations in colleges and universities continue to diversify, composition programs do not always meet students' varying needs. English as a Second Language (ESL) students appear to fail mainstream writing courses at higher rates than their traditional counterparts, yet mainstreaming continues to be mandated, often due to budgetary constraints. Many programs offer multicultural writing courses, but these, too, are often ineffective for many students. Despite both the recent trend in transatlantic scholarship and the central position Wordsworth and Whitman occupy in the Romantic tradition, there have been relatively few comparative discussions of the two poets. Although some critics have discerned solid connections between them, there is essentially a scholarly void in the critical record, and my dissertation fills this gap. A bridge between Wordsworth and Whitman is found in their privileging of a marginalized epistemology, which they expressed through a type of mystical rhetoric I call the "cosmic" mode. This epistemology entails the merging of self and other, a living cosmos endowed with consciousness, …

This article assesses Canada's principal legal responses to the challenge presented by terrorism in the aftermath of the September 11, 2001 attacks on the United States. A review of major federal anti-terrorism legislation reveals a legislative response that fundamentally violates core constitutional principles while failing to significantly enhance public safety.

his study is searching for the existence of any psychological effects on the attitudes or perceptions of West Virginia University students that are exposed to ethnic humor by stand-up comedians in a broadcast format. In this study a convenience sample of West Virginia University students was exposed to a fifteen-minute videotape containing multiple in-group solidarity ethnic jokes that were used by the selected comedians in their analyzed performances. The students were surveyed to quantitatively test the affects of ethnic humor. This research is an exploration of the public relations industry and its correlation between persuasive messages and ethical responsibility. The design tested public relation firms’ websites and the content of their persuasive messages to potential clients. It applies a qualitative analysis to the top 50 Public Relations corporation’s websites homepages and systematically breaks down their persuasive messages as they apply to the industry’s code of ethics. Alcohol exposure causes developmental abnormality known as Fetal Alcohol Syndrome (FAS), featured with central nervous system (CNS) dysfunction. The cerebellum is vulnerable to ethanol toxicity. Developmental exposure to ethanol depletes the number of cerebellar granule cells; however, the underlying mechanisms are unknown. A potential mechanism for ethanol-induced neuronal depletion is to reduce the pool of neuronal progenitors. The progression of the cell cycle is regulated by a family of protein kinases called cyclin-dependent kinases (CDKs). We hypothesize that ethanol interferes with the CDK system and disrupts the cell cycle kinetics in cerebellar granule progenitors (CGPs). Pregnant rats were fed ad …

This dissertation examines twentieth-century British fiction concerned with humankind's interactions with the nonhuman world. I analyze a range of literary works, including H. G. Wells's The Food of the Gods (1903), D. H. Lawrence's The Rainbow (1915), Women in Love (1920), and Lady Chatterley's Lover (1928), John Brunner's Stand on Zanzibar (1968), Graham Swift's Waterland (1983), and J. G. Ballard's Rushing to Paradise (1994). This body of literature remains largely unexamined for its treatments of ecological issues and belongs to a national history deeply implicated in local and global environmental change. The Interpretive Development Program (IDP) of the National Park Service (NPS) develops and maintains the national standards for interpretation by providing professional development opportunities and administrating a peer review certification process of interpretive products. This study explores the little-understood phenomena of how opportunities for intellectual and emotional connections between the resource and the visitor are created by NPS interpreters. This dissertation investigates the theory and practice of editing as it moves into the electronic era. As an example of the type of material which scholars may now be interested in working with, it centers on an edition of a lecture given by the West Virginia artist-journalist David Hunter Strother on John Brown nine years after the insurrection at Harper's Ferry.
