Publishing Privacy: Intellectual Property, Self-Expression, And The Victorian Novel, Jessica Bulman Jan 2003

Publishing Privacy: Intellectual Property, Self-Expression, And The Victorian Novel, Jessica Bulman

UC Law SF Communications and Entertainment Journal

Though typically invoked in legal writing for their portrayals of criminal trials and judicial failings, Victorian authors also probed a more subtle aspect of the law: the interrelationship of privacy and intellectual property. In their novels, this paper argues, these authors treated literary creations as uniquely private expression and used copyright-and the formal control it furnishes over publication-as a model for understanding privacy.

Discussing The First Amendment , Christina E. Wells Jan 2003

Discussing The First Amendment , Christina E. Wells

Faculty Publications

Despite its many good qualities, Eternally Vigilant nevertheless suffers from a flaw common to First Amendment scholarship--a tendency to give short shrift to study of the social, psychological, historical, and political factors that influence the Court's decision making and, thus, free speech doctrine. Discussion including these influences would facilitate an even greater understanding of free speech doctrine and the principles that underlie it.

Fighting Censorship In America, Who Are The Real Censors?, Dennis Ingolfsland Jan 2003

Fighting Censorship In America, Who Are The Real Censors?, Dennis Ingolfsland

The Christian Librarian

During the last half of the 20'11 century, the American Library Association- through the Office of Intellectual Freedom, the Freedom to Read Foundation and the Intellectual Freedom Action Network (ALAs Office 1995, 13) has emerged as one of America's leading opponents of censorship and advocates of free speech. The American Library Association's opposition to censorship is so absolute that it stands firmly against any library restrictions on access to books, magazines or internet sites even by children (Intellectual 1996, 84-94; cf. Berry 1998, 6; Mason 1997, I 04). There is some evidence, however, to suggest that there is a gap …

The 'P'-Word: Conversion In A Postmodern Environment, Brad Kallenberg Jan 2003

The 'P'-Word: Conversion In A Postmodern Environment, Brad Kallenberg

Theology and Religious Studies Faculty Publications

Allow me to write frankly about the “P”-word. There is great concern about the proliferation of the “P”-word. In the past decade, over 1,500 articles and 2,000 books have come into print bearing the "P"-word in their titles. Nearly 1,000 of these books are still in print. Everywhere we turn we find that we have been inundated with the “P”-word. And so we have come to fear for our culture. The "P"-word? “Postmodernism.”

Granted, postmodernism is a slippery concept; there are many versions, many postmodernisms. But should Christians fear postmodernism? To be sure, the modern era proved to be no …

On March 15, 1939, Germany, also known as The Third Reich, invaded Czechoslovakia in what has historically been recognized as a precipitating event leading to the beginning of World War II. The Third Reich, as the aggressor, expanded its efforts from Germany to remove all Jewish People and Jewish influences from Europe. In order to accomplish this objective, the Third Reich built concentration camps as containment centers for the Jewish people. These containment camps were extermination centers with locations at: Treblinka, Belzec, Auschwitz-Birkenau, Wülzburg, Sobibor and other locations. Another of these containment centers was Theresienstadt, which was converted into a …

Thirty Endangered Languages In The Philippines, Thomas N. Headland Jan 2003

Thirty Endangered Languages In The Philippines, Thomas N. Headland

Work Papers of the Summer Institute of Linguistics, University of North Dakota Session

There are 6,809 languages spoken in the world today. Conservative estimates are that the world's languages are currently dying at the rate of at least two languages each month, and linguists predict that most of today's languages will die out in the next 100 years. Since 1962, the author has been gathering field data on some of the smallest language groups in the world-the Philippine Negritos. This paper will explain why the thirty-plus Negrito languages in the Philippines are endangered, and what the projected future is for these numerically tiny post-foraging societies in the 21st century. The argument will be …

Should Marketing Managers Be Concerned About Attitudes Towards Marketing And Consumerism In New Zealand: A Longitudinal View, Steven Lysonski, Srinivas Durvasula, John Watson

Marketing Faculty Research and Publications

New Zealand has gone through a radical metamorphosis since free market economics were introduced in the mid-1980s. Marketing managers are particularly interested in the views of consumers about issues dealing with marketing activities. Negative views could signal consumer backlash against free market activities. This study examines the views of consumers from 1986 to 2001 on a range of issues dealing with marketing and consumerism. The results clearly show that consumers are less negative about marketing and consumerism issues since 1986. It seems likely that New Zealand has evolved in terms of the consumerism life cycle over the last 15 years. …

A Historical Study Of Time Markers In Thai, Pranee Kullavanijaya Jan 2003

A Historical Study Of Time Markers In Thai, Pranee Kullavanijaya

Manusya, Journal of Humanities

In general, time markers which mark a sequence of events can be divided into two main types: markers that have locution time of utterance as the referential point, and markers that have the mentioned time in the text as the referential point. Both types of markers range from one word which can be either inherent or derived to such constructions as noun phrases and preposition phrases. The study shows an increase in both the derived words and phrasal constructions in the four studied periods: Sukhothai, Ayutthaya, Mid-Rattanakosin and Modern Thai. The study also shows that two types of metaphors, one …

Mediated Popular Constitutionalism, Barry Friedman Jan 2003

Mediated Popular Constitutionalism, Barry Friedman

Faculty Articles

At present many theorists advocate some version of popular constitutionalism. Although commentators differ, and not all theories are well-defined, the central idea is that constitutional meaning should reflect popular understandings. This paper explores the relationship between popular opinion and judicial review, with special attention to the social science literature that bears upon the topic. In light of that literature, this paper argues that we have a system of popular constitutionalism that is mediated through politics and media coverage of the courts. The paper begins with a sketch of a normative argument in which popular opinion is relevant to the exercise …

Murders, Memories, And Uncle Al's War: Reflections On The Killing Of Prisoners Of War In World War Ii, James J. Weingartner

SIUE Faculty Research, Scholarship, and Creative Activity

In 2003, I was invited to give a talk at the St. Louis Soldiers’ Memorial Museum. The topic was war crimes, international law, and war crimes trials. It was conceived with the events of 9/11/2001 fresh in mind, but was focused on those subjects within the context of World War II, my area of expertise. Forgotten in the intervening 20 years, I rediscovered it recently while organizing my papers in preparation for donating them to the Southern Illinois University, Edwardsville archives. It’s a simple story that blends some of my own childhood memories of World War II with bits of …

Plagiarism And Its (Disciplinary) Discontents: Towards An Interdisciplinary Theory And Pedagogy, Lisa Maruca

English Faculty Research Publications

Despite the abundance of literature on the topic, there is very little that can be called “common” about our common sense understanding of plagiarism. Taking a closer look at the history, rhetorical uses, and cultural practices of plagiarism, this essay reveals that this concept is multiple and heterogeneous, riddled with contradictions and blind spots. As a result, the article argues the overlapping, inter-related, yet distinct discourses of plagiarism that circulate within the academy can be usefully described as a “complex system.” In positing plagiarism as a complex system, this article has several goals. First, it shows how singular approaches to …

From Marxism-Leninism To Ethnicity: The Sideslips Of Ethiopian Elitism, Messay Kebede Jan 2003

From Marxism-Leninism To Ethnicity: The Sideslips Of Ethiopian Elitism, Messay Kebede

Philosophy Faculty Publications

For many scholars, colonialism and neocolonial policies remain the root causes of Africa's numerous impediments to its progress, ranging from the persistence of poverty to the ravages of ethnic conflicts. However, the number of scholars who prefer to ascribe these impediments essentially to the persistence of traditional views and methods and to the lack of reforms radical enough to trigger a sustained process of modernization is not negligible. My position contests this either-or debate and identifies the culprit as the rise of African elitism—a phenomenon implicating the specific effect of colonialism in conjunction with internal African contributions. I take the …

The Educational Thought And Practices Of Padre Luís Alberto Hurtado Cruchaga S. J., Justo Gallardo Jan 2003

The Educational Thought And Practices Of Padre Luís Alberto Hurtado Cruchaga S. J., Justo Gallardo

Dissertations and Theses @ UNI

The memory of the Jesuit Luís Alberto Hurtado Cruchaga S.J. is deeply held by the people of Chile. Most are aware of his main activities in favor of the poor. More than 50 years after his death, he is undeniably remembered for his main social work, El Hogar de Cristo, the largest welfare institution in Latin America. His importance for education in Chile, however, is less well-recognized. This historical case study is intended to address this less well-known aspect of his life.

As such, the purpose of this study is to examine Padre Hurtado's influence on Chilean education in the …
