The antipathy of federal and state courts toward equal protection arguments in lawsuits challenging the public funding of education have forced education activists to search for alternative doctrinal hooks as they continue to seek reform in states' funding and management of schools. These activists have turned to state constitutions' education clauses, which impose duties on state governments to provide an "adequate" education for all children in the state. However, the art of defining and measuring an "adequate" education has advanced little beyond its state in 1973, when Justice Thurgood Marshall found the term unhelpful. Overall, pesticide use is growing in developing countries. United States' pesticide use changed in content, but remains substantial in volume. Critics of pesticide policy, including many of the speakers at this symposium, are concerned that pesticide problems are worsening. Surprisingly, thirty years after the Federal Insecticide, Fungicide, and Rodenticide Act ("FIFRA") reforms and the victory over DDT, the critics are not yet prepared to declare victory. Even worse from the perspective of environmental pressure groups is the change in attitude toward DDT, a substance whose name invokes extraordinary invective, where the current picture is not quite what the advocacy groups …

Since the California Gold Rush in 1848, the mining of hard rock minerals (e.g., gold, silver, and similar minerals) on public lands has been based on the principle that discovery and development of mineral resources led to private ownership, promoting exploration and discovery of mineral resources. As with other nineteenth century land disposal statutes, such as the various homestead laws, the General Mining Law of 1872 provides for provision of mineral rights and even fee simple title to land based on the satisfaction of conditions related to use of the land and does not require significant payments to the federal …

No current issue in corporate governance is more hotly debated than the question, "Why are American CEOs paid such high salaries?" A recent and influential answer, dubbed the "managerial power" approach, has an appealing simplicity: CEOs so thoroughly control their firms' compensation-setting machinery that they simply pay themselves whatever they want, restrained only by the tenuous limits of their own avarice and the vague need to avoid public "outrage." As an explanation for a complex process, however, the simplistic managerial power approach is so flawed as to be nearly useless. The single most intriguing feature of CEO compensation for example, …

This Note focuses on TRIPS' impact on the pharmaceutical industry as well as health care in developing nations. By using Egypt as a case study, this Note aims to emphasize that the benefits of TRIPS for developing nations depends on the linkage between intellectual property rights (IPR) and other legal regimes, particularly drug regulation, technology transfer, and foreign direct investment (FDI) policies. Advances in reproductive technology are an established part of the medical landscape. No longer merely the subject of science fiction, new reproductive technologies are more commonly available each year. As these technologies become widespread, the law will need to recognize their existence and consider their impact on legal rules and institutions. Much as family law earlier evolved to include adopted and born-out-of-wedlock children within the legal definition of children, so too will property law need to address the reality of posthumously conceived children. The American Cancer Society estimated a quarter of a million women would be diagnosed with breast cancer in 2002. For each of those, another ten women are living with or have survived this disease. At diagnosis, most women view their futures with dread. As with other extreme traumas, the diagnosis of breast cancer can bring profound transformation (Jackson, 1983; LeShan, 1994; O'Brien, 1995). In this study, seven survivors of breast cancer articulate their journeys through this disease and detail how they were able construct transformed lives. The women described how they turned tragedy into triumph. Individual interviews were conducted and …

A significant disparity exists between the numbers of male and female personnel among high-ranking officers serving in the U.S. Navy. The general perception is that women have not been part of the Navy long enough to be in the flag officer's ranks. However, it has been over 30 years since the Navy first placed women in the ranks of flag officers. This article recounts how a number of strategic infrastructure investment decisions in airport and rail development taken by the Singapore government were at variance with recommendations emerging from cost-benefit analysis, but were considered necessary to support external competitiveness. This link between infrastructure provision and economic development may require decision makers to assess the trade-off between prudent macro-economic planning and efficient micro-economic management for major projects. In the case of airport hubs, the most difficult assessment might be the game consideration of how much, and how far ahead, excess capacity is needed to ensure the dominance of the hub.

An important role of education – and the resultant accumulation of human capital – for a less-developed economy is to facilitate technology diffusion in order for it to catch up with developed economies. This paper presents a model linking education, the accumulation of physical capital and technological progress. In the model, investment in education and the accumulation of physical capital are complementary, and intertwine with the technology progress through related effects on technology diffusion and the expansion of the technology frontier. The allocation of effort to education, the optimal savings rate and the technology gap are endogenously determined in the …

A Comparison Of Learning Styles Among Seven Health Professions: Implications For Optometric Education, Patrick C. Hardigan, Stanley R. Cohen

Educational research and development efforts are most often directed at the improvement of teaching while neglecting students’ learning styles. Besides being marginally effective, an exclusive focus on improving teaching methods may lead to reinforcement of inappropriate and nontransferable learning strategies. As such, this study is being undertaken to determine if differences in personality style exist among health profession students. This retrospective-descriptive study tested the null hypothesis “there is no difference in personality traits between osteopathic medicine, pharmacy, physical therapy, physician assistant, dental medicine, optometry and occupational therapy students.” Differences as well as similarities were discovered across all seven professions. In their comprehensive analysis of the Kyoto Protocol and climate policy, Richard B. Stewart and Jonathan B. Wiener examine the current impasse in climate policy and the potential steps nations can take to reduce greenhouse gases. They summarize the current state of information regarding the extent of global warming that would be caused by increasing uncontrolled greenhouse gas emissions. They explain why participation by all major greenhouse gas-emitting countries is essential to curb future greenhouse gas emissions and also note the significant obstacles to obtaining such participation.

A search for narrow-width resonances that decay into electron+jet or neutrino+jet has been performed with the ZEUS detector at the DESY ep collider HERA operating at center-of-mass energies of 300 and 318 GeV. An integrated e+p luminosity of 114.8 pb-1 and e-p luminosity of 16.7 pb-1 were used. No evidence for any resonance was found. Limits were derived on the Yukawa coupling λ as a function of the mass of a hypothetical resonance that has arbitrary decay branching ratios into eq or vq. These limits also apply to squarks predicted by R-parity-violating supersymmetry. Limits for the production of leptoquarks described …

Stability Of Intravesical Epirubicin Infusion: A Sequential Temperature Study., Gj Sewell, Ae Rigby-Jones, Mj Priston

OBJECTIVE: To investigate the stability of epirubicin bladder instillation, prepared from two different epirubicin formulations, under refrigerated storage, transportation and clinical use conditions. METHOD: A sequential study design was used. Epirubicin instillation (1 mg/mL) in polypropylene syringes was sequential incubated for periods of 84 days at 8 degrees C followed by 2 h at 25 degrees C and 1 h at 37 degrees C, the latter two temperatures replicating transport and intravesical conditions, respectively. RESULTS: The instillation was both chemically and physically stable under those incubation conditions. The formulation of epirubicin used to prepare the instillation infusions did not affect …
Environmental Impacts Of Modern Agricultural Technology Diffusion In Bangladesh: An Analysis Of Farmers' Perceptions And Their Determinants, S Rahman

Farmers' perception of the environmental impacts of modern agricultural technology diffusion and factors determining such awareness were examined using survey data from 21 villages in three agro-ecological regions of Bangladesh. Results reveal that farmers are well aware of the adverse environmental impacts of modern agricultural technology, although their awareness remains confined within visible impacts such as soil fertility, fish catches, and health effects. Their perception of intangible impacts such as, toxicity in water and soils is weak. Level and duration of modern agricultural technology adoption directly influence awareness of its adverse effects. Education and extension contacts also play an important …
