No Bond, No Body, And No Return Of Service: The Failure To Honor Misdemeanor And Gross Misdemeanor Warrants In The State Of Washington, Hon. Philip J. Van De Veer

Seattle University Law Review

This Article will first examine how the warrant system works in Washington and how jail overcrowding and prisoner litigation has hindered the ability of law enforcement to arrest defendants wanted on misdemeanor and gross misdemeanor warrants. Second, the scope of the problem will be documented, followed by an analysis of why limited jurisdiction judges are currently unable to adequately respond to the growing problem. Finally, the harms caused by the failure to execute warrants will be detailed, followed by a survey of options available to correct the problem.

Depriving Washington State's Incarcerated Youth Of An Education: The Debilitating Effects Of Tunstall V. Bergeson, Jamie Polito Johnston

The analysis begins in Section II with a general overview and summary of Tunstall v. Bergeson. Section III presents a brief legislative background of the statute at issue in Tunstall, Education Programs for Juvenile Inmates, RCW section 28A.193. Section IV discusses Tunstall's misinterpretation of these statutory provisions, demonstrating the Education Programs for Juvenile Inmates' disregard of the paramount duty to provide education to youth under twenty-one pursuant to the Basic Education Act and violation of the Washington Constitution, as discussed in Section V. Next, Section VI argues that because the right to education is a fundamental right under state law, …

Harm To The "Fabric Of Society" As A Basis For Regulating Otherwise Harmless Conduct: Notes On A Theme From Ravin V. State, Eric A. Johnson

This article explores the possibility that harm to the fabric of society provides the best justification for some statutes that prohibit otherwise harmless conduct. This article considers three illustrations: first, the incest statutes, which, even in progressive states like Alaska and New York, prohibit a wide array of basically harmless conduct; second, a Massachusetts statute regulating the use of human silhouettes in target practice; and finally, legislation that would prohibit the medical procedure known as "partial-birth abortion.'" Agency Burrowing: Entrenching Policies And Personnel Before A New President Arrives, Nina A. Mendelson

This Article examines executive branch agency actions concluded just before a new President takes office, such as "midnight" rulemaking and late-term hiring and promotion, which Professor Mendelson collectively refers to as "agency burrowing." Congress, the media, and some commentators have portrayed such activities as unsavory power grabs that undermine the President-elect's ability to direct the functions of administrative agencies. Rather than dismissing agency burrowing out of hand, however, Professor Mendelson argues for a more nuanced approach. In some cases, burrowing can make positive contributions to the democratic responsiveness of agencies, agency accountability, and the "rule of law." A fuller analysis …

The Model Penal Code approach to mens rea was a tremendous advance. The MPC carefully defines a limited number of mens rea terms, firmly establishes element analysis in place of offense analysis, and recognizes that the doctrine of mistake is part and parcel of the basic analysis of mens rea.

However, a revised Code could improve the drafting of the mens rea provisions in a number of respects:

* Clarify how to distinguish result, circumstance, and result elements

Exfoliated Poly(Methyl Methacrylate) And Polystyrene/ Nanocomposites Occur When The Clay Cation Contains A Vinyl Monomer, Shengpei Su, Charles A. Wilkie

Chemistry Faculty Research and Publications

The bulk polymerization of methyl methacrylate and styrene in the presence of an organically modified clay containing a vinyl group that can be involved in the polymerization produces exfoliated nanocomposites. These nanocomposites have been characterized by X-ray diffraction, transmission electron microscopy, thermogravimetric analysis, mechanical properties, and cone calorimetry. The onset temperature of thermal degradation increases with the mechanical properties. The peak heat release rate is significantly reduced for nanocomposites containing 3 or 5% clay. © 2003 Wiley Periodicals, Inc. J Polym Sci Part A: Polym Chem 41: 1124–1135, 2003

Based on the experience of the U.S. National Assessment, we propose a program of research and analysis to advance capability for assessment of climate impacts, vulnerabilities, and adaptation options. We identify specific priorities for scientific research on the responses of ecological and socioeconomic systems to climate and other stresses; for improvement in the climatic inputs to impact assessments; and for further development of assessment methods to improve their practical utility to decision-makers. Finally, we propose a new institutional model for assessment, based principally on regional efforts that integrate observations, research, data, applications, and assessment on climate and linked environmental-change issues. …

Depressive Störungen in Kindheit und Jugendalter sind unter anderem durch die hohe Prävalenz und Persistenz depressiver Störungen bis ins Erwachsenenleben, bedeutenden Komorbiditäten mit anderen psychischen Störungen und psychosozialen Problemen von hoher individueller und gesellschaftlichen Bedeutung. Aufgrund dieser Erkenntnisse haben verschiedene Autoren weltweit damit begonnen Präventionsprogramme zu entwickeln und zu evaluieren. In diesem Artikel werden die Probleme der Präventionsforschung und die Effektivität von Prävention bei Kindern und Jugendlichen dargestellt. Den Schwerpunkt bildet dabei ein Überblick über derzeit vorliegenden Programme und deren Evaluationen unter besonderer Berücksichtigung von Programmen, die in deutscher Sprache vorliegen. Abschließend werden mögliche Entwicklungsrichtungen der zukünftigen Präventionsforschung aufgezeigt.

Depressive Störungen im Jugendalter sind ein weit verbreitetes Problem mit weitreichenden psychosozialen Folgen. Um beidem vorzubeugen wurde ein universales schulbasiertes kognitiv-verhaltenstherapeutisches Präventionsprogramm entwickelt, das in Anlehnung an das Multifaktorielle Depressionsmodell aus einem kognitiven und einem sozialen Trainingselement besteht. Im kognitiven Teil werden dysfunktionale Gedanken bearbeitet und im sozialen Programmteil werden selbstsicheres Verhalten und Kontaktfähigkeit trainiert. Es wurde erwartet, dass die Teilnahme am Präventionsprogramm direkt nach Beendigung noch keinen signifikanten Effekt auf die depressiven Symptome zeigt, während geringer ausgeprägte dysfunktionale Gedanken und eine Verbesserung der sozialen Unterstützung erwartet wurden. Zahlreiche internationale empirische Befunde belegen heute, dass depressive Symptome und Störungen im Jugendalter ein weit verbreitetes, oftmals folgenreiches und ernst zu nehmendes Gesundheitsproblem darstellen. Depressive Jugendliche zeigen in vielen Fällen erhebliche Alltagsbeeinträchtigungen und verschiedene komorbide psychische Probleme. Sie tragen ein deutliches Risiko, auch in ihrer weiteren Entwicklung – bis in das Erwachsenenalter – unter anhaltenden oder wiederkehrenden depressiven Episoden, anderen psychischen Störungen und psychosozialen Beeinträchtigungen zu leiden (vgl. Further Thoughts On The Role Of Regulatory Purpose Under Article Iii Of The General Agreement On Tariffs And Trade: A Tribute To Bob Hudec, Donald H. Regan

My topic in this article is the role of regulatory purpose under Article III of the GATT, and I regard Bob [Hudec] as the patron saint of efforts to establish the relevance of purpose. His famous "Requiem for an 'Aims and Effects' Test" may have been called a requiem, but it was reluctant and sceptical. Bob thought dispute settlement tribunals ought to consider the regulator's purpose, and he thought they would do so, whatever they said. As decisions on Article III accumulate, we are in the process of learning that he was right on both counts.

The Uniform Probate Code's Elective Share: Time For A Reassessment, Lawrence W. Waggoner

In this Article, Professor Waggoner proposes reforms to the Uniform Probate Code's (UPC) treatment of the elective share of the surviving spouse. First, the Article recommends that the UPC adopt a form of presentation that more transparently reflects the normative theories and empirical assumptions underlying the UPC's elective share framework. Second, the Article presents demographic data suggesting that the UPC's current elective share approximation schedule may be inappropriatef or a sizable faction of married couples, those remarryingf ollowing widowhood.
