New Social Movements And The Struggle For Worker’S Rights In The Maquila Industry, Victoria Carty Jan 2003

New Social Movements And The Struggle For Worker’S Rights In The Maquila Industry, Victoria Carty

Sociology Faculty Articles and Research

"Campaigns to improve worker’s rights in export processing zones (EPZs), also referred to the maquila industry in Latin America, is an important topic analytically and politically. On theoretical and practical levels, the co-existence of market economies with effective means to ensure adequate working conditions for workers is a critical question. Underlying the issue is a vigorous debate regarding how the global economy should be governed; who or what should govern it, and whose interest is should serve (Faux, 2002)."

Risk Avoidance, Cultural Discrimination, And Environmental Justice For Indigenous Peoples, Catherine O'Neill Jan 2003

Risk Avoidance, Cultural Discrimination, And Environmental Justice For Indigenous Peoples, Catherine O'Neill

Faculty Articles

This article begins with the recognition that environmental justice for Native peoples requires attention to the interrelated cultural, spiritual, social, ecological, economic, and political dimensions of environmental issues. It observes, moreover, that “environmental justice requires an appreciation of each tribe’s particular historical circumstances and contemporary understandings, including each group’s aspirations for the flourishing of its culture.” It contends that some environmental decision makers and commentators have increasingly come to embrace “risk avoidance” – strategies that call upon risk-bearers to alter their practices in order to avoid the risk of environmental harms – in lieu of risk reduction – strategies that …

Resisting Medicine/Remodeling Gender, Dean Spade Jan 2003

Resisting Medicine/Remodeling Gender, Dean Spade

Faculty Articles

In this article, Dean Spade explores the problematic role of medicine in pushing for trans rights. Spade uses a combination of personal narrative of his own interaction with the healthcare system and his experience with legal advocacy on behalf of transgender and gender nonconforming clients. He reveals how the medicalization of trans identity, by categorizing it as a mental health disorder called Gender Identity Disorder, serves to reaffirm that everyone should either be male or female. Spade further asserts this medicalization can be problematic when advocating for the legal rights of gender nonconforming individuals. For example, he points out that …

"Active Living": Transforming The Organization Of Retirement And Housing In The U.S., Paul C. Luken, Suzanne Vaughan Jan 2003

"Active Living": Transforming The Organization Of Retirement And Housing In The U.S., Paul C. Luken, Suzanne Vaughan

The Journal of Sociology & Social Welfare

We examine the transformation of the social institutions of retirement and housing in the US in the latter part of the 20th century. Using institutional ethnography we explicate a woman's experience relocating to an age segregated community. Her relocation is predicated upon ideological practices that reconceptualize retirement as "active living" and the construction of a setting in which retirees engage in this new lifestyle. We demonstrate the textual mediation of this ideological and organizational reformation through an examination of an advertising campaign undertaken by the Del Webb Development Corporation in the marketing of Sun City, Arizona. The advertising texts provide …

Evaluation Of 10-Fold Cross Validation And Prediction Error Sums Of Squares Statistic For Population Pharmacokinetic Model Validation, Shibani Harite Jan 2003

Evaluation Of 10-Fold Cross Validation And Prediction Error Sums Of Squares Statistic For Population Pharmacokinetic Model Validation, Shibani Harite

University of the Pacific Theses and Dissertations

It was the objective of the current study to evaluate the ability of 10-fold cross validation and prediction error sum of squares (PRESS) statistic to identify population pharmacokinetic models (PPKM) that were estimated from data without influence observations versus PPKMs from data containing influence observations. The evaluation of 10-fold cross validation and PRESS statistic from Leave-one-out cross-validation for PPK model validation was performed in 3 Phases. In Phase 1 model parameters (theta and clearance) were estimated for datasets with and without influence observations. It was found that influence observations caused an over-estimation of the model parameters.

Head Start, Other Preschool Programs, & Life Success In A Youth Cohort, Richard K. Caputo Jan 2003

Head Start, Other Preschool Programs, & Life Success In A Youth Cohort, Richard K. Caputo

The Journal of Sociology & Social Welfare

This study assesses the effects of Head Start and other preschool programs on five life success measures in a U.S. cohort of youth (N = 5,621). The life success indices are average annual income-to-poverty ratios, economic mobility, and number of years the youth lived in families whose incomes fell below official poverty thresholds, received Food Stamps, and received TANF/AFDC. Controlling for a variety of background and other factors in separate regression models for each life success measure, results show that youth who participated in preschool programs other than Head Start had higher average annual income-to-poverty ratios than nonpreschoolers. Bivariate findings …

Identity Theft, Privacy, And The Architecture Of Vulnerability, Daniel J. Solove Jan 2003

Identity Theft, Privacy, And The Architecture Of Vulnerability, Daniel J. Solove

GW Law Faculty Publications & Other Works

This Article contrasts two models for understanding and protecting against privacy violations. Traditionally, privacy violations have been understood as invasive actions by particular wrongdoers who cause direct injury to victims. Victims experience embarrassment, mental distress, or harm to their reputations. Privacy is not infringed until these mental injuries materialize. Thus, the law responds when a person's deepest secrets are exposed, reputation is tarnished, or home is invaded. Under the traditional view, privacy is an individual right, remedied at the initiative of the individual.

In this Article, Professor Solove contends the traditional model does not adequately account for many of the …

The Origins And Growth Of Information Privacy Law, Daniel J. Solove Jan 2003

The Origins And Growth Of Information Privacy Law, Daniel J. Solove

GW Law Faculty Publications & Other Works

In recent years, information privacy has emerged as one of the central issues of our times. Today, we have hundreds of laws pertaining to privacy - the common law torts, criminal law, evidentiary privileges, constitutional law, at least twenty federal statutes, and numerous statutes in each of the fifty states. To understand the law of information privacy more completely, it is necessary to look to its origins and growth. This article provides a brief overview of the history of the development of information privacy law. In particular, it explores the way that the law has emerged in response to changes …

The Virtues Of Knowing Less: Justifying Privacy Protections Against Disclosure, Daniel J. Solove Jan 2003

The Virtues Of Knowing Less: Justifying Privacy Protections Against Disclosure, Daniel J. Solove

GW Law Faculty Publications & Other Works

This Article develops justifications for protections against the disclosure of private information. An extensive body of scholarship has attacked such protections as anathema to the Information Age, where the free flow of information is championed as a fundamental value. This Article responds to two general critiques of disclosure protections: (1) that they inhibit freedom of speech, and (2) that they restrict information useful for judging others.

Regarding the free speech critique, the Article argues that not all speech is of equal value; speech of private concern is less valuable than speech of public concern. The difficulty, however, is distinguishing between …

Can Pragmatism Be Radical? Richard Posner And Legal Pragmatism, Daniel J. Solove, Michael Sullivan Jan 2003

Can Pragmatism Be Radical? Richard Posner And Legal Pragmatism, Daniel J. Solove, Michael Sullivan

GW Law Faculty Publications & Other Works

Richard Posner's Law, Pragmatism, and Democracy (2003) is the most comprehensive account to date of his pragmatic vision of the law and democracy. For the most part, Posner's theory of pragmatism has been attacked externally, mainly by theorists unsympathetic to pragmatism. In contrast, in this Review, we contest Posner's account of pragmatism from within the pragmatic tradition. We contend that Posner's views are problematic not because they are pragmatic, but because they are often not pragmatic enough.

We put Posner's account of pragmatism to the pragmatic test by examining its implications. Posner views ideals as useless and philosophical theorizing as …
