This paper examines the challenge of protecting American Indian sacred sites located on federal public lands. Many have addressed this issue in the religious freedoms context, but I believe the problem is just as much about property law. The Supreme Court's decision in Lyng v. Northwest Indian Cemetery Protective Association, for example, would appear to suggest that federal ownership of certain sacred sites trumps tribal free exercise clause claims regarding those sites. This holding corresponds with a classic model in which "[p]roperty is about rights over things and the people who have those rights are called owners." However, a …

Access, Adequacy And Equality: The Constitutionality Of School Fee Financing In Public Education, Daria Roithmayr

This article explores the question of whether charging school fees for public education violates s 29 or s 9 of the Constitution. The article concludes that fees may be unconstitutional, for two reasons. First, charging school fees may violate learners' rights to basic education under s 29, because a fee-based financing system creates problems with both access and adequacy. Despite the availability of exemptions for the poor, the school fee regime of financing appears to completely bar access for some learners. In this Article, I argue that the practice of charging school fees to attend public school is an example of locked-in discrimination that persists over time, even in the absence of intentional discrimination. Exploring the lock-in model of discrimination in the unique context of South Africa, I make two central points. First, discriminatory practices often become locked into institutional structures because high switching costs-the costs of moving from a discriminatory practice to an inclusive one--make it too difficult for an institution to discontinue discriminating. There is little doubt that sexism and ageism still exist. To remedy these "isms," there are laws to protect both women and older workers from discrimination in the workplace, namely Title VII of the Civil Rights Act of 1964 ("Title VII"), which prohibits sex discrimination as well as discrimination based on many other protected categories, and the Age Discrimination in Employment Act of 1967 ("ADEA"), which prohibits age discrimination. Despite these protections, an older woman cannot bring a claim based on the fact that she feels she was discriminated against because she is an older woman. In other words, her …

Subsidiarity As A Structural Principle Of International Human Rights Law, Paolo G. Carozza

This article argues that the principle of subsidiarity should be recognized as a structural principle of international human rights law primarily because of the way that it mediates between the universalizing aspirations of human rights and the fact of the diversity of human communities in the world. The idea of subsidiarity is deeply consonant with the substantive vision of human dignity and the universal common good that is expressed through human rights norms. Yet, at the same time it promotes respect for pluralism by emphasizing the freedom of more local communities to realize their own ends for themselves.

Relationship Between Evaluative Groups' Perceptions Of Children And Children's Self-Reported Levels Of Self-Concept, Terry T. Burgener

The significance of significant others' (parents, peers and teachers) ratings on children's self-reported levels of self-concept were investigated. Self-reported levels of self-concept were determined by administrating the Multidimensional Self Concept Scale (MSCS), while parent, peer, and teacher ratings of children were determined by the use of rating scales designed using selected MSCS items. Results indicated that all significant others' ratings were positively correlated to children's self-reported levels of self-concept. Peer ratings were the most predictive of self-reported level of self-concept, while teacher ratings were the second most predictive variable and parent ratings the least predictive variable. Phaeophyscia leana (Tuck.) Essl., an endemic North American lichen species presently known to occur only within the Ohio River basin, is state-endangered in Illinois and a potential candidate for the Federal Endangered Species list. Since it utilizes periodically inundated corticolous substrates associated with river channels, oxbow lakes, and sloughs, this imperiled lichen is sensitive to landuse patterns within river floodplains. Surveys for P. leana were conducted to recensus previously documented populations, thereby assessing their stability, and to identify additional populations within the Ohio River Basin. This study, which consists of two phases, explores the relationships between religion and coping with stress within the framework of interpersonal and intrapersonal communication. Both pastors and congregational members (n = 855) were surveyed about their perceptions of the role of religion in managing and coping with stress. A focus group involving five members of the clergy was implemented to conduct phase II of the research. This thesis examines how church relationships (i.e. with God, the pastor, and among congregational members) affect our abilities to function through stressful times. Dismissed by contemporary critics as a second-rate writer, Benjamin Disraeli has been undervalued for over a hundred and fifty years. Writing in 1979, D.R. Schwarz rued that no recent full-length study of his novels had been undertaken, while other, even more minor novelists have been regularly exhumed. A substantial reassessment may be underway, as Paul Smith notes, particularly in the area of Disraeli's Jewishness. The purpose of this study was to compare college age students' knowledge about wellness to their physical activity and nutrition attitudes and behaviors. This study tested the knowledge of 202 college age students at Eastern Illinois University and gathered data on their physical activity and nutrition attitudes and behaviors. A modified Wellness Knowledge, Attitude, and Behavior Instrument (WKABI) questionnaire was used for data collection (Dinger, 1994). The purpose of this study was to clarify the relationship between child maltreatment recurrence and several predictor variables in 7 rural counties in central Illinois, an under-studied population in the child maltreatment literature. Additionally, factors that contributed to the decision by Illinois Department of Child and Family Services (DCFS) to provide post-investigative services were also examined. Data were obtained from an integrated database maintained by Illinois DCFS. All indicated cases of maltreatment occurring between January 1, 2000 and March 31 of 2001 were examined for a 12-month period following the initial indicated report for child revictimization or perpetrator recidivism. This article presents a review of the service-learning literature as a foundation for a discussion on integrating service-learning into dietetics and nutrition education. The purposes of this review are to (1) define service-learning, (2) discuss how service-learning can enhance dietetics and nutrition education programs, (3) explain principles and best practices fur integrating service-learning into dietetics and nutrition curricula, and ( 4) outline practical tips for orienting students for this experience and establishing sites for service-learning activities. Demographic trends show that the population of librarians in the U.S. is rapidly aging. This paper examines the ways that library managers can make workplaces more attractive to older librarians in order to encourage them to remain in the workforce beyond retirement age. The article dispels some negative stereotypes of "the older worker" and shows the advantages of retaining individuals with experience and maturity. It also addresses organizational climate, management, and training issues related to older workers.
