Billboards And Big Utilities: Borrowing Land-Use Concepts To Regulate "Nonconforming" Sources Under The Clean Air Act, Deepa Varadarajan

Part II of this Note provides an overview of how the regulatory framework has developed with regard to federal control technology requirements governing major stationary sources. It focuses on the statutory language of the 1970 Clean Air Act and the 1977 Clean Air Act Amendments and subsequent administrative and judicial interpretations. Part III examines the development of the land-use doctrine governing the regulation of preexisting nonconforming uses and highlights its theoretical similarities to the air pollution context. Part IV looks specifically at the jurisprudence surrounding the use of amortization provisions in the zoning context. By and large, a court's acceptance …

Enforcement Of Wto Rulings: An Interest Group Analysis, Mark L. Movsesian

The WTO's Dispute Settlement Understanding ("DSU") provides that disputes are to be resolved in adversarial proceedings before impartial panels of experts. These panels have authority to decide whether members' laws conform to WTO requirements; members may appeal rulings to a permanent Appellate Body within the organization, which has the final say on questions of law and legal interpretation. Under the DSU, if a member fails to comply with a final ruling in a dispute, the prevailing party may retaliate by suspending trade concessions that it owes the offending member. This retaliation can continue until the offending member implements the WTO's …

The challenges of teaching corporate social responsibility and good corporate citizenship have shifted as political and social climates have changed in New York, the United States, and around the world. I discuss some of those challenges in this Article. My primary focus, however, is the challenge of talking about race in business and corporate law courses and seminars.

This article, however, does not purport to cover all possible dimensions of sovereignty but, instead, focuses primarily on what might be thought of as the core of sovereignty - the "monopoly of power" dimension - although it will be clear that even this focus inevitably entails certain linkages and "slop-over penumbra" of the other sovereignty dimensions. This "core" dimension is examined in the context of its roles with respect to international law and institutions generally, and international relations and related disciplines such as economics. One of the theoretical premises of the patent system is that it enhances the dissemination of valuable information by assuring creators of new inventions a limited monopoly for the exploitation of their inventions. As a tool of state policy, the patent system seeks to catalyze the industrialization of the state, disclosure of information by inventors, and ultimately, the enrichment of the public domain in a manner that benefits both the inventor and the Society. There is a robust clinical literature on how issues of race and gender may influence all aspects of the clinicalsetting: the relationship between student and client, the relationship between student and student, the relationship between student and clinical supervisor, the attitude of the fact-finder toward the clinical client. But there has been virtually no attention paid to the role of sanism in the clinical setting.

Sanism is an irrational prejudice of the same quality and character as other irrational prejudices that cause and are reflected in prevailing social attitudes of racism, sexism, homophobia and ethnic bigotry. It permeates all aspects …

This essay focuses on the critical reaction to Bjorn Lomborg's book, The Skeptical Environmentalist. After the book was glowingly reviewed in the Washington Post, the Economist, and other influential publications, it was critically reviewed in Scientific American, Nature, and Science and criticized by environmental organizations. The criticism went beyond trying to show him wrong on environmental policy to claim that he should be disqualified as a participant in debates on environmental policy. Determination Of Seric Retinol Levels In Relation To Consumed Diet And The Prevalence Of Anemia In Preschool- And School-Aged Children In The Communities Of Cuambo And La Rinconada, Imbabura Province, Verónica Chávez

In this investigation the seric retinol levels were determined in order to relate them with consumed diets by preschool- and school-aged children and the prevalence of anemia in the communities of Cuambo and La Rinconada, Imbabura province, in order to later compare them with reference values. Blood samples were taken from 74 children from the two communities, 30 in La Rinconada and 44 in Cuambo, beneficiaries of the Benson Institute, to determine retinol, ferritin, hemoglobin, and hematocrit. Also, a 24-hour record with frequency of food consumption survey was given to the studied children's parents, making a sample of 56 families. …

The general objective of this investigation was to implement and strengthen family orchards for the diversification of the diet and improvement of the consumption of vegetables and fruits available in the communities of the Rinconada and Cuambo. They collaborated in the implementation and strengthening of the family orchards and by means of focal group techniques determined the readiness, seasonal variance, and alimentary habits of the available vegetables and fruits. In many countries, the health and the development of a great number of people are compromised by the insufficient distribution of micro-nutrients. The deficiency of iron is one of the things that to a large extent contributes to the high rates of death and maternal and childhood mortality, affecting also a great percentage of school aged children. We have developed novel instrumentation using confocal and widefield microscopy to image and analyze thrombus formation in real time in the microcirculation of a living mouse. This system provides high-speed, near-simultaneous acquisition of images of multiple fluorescent probes and a brightfield channel, and supports laser-induced injury through the microscope optics. Although this imaging facility requires interface of multiple hardware components, the primary challenge in vascular imaging is careful experimental design and interpretation. This system has been used to localize tissue factor during thrombus formation, to observe defects in thrombus assembly in genetically altered mice, to study the kinetics of platelet …
