Restoring Power To The Powerless: The Need To Reform California's Mandatory Mediation For Victims Of Domestic Violence, Alana Dunnigan Jan 2003

Restoring Power To The Powerless: The Need To Reform California's Mandatory Mediation For Victims Of Domestic Violence, Alana Dunnigan

University of San Francisco Law Review

In California, the intersection of mandatory mediation with domestic violence poses significant dangers on two levels. On a societal level, California's requirement that victims of domestic violence mediate with their abusers has placed a hurdle in the battered women's movement by reprivatizing domestic violence, impeding the progress that is driven by public discourse and scrutiny. On an individual level, mandatory mediation leaves victims in a disadvantageous position, fending for themselves at a bargaining table that fails to promote the safety and welfare of victims and their children.

The Rise And Spread Of Mandatory Arbitration As A Substitute For The Jury Trial, Jean R. Sternlight

University of San Francisco Law Review

THE CVILJURY trial is fast disappearing from our legal landscape, and one important reason for its disappearance is the rapid growth of mandatory arbitration. However, with few exceptions, lawyers, courts, and commentators have failed to adequately consider constitutional rights to a jury trial in determining the validity of arbitration clauses.

Retribution For Rats: Cooperation, Punishment, And Atonement, Michael A. Simons Jan 2003

Retribution For Rats: Cooperation, Punishment, And Atonement, Michael A. Simons

Faculty Publications

(Excerpt)

To mobsters, he is a "rat"; to drug dealers, a "snitch." To school children, he is a "tattletale"; to corporate executives, a "whistleblower." To cops, he is an "informant"; to prosecutors, a "cooperator." By whatever name he is known, the person who betrays his associates to the authorities is almost universally reviled. In movies, on television, in literature, the cooperator embodies all that society holds in contempt: he is disloyal, deceitful, greedy, selfish, and weak.

The cooperator, though, has long been a mainstay of our criminal justice system. For centuries, criminal defendants have received leniency in return for testimony …

Enforcement Of Wto Rulings: An Interest Group Analysis, Mark L. Movsesian

Faculty Publications

The WTO's Dispute Settlement Understanding ("DSU") provides that disputes are to be resolved in adversarial proceedings before impartial panels of experts. These panels have authority to decide whether members' laws conform to WTO requirements; members may appeal rulings to a permanent Appellate Body within the organization, which has the final say on questions of law and legal interpretation. Under the DSU, if a member fails to comply with a final ruling in a dispute, the prevailing party may retaliate by suspending trade concessions that it owes the offending member. This retaliation can continue until the offending member implements the WTO's …

Sovereignty - Modern: A New Approach To An Outdated Concept, John H. Jackson Jan 2003

Sovereignty - Modern: A New Approach To An Outdated Concept, John H. Jackson

Georgetown Law Faculty Publications and Other Works

This article, however, does not purport to cover all possible dimensions of sovereignty but, instead, focuses primarily on what might be thought of as the core of sovereignty - the "monopoly of power" dimension - although it will be clear that even this focus inevitably entails certain linkages and "slop-over penumbra" of the other sovereignty dimensions. This "core" dimension is examined in the context of its roles with respect to international law and institutions generally, and international relations and related disciplines such as economics. National government leaders and politicians, as well as special interest representatives, too often invoke the term …
