Executive Summary

A study of the macrobenthic communities of the Elizabeth River watershed was initiated in summer 1999. This report presents the data from the fourth year of sampling in 2002. The three objectives of the Benthic Biological Monitoring Program of the Elizabeth River watershed are: (1) To characterize the health of the tidal waters of the Elizabeth River watershed as indicated by the structure of the benthic communities. ( 2) To conduct trend analyses on long-term data at 14 fixed-point stations to relate temporal trends in the benthic communities to changes in water and/or sediment quality. Trend analyses will …

Decreasing Barriers For Teens: Evaluation Of A New Teenage Pregnancy Prevention Strategy In School-Based Clinics, Abbey C. Sidebottom, Amanda Birnbaum, Sarah S. Nafstad

Sidebottom et al seek to evaluate the effects of the change in distribution systems on students' receipt of requested contraceptives and demand for contraceptive school-based clinics (SBC). The result of the study reveals that the average number of requests per student was higher under the voucher system, possibly as a consequence of expires vouchers resulting in repeated requests. The findings also suggest that SBCs could go a step further in reducing adolescents' barriers to accessing contraceptives by adopting an on-site direct delivery system..

In July 2003, the School of Natural Resource Sciences was merged with the Conservation and Survey Division and the Water Center Nebraska State Survey. This merger produced the School of Natural Resources (hereafter referred to as the "School") in its current form. The University of Nebraska-Lincoln requested a ten-year review of the School's programs and activities. The review was administered by the Cooperative State Research, Education and Extension Service (CSREES) in cooperation with the University of Nebraska-Lincoln's Institute of Agriculture and Natural Resources, the College of Agriculture, and the School.

This paper examines the notion of empowerment and what it entails in housing development. Through a critical analysis if the different phases in one particular housing project analyzed by the author, the paper highlights the areas of empowerment and emphasizes that it is a process, which in the case of Nthutukoville in KwaZulu-Natal, South Africa began with securing land tenure. Access to resources and acquisition of skills are important. Both external and internal factors may be responsible for women’s inability to take charge of their lives. Has the Communist Party of China (CPC) fully liberated Chinese women? Is the leadership of the CPC the key to Chinese women’s liberation in the twenty-first century? The CPC has tried to convince the Chinese people and international society to believe that the answer is positive. Dynamic Modeling Of The Ssdi Application Timing Decision: The Importance Of Policy Variables, Rickard V. Burkhauser, J S. Butler, Gulcin Gumus

This paper analyzes the importance of policy variables in the context of Social Security Disability Insurance (SSDI) application timing decision. Previously, we explicitly modeled the optimal timing of SSDI application using dynamic structural models. We estimated these models using data from the Health and Retirement Study (HRS). This paper uses option value model estimates to simulate application timing under alternative SSDI policy formulations. We consider changes in three policy variables: benefit levels, acceptance rates, and employer accommodation. Our simulations suggest all these changes would have substantial effects on expected spell lengths until application and on lifetime application rates, and hence …

This Essay explores the concept of medical necessity as it has evolved in the judicial and administrative oversight of managed care. The goals of the Essay are to illustrate the range of plausible rationales for establishing administrative procedures to govern medical necessity disputes, and to demonstrate the difficulty of incorporating into those procedures the most important professional and social responsibilities of managed care in today’s health care system. The production rates and substructure of jets have been studied in charged current deep inelastic e+p scattering for Q2 > 200 GeV2 with the ZEUS detector at HERA using an integrated luminosity of 110.5 pb-1. Inclusive jet cross sections are presented for jets with transverse energies ETjet > 14 GeV and pseudorapidities in the range -1 < ηjet < 2. Dijet cross sections are presented for events with a jet having ETjet > 14 GeV and a second jet having ETjet > 5 GeV. Measurements of the mean subjet multiplicity, 〈ηsbj〉, of the inclusive jet sample are presented. Predictions based on parton-shower Monte Carlo models and next-to-leading-order QCD calculations are compared to the measurements. The value of αs (MZ), determined …

Despite the 15-year focus on transition planning, students with learning disabilities (LD) continue to experience less positive post-school outcomes than their peers without disabilities. Outcome data indicate that experiencing successful transitions from public schooling into the adult world seems to be a complex and elusive process. The 1997 amendments to the Individuals with Disabilities Act promote the development of inter-agency linkages between school personnel and community agencies in an effort to mobilize all available resources. In many cases, however, these linkages are not being made. This article provides information on available community agencies, the resources they offer, and ways school …

Coping With Cafos: How Much Notice Must A Citizen Give - Community Ass'n For Restoration Of The Environment V. Henry Bosma Dairy, Martin A. Miller

In the context of reviewing Community Ass’n for Restoration of the Environment v. Henry Bosma Dairy, this Note focuses on what constitutes sufficient notice and suggests how citizen groups should handle additional violations discovered after suit has been filed. Although the Ninth Circuit had previously taken a fairly strict approach in interpreting notice requirement, Bosma Dairy indicates a shift toward a more forgiving approach by allowing the plaintiff to include certain non-noticed violations in its lawsuit. This urges the continued movement away from a rigid and formalistic approach.

Personal jurisdiction standards outlined in International Shoe Co. v. Washington have proven to be inadequate. This Article begins in Part II with an examination of the origins of the International Shoe minimum contacts test, and then in Part III analyzes and critiques the opinion and the test. Part IV looks at later Supreme Court cases that attempt to refine and apply the test, and Part V looks at the same pattern for other federal courts and state courts. Class Actions And Ex Parte Communications: Can We Talk, Douglas R. Richmond

The subject of ex parte communications with class members is a murky one. Here the rules of civil procedure and professional responsibility overlap as in no other area, and case law is relatively scarce. Insofar as class actions are litigated in federal courts, another problem is that many of the decisions on this subject are district court decisions, which lack precedential force. In sum, lawyers’ need for guidance in this area is significant and seems destined to grow in importance as class action litigation continues to spread.
