Comment: Dna As Property: Implications On The Constitutionality Of Dna Dragnets, Jonathan Will

Journal Articles

This comment will argue that when the state seeks to deprive a person of his or her DNA, greater constitutional protections than are currently afforded dragnets must be provided. Part I will discuss the unique properties of DNA, the information contained therein and why it should be constitutionally protected. Part II will briefly trace the history of DNA dragnets, including the practical and procedural uses in worldwide criminal investigations. Part III will explore current law and commentary regarding Fourth Amendment privacy interests in one’s DNA. Part IV will argue that DNA constitutes personal property, and finally, Part V will show …

Reenchanting International Law, Mark C. Modak-Truran Jan 2003

Reenchanting International Law, Mark C. Modak-Truran

Journal Articles

I will argue that international law needs religion because it is indeterminate and that international law should not attempt to resolve legal indeterminancy because this would require establishing an official international religion. Given the limitations of this article, however, I will not attempt to provide a comprehensive normative and descriptive account of law and international law to support this claim." My more modest expectations are to provide a normative theory of law to justify the interpretation of international law in cases in which international law is indeterminate.

The Professional Obligation To Raise Frivolous Issues In Death Penalty Cases, Monroe H. Freedman Jan 2003

The Professional Obligation To Raise Frivolous Issues In Death Penalty Cases, Monroe H. Freedman

Hofstra Law Review

Lawyers are generally familiar with the ethical rule forbidding frivolous arguments, principally because of sanctions imposed under rules of civil procedure for making such arguments. Not all lawyers are aware, however, of two ways in which the prohibitions of frivolous arguments are restricted in both the rules themselves and in their enforcement. First, the ethical rules have express limitations with respect to arguments made on behalf of criminal defendants, and courts are generally loath to sanction criminal defense lawyers. Second, the term "frivolous" is narrowed, even in civil cases, by the way it is defined and explained in the ethical …

Associations Of Knee Angles, Moments And Function Among Subjects That Are Healthy And Anterior Cruciate Ligament Deficient (Acld) During Straight Ahead And Crossover Cutting Activities, Jeff Houck, H. John Yack

Faculty Publications - College of Physical Therapy

The objective of this study was to compare knee angles and moments of healthy subjects (n/20) and subjects that were anterior cruciate ligament deficient (ACLD) (n/16) during stepping and crossover cutting activities. Subjects that were ACLD were separated into high (n/7) and low (n/9) functioning groups based on knee functioning ratings. Knee angles and moments were estimated using three dimensional motion tracking and force plate data. The results suggest that knee angle and moment data were associated with level of functioning of ACLD subjects. Primarily knee frontal and transverse plane moments distinguished the stepping and crossover cut activities. Only some …

Block, Roberts, and Clarke offer a method for comparing ten labor standards across political jurisdictions. The Antitrust Implications Of Collaborative Standard Setting By Insurers Regarding The Use Of Genetic Information In Life Insurance Underwriting, Robert H. Jerry Ii

UF Law Faculty Publications

Whenever two or more market participants collaborate to restrain trade, the potential applicability of federal and state antitrust laws must be considered. When the collaborating parties are insurance companies, a further layer of analysis may be necessary to determine whether the activity is exempt from federal antitrust regulation. Even if the activity enjoys an exemption, state antitrust law may have different things to say about the activity. Embedded in each of these levels of analysis are many difficult and complex subsidiary questions. In short, the law of insurance antitrust is not a subject for the faint of heart.

Antitrust law …

Market Based Approaches To Environmental Preservation: To Environmental Mitigation Fees And Beyond, James C. Nicholas, Julian C. Juergensmeyer

Faculty Publications By Year

Impact fees are widely accepted and utilized across the United States as a technique to generate revenue for capital infrastructure improvements necessitated by new development. This article looks at the origination of impact fees, their legal framework, the extension of the concept towards environmental protection, and an alternative economic approach in environmental protection, “market based regulation.” Based upon techniques utilized primarily in the arenas of wetlands and air quality regulation, a concept of utilizing economic incentives for broader environmental protection is explored. Considerations of the legal framework evolved through impacts fees are then applied to possible implementation aspects of the …

Exception Becomes The Rule: The Missouri Supreme Court Expands Th Continuing Care Exception - Montgomery V. South County Radiologists, Inc., The, James B. York

Missouri Law Review

This Note addresses the importance of the Missouri Supreme Court’s decision in Montgomery v. South County Radiologists, Inc., and its future effect on the continuing care exception and its development throughout Missouri jurisprudence. This Note then reviews the majority’s decision in Montgomery and argues that the Missouri Supreme Court inappropriately extended the scope of the exception. Finally, this Note suggest that the interpretation of the continuing care exception used by the majority in Montgomery offers no guidance for providers of auxiliary medical services, which will result in an overall increase in the cost of health care and result in the …

Development And Validation Of Transtheorectical Measure For College Student Spiritual Expression, John A. Ward Jan 2003

Development And Validation Of Transtheorectical Measure For College Student Spiritual Expression, John A. Ward

Open Access Dissertations

The study of the use of religious techniques in counseling and religious/spiritual expression has gained increased attention in research literature over the last 15-20 years. Psychologists are becoming increasingly accepting of the role of religious techniques in counseling and the role of religious/spiritual expression in human development. However, most agree that the research base needs to be more inclusive and expanded. When religion is the focus of investigation in college student populations, most attention is focused on religious beliefs and practices, and changes in beliefs over the course of the college experience.

The transtheoretical model (TTM) is an integrative model …

Latent Transition Ananlysis As A Sensitive Outcome: Analysis For Longitudinal Data, Rosemarie A. Martin

Open Access Dissertations

Three secondary data analysis studies were conducted to provide methodological and theoretical examples of the application of Latent Transition Analysis (LTA) to three studies of smoking cessation among adults. Each study was designed to evaluate an interactive expert system intervention for smoking cessation in three different populations of smokers: (1) Chapter 2 evaluated the expert system intervention versus assessment only in smokers from the state of Rhode Island (N=4,144); (2) Chapter 3 evaluated the expert system intervention versus a non-interactive manual-based intervention in a managed care setting (N=2,882); (3) and Chapter 4 examined the expert system intervention versus assessment only …

Western Australia has a long tradition of supplying countries of the Middle East with high quality foodstuffs and in implementing agricultural development projects. The Middle East is one of Western Australia's key trading partners, consuming an annual food production valued in excess of $1 billion. In recent times, …
