A Social Contract Between Students And The State: A Constitutional Analysis Of Florida Statutes Related To Mandatory Expulsion For Weapon Possession, Corporal Punishment And The Use Of Metal Detectors On Campus, Loula D. Giannet

St. Thomas Law Review

This article analyzes the constitutionality of various Florida statutes as they may be applied to curtail acts of violence on school grounds. Analyzed from a social contract theoretical perspective, the article first examines whether Florida's zero-tolerance policy regarding weapon possession in schools, which requires mandatory expulsion, comports with the Due Process Clause. Second, the article evaluates the relevant statutes pertaining to corporal punishment and the due process implications of this sanction. Third, the article explores the constitutional issues associated with the use of metal detectors on campus. Finally, the article briefly discusses whether the Double Jeopardy Clause precludes a subsequent …

Human Capabilities And Human Authorities: A Comment On Martha Nussbaum's Women And Human Development, Robin West

St. Thomas Law Review

In these comments, I want to fill in that gap. I will highlight and then amplify what I think is missing or underplayed in Nussbaum's treatment of capabilities and women, and that is the role that authority plays-and the role it should and should not play-in guiding states toward a recognition of their obligation to nurture, promote, or protect women's-and men's and children's-human capabilities.

Semblances Of Sovereignty: The Constitution, The State, And American Citizenship, T. Alexander Aleinikoff, Harvard University Press, 2002. Pp. 223, Harvey Gee

St. Thomas Law Review

A major contribution to the contemporary thinking about immigration, citizenship, and assimilation is offered by Georgetown Law Center Law Professor T. Alexander Aleinikoff in his recent volume, Semblances of Sovereignty: The Constitution, the State, and American Citizenship. The book helps to advance the immigration debate and define what it means to be an American. Aleinikoff paints with broad theoretical strokes with academics in mind. Relying on theory, he asks readers to consider how the court has treated the issue of "citizenship" and how it has defined its boundaries and limitations. He also addresses the reasons why traditional notions of immigrant …

Prenatal Tort Law And The Personhood Of The Unborn Child: A Separate Legal Existence, Gregory J. Roden Jan 2003

Prenatal Tort Law And The Personhood Of The Unborn Child: A Separate Legal Existence, Gregory J. Roden

St. Thomas Law Review

This article will examine the state of prenatal tort and wrongful death law at the time the Supreme Court decided Roe v. Wade and compare such examination to Justice Blackmun's assessment of it in his Roe opinion. Justice Blackmun's opinion in Roe v. Wade briefly takes up the area of prenatal tort law wherein he discusses some of the (allegedly) inchoate rights of the unborn: In areas other than criminal abortion, the law has been reluctant to endorse any theory that life, as we recognize it, begins before life birth or to accord legal rights to the unborn except in …

Ethnic Studies Review

In its larger contexts the topic of this issue of Ethnic Studies Review, "Fair Access," has many referents. In 2004 we are marking the fiftieth anniversary of Brown v Board of Education which stated unequivocally that separate but equal systems of education did not and could not exist, and yet equal education for all our children still does not exist. Recent reports detail that in many urban areas school systems are at least as segregated as prior to the Brown decision, and all levels of government seem satisfied with that status quo. We watch with astonishment as over six hundred …

Centering Race And Ethnicity- Related Issues In Social Sciences Curricula, Joseph F. Sheley Jan 2003

Centering Race And Ethnicity- Related Issues In Social Sciences Curricula, Joseph F. Sheley

Ethnic Studies Review

A 2002 review of the course requirements and electives of Economics, History, Political Science, and Sociology programs in thirty randomly selected state and private, "doctoral-level" and "masters-level" institutions produced 201 courses relating to the study of race-and ethnic-related issues. Only two courses (History offerings on a single campus) were required for completion of a major. While some departments offered "concentrations" with mandated content, the concentrations themselves were elective. Diversity in America today is a truly important component of social (re)organization and change and, thus, a major source of social friction. Why is it, then, that students, those majoring in the …

From Household Bathrooms To The Workplace: Bringing The Americans With Disabilities Act Back To Where It Belongs: An Analysis Of Toyota Motor Manufacturing V. Williams, Argun M. Ulgen Jan 2003

From Household Bathrooms To The Workplace: Bringing The Americans With Disabilities Act Back To Where It Belongs: An Analysis Of Toyota Motor Manufacturing V. Williams, Argun M. Ulgen

Fordham Urban Law Journal

The purpose of this Comment is to analyze how the Supreme Court's treatment of the ADA in Toyota Motor Manufacturing deviated from the economic goals that Congress targeted when it passed the ADA, and argue that plaintiffs such as Ella Williams are exactly whom Congress had in mind when enacting the ADA. In accordance with Congress's intent under Title I of the ADA, "to provide clear, strong, consistent, and enforcable standards addressing discrimination against individuals," this Comment then attempts to establish a clearer, more formal definition of disability, centered on Congress's remedial economic purposes in enacting the ADA. Part I …

Due Process And Problem Solving Courts, Eric Lane Jan 2003

Due Process And Problem Solving Courts, Eric Lane

Fordham Urban Law Journal

This article addresses the model of the problem-solving courts, beginning with the 1989 Dade County, Florida drug court and the role of the pro-active problem solving judge as presented by Judge Lederman of the Dade County drug court. The article reviews the role of the pro-active problem-solving judge in light of the defendants due process rights. After reviewing several case studies, transcripts, and literature on the issue, the article concludes that problem-solving judging and lawyering need not be in conflict with due process standards.

Theorizing Community Justice Through Community Courts, Jeffrey Fagan, Victoria Malkin

Fordham Urban Law Journal

This article reports on research conducted on the Red Hook Community Justice Center in Brooklyn, New York. It theorizes the structure and process of community justice, focusing on the model offered by community courts and examining how the Red Hook Community Justice Center's development and implementation are products of its immersion in the intersection of societal, spatial, and political dynamic within the Red Hook neighborhood. The article begins by reviewing the sociological perspectives that converge in the historical development of "community justice." It continues by setting forth a framework of social regulation and control that shapes the internal workings of …

The International Significance Of An Instance Of Urban Environmental Inequity In Tijauna, Mexico , Tseming Yang Jan 2003

The International Significance Of An Instance Of Urban Environmental Inequity In Tijauna, Mexico , Tseming Yang

Fordham Urban Law Journal

Environmental equity problems are not exclusive to any one nation. With a lack of regulations, communities of color and poor, and the prevalence of social marginalization, issues of environmental inequality may occur even more vividly in countries with this climate. In Tijuana, Mexico, Metales y Derivados, an abandoned lead smelter, left its surrounding community, Colonia Cilpancingo, with a litany of health related issues and a hunt for justice from its failure to act with appropriate environmental stewardship. Having gained attention in the international news and exposing a failure of regulatory policies and transnational exploitation, Metales is an example of the …

Heterogeneous Photocatalytic Reduction Of Ferrate(Vi) In Uv-Irradiated Titania Suspensions: Role In Enhancing Destruction Of Nitrogen-Containing Pollutants, Virender K. Sharma, Kurt Winkelmann, Yekaterina Krasnova, Changyoul Lee, Mary Sohn Jan 2003

Heterogeneous Photocatalytic Reduction Of Ferrate(Vi) In Uv-Irradiated Titania Suspensions: Role In Enhancing Destruction Of Nitrogen-Containing Pollutants, Virender K. Sharma, Kurt Winkelmann, Yekaterina Krasnova, Changyoul Lee, Mary Sohn

Chemistry and Chemical Engineering Faculty Publications

The results of the heterogeneous photocatalytic reduction of Fe(VI) in UV-irradiated TiO2 suspensions are presented and suggest indirect observation of the formation of Fe(V) by the photoreduction of Fe(VI) with ecb- at TiO2 surfaces. Because Fe(V) selectively and rapidly oxidizes low reactivity pollutants with the production of the non-toxic by-product, Fe(III), the photocatalytic reduction of Fe(VI) has a role in pollution remediation processes. The experiments were conducted as a function of TiO2 suspension concentrations, Fe(VI) concentrations, and pH in basic media. The initial rate of Fe(VI) reduction gave a fractional order with respect to initial Fe(VI) concentrations and adheres to …

A Comparative Analysis Of Design Techniques For The Construction Of An Expert System For Aircraft Engine Diagnostics, Mitch Raton Jan 2003

A Comparative Analysis Of Design Techniques For The Construction Of An Expert System For Aircraft Engine Diagnostics, Mitch Raton

CCAC Theses and Dissertations

The lack of knowledge and understanding of diagnostic aircraft propulsion systems causes inappropriate problem diagnosis. Because of increasing complexity, technicians are incapable of performing the necessary tasks in accordance with standard regulations. More sophisticated systems are needed today to "assist" the user technician in decision-making. This work provided a study of rule-based and frame-based expert system techniques to determine the most appropriate solution in the domain of complex diagnosis using large amounts of deterministic data. The study produced a framework that facilitates the diagnosing of faults on aircraft engines, thus reducing the burden on the aircraft mechanic regardless of experience …

"What Was I Created For, I Wonder?" : Occupation For Women In Shirley And Cranford, Julie Anne Tignor Jan 2003

"What Was I Created For, I Wonder?" : Occupation For Women In Shirley And Cranford, Julie Anne Tignor

Master's Theses

Charlotte Brontë's Shirley and Elizabeth Gaskell's Cranford unite in asking and answering the question of what unmarried women were supposed to do with their time and talents in Victorian England, considering the constraints of both gentility and economic conditions. In writing these novels, Brontë and Gaskell joined mid-nineteenth century feminists such as Francis Power Cobbe and Florence Nightingale in discussing women's occupation. Cranford, rather than presenting the typical young unmarried woman as its heroine, features a community of old maids as its "heroines," revealing their story through the narration of Mary Smith. Shirley's Caroline Helstone examines the socially accepted …

An Integrated, Secured, Open-Source Medical Prototype For Collaborative Patient Management On The Internet, Joseph Dabre Ramsey Jan 2003

An Integrated, Secured, Open-Source Medical Prototype For Collaborative Patient Management On The Internet, Joseph Dabre Ramsey

CCAC Theses and Dissertations

Conventional approaches to building critical and secured systems are based on the use of commercial tools for development and maintenance. Changes in the marketplace and the acceptance of the open-source model have brought this assumption into question. The combination of open-source's rapid rise and the introduction of pervasive computing has made the computing industry more receptive to open-source tools and products. The open-source model allows systems to be controlled by a single individual or a small developer group that reduces dependence on individual experts. The availability of free system source codes, an expanding commercial support market, and increasing global collaborative …
