Labor Disputes In Contract Law: The Past And Present Of Alaska Packers’ Ass’N V. Domenico, Debora L. Threedy Oct 2003

Labor Disputes In Contract Law: The Past And Present Of Alaska Packers’ Ass’N V. Domenico, Debora L. Threedy

Texas Wesleyan Law Review

In Part II, I will give a brief recapitulation of the facts and background of Alaska Packers' as revealed by my digging into the case. In Part III, I will briefly discuss the doctrinal evolution of duress and the pre-existing duty rule before and after Alaska Packers' and conclude that this evolution complicates, but does not negate, Professor Snyder's insight into the "pernicious effect" of labor disputes on the development of contract doctrine. Finally, in Part IV, I will point out the continuing relevance of the case to the intersection of labor and contracts, and suggest that a hundred years …

The Validity Of A Restraint Of Trade Clause In South Africa As A Contractual Term In An Employment Contract, Marlize Van Jaarsveld Oct 2003

The Validity Of A Restraint Of Trade Clause In South Africa As A Contractual Term In An Employment Contract, Marlize Van Jaarsveld

Texas Wesleyan Law Review

What follows is a reflection on the history and the validity of restraint of trade clauses as contractual terms in South African employment contracts. The Article is divided into seven parts. Part I deals with the general meaning of restraint of trade clauses and the reasons for including these clauses in employment contracts. This is followed by a discussion of the then-uncertain status of restraint of trade clauses in South African employment contracts until 1984, when the status of restraint clauses in contracts was finally addressed. In Part III, the consequences of the Appeal Court's 1984 groundbreaking decision in Magna …

A Multi-Perspective Class Project At Oral Roberts University, Andrew Lang, Aimee Raile, Joy Thrall

College of Science and Engineering Faculty Research and Scholarship

In 2001, Oral Roberts University launched an honors program. Unlike most honors programs, the ORU program is two-tiered, meaning that the top sixteen to eighteen students in every class are considered fellows and the rest of the students who meet the academic requirements are scholars. ORU requires both fellows and scholars to complete twenty-four hours of honors coursework through designated sections of general education classes. One unique aspect of the program is that the fellows are required to complete five of six special interdisciplinary honors seminars as part of their required twenty-four hours. These classes replace traditional general education courses …

What Are You Thinking.... Allowing Publics To Engage The Surfaces Of The City, Matthew 'Mick' Mcnutt

Architecture Thesis Prep

"How can architecture build urban environments that allow for public participation in and control over the space of the city?
