Federal Court Authority To Regulate Lawyers: A Practice In Search Of A Theory Of A, Fred C. Zacharias, Bruce A. Green Oct 2003

Federal Court Authority To Regulate Lawyers: A Practice In Search Of A Theory Of A, Fred C. Zacharias, Bruce A. Green

Vanderbilt Law Review

Federal courts regulate lawyers, including federal prosecutors, by enforcing various constitutional, statutory, and other legal constraints. Federal courts also adopt and enforce their own disciplinary rules pursuant to rule-making authority delegated by Congress. To what extent, however, do federal courts have independent power, in the absence of an explicit grant of authority, to regulate private lawyers and federal prosecutors? Although lower federal courts have long exercised power both to define and to sanction professional misconduct, the United States Supreme Court has never clarified the source and scope of this authority.

This issue is important for two reasons. First, most federal …

How Reading Recovery Teaches The Five Essential Elements Of Reading Instruction And More, Mary Anne Doyle, Salli Forbes

Curriculum & Instruction Faculty Publications

In 1997 Congress called for the director of the National Institute of Child Health and Human Development (NICHD), in consultation with the Secretary of Education, to convene a national panel to assess the status of research-based knowledge, including the effectiveness of various approaches to teaching children to read (NICHD, 2000a, p. 1). The resulting 14- member National Reading Panel (NRP or Panel) included reading researchers, representatives of colleges of education, educational administrators, a classroom teacher, a parent, and a medical doctor (Yatvin, 2002). The work completed by the NRP involved identification and meta-analyses of the experimental and quasi-experimental research literature …

Effective And Efficient Regulation In Nova Scotia, J Marshall Burgess Oct 2003

Effective And Efficient Regulation In Nova Scotia, J Marshall Burgess

Dalhousie Law Journal

Effective and efficient regulation of the oil and gas industry on the East Coast of Canada is a top priority of the federal and provincial governments. Ever since oil and gas exploration and development began in this region, stakeholders and others have urged regulators to address and remedy this issue. This paper reviews how governments have responded first in the onshore context, and then in the offshore. Issues that regulators need to address are identified and legislative, regulatory, and administrative changes which have been made and are proposed are reviewed. Finally, the author reflects on possible future developments and the …

Effective And Efficient Regulation Of The Offshore Oil Industry: The 2001 White Rose Public Review Process, Peter O'Flaherty, Matthew Clarke

Dalhousie Law Journal

Section 44(2)(b) of the provincial and federal Canada-Newfoundland Atlantic Accord Implementation Acts provides for a public review of proposed developments of petroleum resources as part of the existing regulatory approval process for the Newfoundland Offshore Area. To date, public reviews have been conducted for three offshore oil developments: Hibernia, Terra Nova and White Rose. This paper examines the effectiveness and efficiency of the public review process for the White Rose Project. The author concludes that the review process was effective in successfully gathering public input and reporting this information to the CNOPB. Despite CNOPB's failure to accept many of the …

Provincial Entitlement To Gas Trunk Line Ownership - Enforceability And Constitutionality, Dufferin Harper Oct 2003

Provincial Entitlement To Gas Trunk Line Ownership - Enforceability And Constitutionality, Dufferin Harper

Dalhousie Law Journal

The author discusses the interpretation of section 40 of the Nova Scotia Accord Act (Canada) and the Nova Scotia Accord Act (Nova Scotia). The section provides that the Government of Nova Scotia be given "a reasonable opportunity" to acquire on a "commercial basis" up to a fifty percent ownership in the Nova Scotia trunkine in certain circumstances. He points out that even though the dispute between the Federal and Provincial governments regarding the ownership of the offshore appears to be on hold, the issue is relevant to the application of section 40.

Walking The Centre Line: Balancing An Employee's Right To Privacy In Drug And Alcohol Policies In The Atlantic Offshore Oil Industry, Harold Smith, Joseph Anthony Oct 2003

Walking The Centre Line: Balancing An Employee's Right To Privacy In Drug And Alcohol Policies In The Atlantic Offshore Oil Industry, Harold Smith, Joseph Anthony

Dalhousie Law Journal

Should the principles applied to drug and alcohol testing on land be imported into the Atlantic offshore oil and gas industry? The authors take the position that there is room for the notion that the application of principles derived from safety sensitive land based industry ought not to be applied in a perfunctory or rote manner to the Atlantic offshore environment. The case law, since Entrop, shows a judicial tendency to apply the requirements established by the obiter dictum of Entrop. (Etrop dealt with safety sensitive but land-based industry.) The danger is that the principles, as developed by and since …

Implementation Of Steel Bridge Protection Policy, Luh M. Chang, Po-Han Chen, Sangwook Lee

JTRP Technical Reports

Many Departments of Transportation (DOTs) have made tremendous efforts for managing their civil infrastructure systems effectively and to meet public demands for their performance and safety. The introduction of warranties help many DOTs keep their construction with better quality by shifting post-construction responsibilities to contractors. Warranties are applied to numerous items according to each DOT’s needs, and this research focuses on steel bridge painting protection policy for Indiana Department of Transportation (INDOT). This research represents the development of an implementable warranty clause for protecting steel bridge painting and the image processing technique for the objective and quantitative painting quality assessment. …

"What Good Are They Anyway?": A User Looks At Documentary Editions Of Statesmen's Papers, Daniel Feller

Documentary Editing: Journal of the Association for Documentary Editing (1979–2011)

Historical editing has come far in recent years. Editors now have their own organization; they have an ever-stricter set of standards and, as of this year, a handbook codifying those standards. What was once an avocation has become a profession. Yet one cannot overlook that documentary editions have failed to meet some of the expectations first held out for them. The "bloodless revolution in American history" promised us a quarter-century ago from the publication of great statesmen's papers has so far proved not only bloodless but undetectable. Ironically, just as that revolution was being proclaimed, a very different-and far from …

0.18 Μm Cmos Low Power Standard Cell Library, Suryadi Gunawan Oct 2003

0.18 Μm Cmos Low Power Standard Cell Library, Suryadi Gunawan

Theses

With the increasing number of transistors in a single integrated circuit, power is becoming one of the major issues in integrated circuit development. This issue requires additional effort from designers in order to produce lower power designs. The purpose of this thesis is to develop a standard cell library using Taiwan Semiconductor Manufacturing Company's 0.18-micron CMOS technology. The library cells consume less power compared to the vendor library provided by MOSIS. Although a reduction in power consumption is the main objective in this cell library, the timing delay and area are two aspects that cannot be ignored. However, a sacrifice …

Evaluation Of Methods To Protect Water Quality In Karst Areas: Phase I, Jennifer Webster, Dhandayudhapani Ramalingam, Sudhir Palle Oct 2003

Evaluation Of Methods To Protect Water Quality In Karst Areas: Phase I, Jennifer Webster, Dhandayudhapani Ramalingam, Sudhir Palle

Kentucky Transportation Center Research Report

The primary focus of this report is two-fold; to provide a literature review on what has been previously learned about highway runoff in relation to karsts aquifers and to characterize a karsts highway site in Kentucky that can be used to evaluate a variety of best management practices. From research findings, the main sources of pollutants in highway runoff came from vehicles, atmospheric fallout, and precipitation. The behavior of pollutants and their interaction with the environment can dictate where they will be found and how to best minimize their effects. Although it would seem that traffic volumes would greatly influence …

Also investigated was the relationship between corporal punishment and certain affective and personality variables. The Conflict Tactics Scale CTSPC-CA was utilized to measure the level of corporal punishment experienced by all 274 participants. However, only those respondents with the 75 highest and 75 lowest corporal punishment scores were compared in statistical analyses. Results indicated a significant difference between the higher and lower corporal punishment groups on the variables …

Lbj's Ghost: A Contextual Approach To Targeting Decisions And The Commander In Chief, James E. Baker Oct 2003

Lbj's Ghost: A Contextual Approach To Targeting Decisions And The Commander In Chief, James E. Baker

Georgetown Law Faculty Publications and Other Works

The moral imperative and relevance of the Law of Armed Conflict (“LOAC”) is more apparent today than before September 11, 2001. Law distinguishes democratic societies from the terrorists who attack them; nowhere is this more apparent than in the methods and means of warfare. Indeed, part of our revulsion and contempt for terrorism lies in the terrorists' indiscriminate, disproportionate, and unnecessary violence against civilians. In contrast, the enduring strength of the LOAC is its reliance on the principles of proportionality, necessity, and discrimination, which protect civilians and minimize combatant suffering. For these reasons, we should not begrudge the LOAC's limitations …

The Law And Economics Of Disability Accommodations, Michael Ashley Stein Oct 2003

The Law And Economics Of Disability Accommodations, Michael Ashley Stein

Duke Law Journal

The Americans with Disabilities Act provides a clear mandate that disabled workers be provided with "reasonable" accommodations, but does not meaningfully articulate the standards by which reasonableness ought to be measured. Until now, neither courts nor commentators have provided a systematic model for analyzing accommodation claims. This Article articulates an initial law and economics framework for analyzing disability-related accommodations. In doing so, it demonstrates how accommodations span a cost continuum that can be divided into areas of Wholly Efficient and Semi-Efficient Accommodations to be funded by private employers, Social Benefit Gain Efficient Accommodations where the costs should be borne by …

Making The Key Agreement Protocol In Mobile Ad Hoc Network More Efficient, Gang Yao, Kui Ren, Feng Bao, Robert H. Deng, Dengguo Feng Oct 2003

Making The Key Agreement Protocol In Mobile Ad Hoc Network More Efficient, Gang Yao, Kui Ren, Feng Bao, Robert H. Deng, Dengguo Feng

Research Collection School Of Computing and Information Systems

Mobile ad hoc networks offer convenient infrastructureless communications over the shared wireless channel. However, the nature of mobile ad hoc networks makes them vulnerable to security attacks, such as passive eavesdropping over the wireless channel and denial of service attacks by malicious nodes. To ensure the security, several cryptography protocols are implemented. Due to the resource scarcity in mobile ad hoc networks, the protocols must be communication efficient and need as less computational power as possible. Broadcast communication is an important operation for many application in mobile ad hoc networks. To securely broadcast a message, all the members in the …

Adaptive Collusion Attack To A Block Oriented Watermarking Scheme, Yongdong Wu, Robert H. Deng Oct 2003

Adaptive Collusion Attack To A Block Oriented Watermarking Scheme, Yongdong Wu, Robert H. Deng

Research Collection School Of Computing and Information Systems

In this paper, we propose an adaptive collusion attack to a block oriented watermarking scheme [1]. In this attack, traitors conspire to selectively manipulate watermarked blocks to remove the watermark information. To this end, the traitors compare the watermarked blocks generated from the same original block. If two watermarked block are not equal, they average these two blocks to generate a pirated block. Then, replace the watermarked blocks with the pirated blocks so as to build a pirated image. The pirated image has no watermark but has much higher quality than watermarked images. We also give a theoretical analysis on …

An Efficient Public-Key Framework, Jianying Zhou, Feng Bao, Robert H. Deng Oct 2003

An Efficient Public-Key Framework, Jianying Zhou, Feng Bao, Robert H. Deng

Research Collection School Of Computing and Information Systems

Public-key certificates play an important role in binding the public key with the identity of the owner of the corresponding private key. A certificate might be revoked before its scheduled expiry date by the issuing CA. Efficient and timely distribution of certificate revocation information is a big challenge facing the PKI providers. Existing certificate revocation schemes place a considerable processing, communication, and storage overheads on the CA as well as the relying parties. To improve the current situation, we propose a revocation-free public-key framework, in which the maximum lifetime of a certificate is divided into short periods and the certificate …
