Biological Sciences Faculty Publications

Chemical analysis (high-performance liquid chromatography) and bioassay demonstrated the presence of compounds that seem to be components of the Ixodes scapularis arrestment pheromone. Only two purines, guanine and xanthine, were found in acidified saline extracts made from cast skins after molting of fed nymphs, fed larvae, and fecal/excretory exudates deposited by unfed adults on substrates in their environment. The ratio of guanine to xanthine was 10.6:1 in an extract from the nymphal skins versus 0.95:1 in an extract from the larval skins. Guanine, xanthine, and traces of a third purine, tentatively identified as 8-azaguanine, were found in extracts made from …

Ethical Issues In Open Source Software, Frances Grodzinsky, Keith W. Miller, Marty J. Wolf Jan 2003

Ethical Issues In Open Source Software, Frances Grodzinsky, Keith W. Miller, Marty J. Wolf

School of Computer Science & Engineering Faculty Publications

In this essay we argue that the current social and ethical structure in the Open Source Software (OSS) Community stem from its roots in academia. The individual developers experience a level of autonomy similar to that of a faculty member. Furthermore, we assert that the Open Source Software Community's social structure demands benevolent leadership. We argue that it is difficult to pass off low quality open source software as high quality software and that the Open Source development model offers strong accountability. Finally, we argue that Open Source Software introduces ethical challenges for universities and the software development community.

From Intrapreneurship To Entrepreneurship: Is Technical Expertise Sufficient?— A Case Study, John Woodilla Jan 2003

From Intrapreneurship To Entrepreneurship: Is Technical Expertise Sufficient?— A Case Study, John Woodilla

New England Journal of Entrepreneurship

Following a successful career in industry, Dr. Douglas V. Shick, a newly minted entrepreneur, established NRS Associates, LLC, to perform consulting services based on two highly technical computer-modeling programs. Doug was heavily involved in the development of one program, an innovative computer simulation software for modeling a particular manufacturing process, through intrapreneurial activity during his corporate experience. Doug established his business on September 1, 2001, and on September 10 announced his services by e-mail to everyone he knew. The unforeseen events of the next day, September 11, produced some unexpected aftereffects that Doug had to factor into his developing business.

Monetary-Policy Targeting In The Central European Transition Economies, Lucjan T. Orlowski Jan 2003

Monetary-Policy Targeting In The Central European Transition Economies, Lucjan T. Orlowski

WCBT Faculty Publications

This chapter examines the monetary-policy-targeting systems, in the second half of the 1990s (until 1998), of three Central European EU-accession candidates—the Czech Republic, Hungary, and Poland--and advocates the potential benefits of applying a direct-inflation-targeting (DIT) system in them. For the purpose of the analysis presented here, DIT is defined as "a monetary policy framework that is based on the assumption of long-term price stability as the official policy goal and on the designation of the official inflation forecast as intermediate policy target" (Orlowski, 2000). Section 1 is a brief overview of monetary-targeting practices in the Czech Republic Hungary, and Poland. …

Zhou Documents

This critical essay was written by artist and critic Kai-Jun Gu for Xin Cang. Through Xin Cang's innate "shamanic temperament" as the starting point, and connected to his Manchu heritage and Buddhist family background, the essay maps his art practice as two phases and one hidden thread. In the early phase, represented by the Trampling on the Face and Communication series, the body becomes a sign of "social therapy." In the later phase, represented by Identity Exchange and Unity of Heaven and Man, the body shifts from a "social body" to a "body of the world" that resonates with the …

Texas Annual Survey: Securities Regulation, George Lee Flint Jr Jan 2003

Texas Annual Survey: Securities Regulation, George Lee Flint Jr

Faculty Articles

The Texas Legislature passed Sunset Legislation that distinguished between securities dealers and investment advisors that allowed the Texas Securities Act (“TSA”) to comply with national trends in securities regulation. The court struggled with definitions of “control person” and “evidence of indebtedness.” However, the Sunset Legislation allowed the expanded Board to submit emergency cease and desist orders and to conduct surprise inspections of registered dealers and sellers of securities. Violation of a cease and desist order became a criminal offense.

The Sarbanes-Oxley Act increased the existing statute of limitations under the federal securities laws for private causes of action involving claims …

“Absolute And Perfect Candor” To Clients, Vincent R. Johnson Jan 2003

“Absolute And Perfect Candor” To Clients, Vincent R. Johnson

Faculty Articles

The fiduciary duty owed to clients by attorneys is defined by the reasonable-care standard of negligence as opposed to the all-encompassing “absolute and perfect candor” rhetoric frequently used to describe the duty owed. Words have meanings and, though the use of “absolute and perfect candor” serves a beneficial purpose, reminding attorneys of the special duty owed to their clients, the fiduciary duty owed to clients is not so all encompassing and impractical.

Modern case law fails to establish that a broadly applicable duty of “absolute and perfect” candor applies to the attorney-client relationship, except in a limited number of situations. …

Using “Hi-Tech” Tools In A Traditional Classroom Environment — A Two Semester Experiment, Robert E. Oliphant

Richmond Journal of Law & Technology

The most amazing thing is that we are all using computers, learning, and trying but the majority of us are not computer geeks. We are a group that is willing to learn and help. Whether we like it or not, technology has become an integral part of our lives and affects virtually every aspect of the legal profession — from the solo practitioner in northern Minnesota to the partner in a 400-person Wall Street firm. Technology has transformed how lawyers communicate, manage files, present cases to juries, and handle their professional and personal activities. It has been warmly received by …

Towards A Theory Of Cyberplace: A Proposal For A New Legal Framework, Ronnie Cohen, Janine S. Hiller Jan 2003

Towards A Theory Of Cyberplace: A Proposal For A New Legal Framework, Ronnie Cohen, Janine S. Hiller

Richmond Journal of Law & Technology

This article discusses whether the existing legal framework for property and places should apply to the electronic medium, or whether the uniqueness of the Internet requires a different characterization. The source of the right of the owner of an Internet site to legally control access to and use of the site and its content is the tort law of trespass and the law of contract. The sources of the right of users to freely access and use Internet content are the policies of free speech and public accommodation. Part I of this paper reviews the common law trespass theories that …

Regulating Genetically Modified Foods: Is Mandatory Labeling The Right Answer?, Jonathan Adler Jan 2003

Regulating Genetically Modified Foods: Is Mandatory Labeling The Right Answer?, Jonathan Adler

Richmond Journal of Law & Technology

Thank you. It’s a pleasure to be here, and I appreciate the invitation. What I want to talk about are some legal issues relating to labeling and, in particular, constitutional issues relating to mandatory labeling for genetically modified foods or food products that may contain genetically modified components. This is a separate issue from whether or not the FDA, or some other agency, has sufficient statutory authority at present to mandate labeling, and that is something worth discussing. Even if they do have such authority, or even if Congress tomorrow were to give the FDA such authority or were to …

The Principal's Role In Promoting Success For Culturally And Linguistically Diverse Students: A Participatory Research Study, Maria Norma Martinez

Doctoral Dissertations

We need to understand more fully what facilitates success in schools with diverse populations. Through participatory research, the voices of school principals who are responsive to the needs of culturally and linguistically diverse students were recorded and analyzed to provide insights on the practices that promote the school success of culturally and linguistically diverse students. Using a dialogic retrospective, the participants had the opportunity to engage, individually and collectively, in reflection and dialogue to identify common themes that emerged in their important work as school leaders and as advocates for diverse students.

A Case For Changing The National Airspace System From A Magnetic North To A Geographic North Based Model, Michael K. Larson Jan 2003

A Case For Changing The National Airspace System From A Magnetic North To A Geographic North Based Model, Michael K. Larson

Journal of Aviation/Aerospace Education & Research

The Global Positioning System (GPS) is currently playing a major role in aviation navigation and is proposed by the Federal Aviation Administration (FAA) to be the foundation of the future National Airspace System (NAS). The Position, Velocity and Time (PVT) information provided by GPS for navigation purposes is directly based on Geographic North parameters rather than on Magnetic North, which is currently the foundation of the NAS. This paper uniquely addresses the exploration of this relationship between the GPS and Geographic North by applying an experimental research design to analyze the potential benefit of basing the NAS on Geographic North. …
