The Creativity Of The Common-Law Judge: The Jurisprudence Of William Mitchell, Charles J. Reid Jr.

William Mitchell Law Review

Mitchell's presence graced the Minnesota Supreme Court for nearly nineteen years, from 1881 to 1900. His output was prodigious. He produced nearly 1600 judicial opinions. It has been estimated “that excluding Sundays, and allowing a month in each year for vacation, Judge Mitchell wrote one opinion in every three days for nineteen years.” Indeed, “[i]n point of numbers, his opinions exceed those of any other justice of the Supreme Court of his state, or the nation.” It is one aspect, perhaps the central aspect, the unifying theme of this prolific body of work, that is the focus of this essay: …

Diet And Preparation For Spring Migration In Captive Hermit Thrushes (Catharus Guttatus), Jennifer A. Long, Philip C. Stouffer

Seasonal changes in food choice by migratory birds often reflect changes in relative food abundance and increased energetic demand. Hermit Thrushes (Catharus guttatus) in southeastern Louisiana are highly frugivorous during winter but forage exclusively on arthropods just prior to spring migration. We hypothesized that this switch to an exclusively arthropod diet would lead to an increase in fat reserves compared to a frugivorous diet, and that fat birds would initiate migration sooner and display more migratory activity than lean birds. A Regional Comparison Of Us Homeowner Perceptions About Treated Wood, Ben N. Donkor, Sanna Kallioranta, Richard P. Vlosky, Todd F. Shupe

This study examines United States homeowner perceptions about treated wood products. Regional differences were measured across a number of themes including overall perceptions about treated wood, treated wood relative to alternative building materials, and safety issues. Respondents in the South had the most positive perception of treated wood. The most significant health concerns were related to arsenic and chromium in preservative treatments with no differences across regions. Overall, there is not a strong aversion to using treated wood products per se although the perception of health risks exists.

An explorative study was conducted to try and understand how young children’s emerging death concepts form including, (a) what family demographics and child factors contributed to family well-being, (b) did family well-being influence children’s social competence, and (c) did family well-being and children’s social competence influence children’s death conceptions. Although the subject of death contains many unique characteristics, it is not easily separated from other aspects of life; death is inseparable from the whole human experience (DeSpelder & Strickland, 2002). Secured Transaction History: The Impact Of English Smuggling On The Chattel Mortgage Acts In The Spanish Borderlands, George Lee Flint Jr, Marie Juliet Alfaro

Spanish colonies, including the territories of Florida, Louisiana, and southwestern America, acknowledged the jurisdiction of Spanish royal decrees. The colonies approached the registration of mortgages in a similar but more tentative fashion, recognizing the distances between the borderlands and the registrar’s offices. The law developed differently in Florida and Louisiana, which were administered by a different governmental body. While the registration process was required for chattel mortgages on slaves, there is no evidence the rules were enforced or applied to other types of mortgages on personalty. However, in 1770, Louisiana adopted a filing requirement for chattel mortgages for all slaves …

The fiduciary duty owed to clients by attorneys is defined by the reasonable-care standard of negligence as opposed to the all-encompassing “absolute and perfect candor” rhetoric frequently used to describe the duty owed. Words have meanings and, though the use of “absolute and perfect candor” serves a beneficial purpose, reminding attorneys of the special duty owed to their clients, the fiduciary duty owed to clients is not so all encompassing and impractical.

Modern case law fails to establish that a broadly applicable duty of “absolute and perfect” candor applies to the attorney-client relationship, except in a limited number of situations. …

IAA Reports—Monograph Series of the Israel Antiquities Authority

This is the first of the series of final reports on the excavations at the Hellenistic city of Maresha, and documents the work in the extensive man-made subterranean complexes below the lower city during the 1980s. Three subterranean complexes are presented here (70, 21, 44–45), including the study of their architecture, pottery and small finds and the industries that took place there. Chapters 1 and 2 present the setting of the site and review previous excavations, while Chapter 9 summarizes all the data in order to present a human face for the finds uncovered here.

Miriam Gideon's Cantata, The Habitable Earth: A Conductor's Analysis, Stella Panayotova Bonilla

American composer Miriam Gideon (1906-1996) is highly recognized for her vocal chamber music and her contribution to the Jewish Synagogue service. Her musical style has been described as both lyrical and expressionistic, highly engaging, with strong prevalence of dissonance and chromaticism. This study examines Miriam Gideon's cantata The Habitable Earth from a conductor's point of view. Its purpose is to increase familiarity with the work among choral musicians. The study offers detailed analysis and suggestions for performance procedures, which may also be used for understanding other twentieth century choral works.
