Physician Restrictive Covenants: The Neglect Of The Incompetent Patients' Interests, S. Elizabeth Malloy

Faculty Articles and Other Publications

The article examines how courts in different jurisdictions have addressed restrictive employment covenants for physicians and proposes a new approach drawn from the third-party beneficiary analysis in contract law. Physicians hired into existing practices often must sign substantial non-compete agreements. In evaluating the enforceability of any restrictive covenant, courts consider, among other factors, the agreement's effect on the public. Surprisingly, the vast majority of jurisdictions treat the "public interest" analysis vis-a-vis physician restrictive covenants no differently than any other commercial restrictive covenant; this approach neglects the impact that such agreements can have on a physician's existing patients. Connecting With Elementary School Esl Students Through Dialogue Journals, Amelia Myers Collins

This paper presents my experiences using dialogue journals with English as a Second Language students at Ephesus Road Elementary School in Chapel Hill, NC. The history and background of dialogue journals is discussed, as well as my philosophy of teaching. The practical aspects of using dialogue journals with elementary school non-native English-speaking students and the benefits and difficulties associated with them are described using student material. In addition, the work covers how my experience using dialogue journals differed from my expectations when I began using them. Excerpts of written dialogues between students and teacher are included.

A Plan For The Future Of The Presumpscot River: Cumulative Impacts To Environmental Conditions On The River And Its Shorelands, Presumpscot River Management Plan Steering Committee

The Presumpscot has a rich history. The river was settled early in Maine’s history (the first dam was constructed at Smelt Hill in the early 1730’s). The power and water supplied by the Presumpscot were fundamentally important to the early development of the area. Without the river there would have been no mills and little development in the area. The Presumpscot was the site of Maine’s first pulp mill, first hydroelectric project, only significant canal, and largest gunpowder mill.

Interest in reclaiming the river was given a boost in 1992 when the Maine Department of Inland Fisheries & Wildlife undertook …

The stress response is one mechanism that the bladder urothelium could potentially employ to protect itself from cellular damage after exposure to arsenic and, in so doing, influence the shape of the dose-response curve at low concentrations of exposure to this environmental pollutant. In the present study, we used the cultured human urothelial cell line UROtsa, a model of human urothelium, to determine the expression of heat shock proteins hsp 27, hsp 60, hsc 70, and hsp 70 after acute and extended exposure of the cells to lethal and sublethal levels of sodium arsenite (NaAsO2). To assess the relationship between fish density and seagrass and drift algae cover on a small geographic scale, we collected quantitative data on fish and vegetation communities during daylight hours near the mouth of the Little Manatee River, Tampa Bay, Florida. In 1991, fish were collected with two types of sampling gear, a 120-m long-haul seine and 1-m2 roving dropnets. Seagrass and drift algae cover in each sampled area was categorized as none, sparse, moderate, or dense. Food-borne transmission of prions can lead to infection of the gastrointestinal tract and neuroinvasion via the splanchnic and vagus nerves. Here we report that the transmission of transmissible mink encephalopathy (TME) is 100,000-fold more efficient by inoculation of prions into the tongues of hamsters than by oral ingestion. The incubation period following TME agent (hereinafter referred to as TME) inoculation into the lingual muscles was the shortest among the five nonneuronal routes of inoculation, including another intramuscular route. Deposition of the abnormal isoform of the prion protein, PrPSc, was first detected in the tongue and submandibular lymph node …

Recently there has been much discussion about the People’s Republic of China’s (PR) investment in and commitment to agricultural biotechnology (agri-biotech). Rapid economic expansion, population growth and technological development are changing the PRC; accompanying these changes is increased demand for high-quality food and fibre. Agri-biotech is optimistically viewed as an important way to meet these demands. Whereas Chinese technological capacity in agri-biotech has advanced significantly over the past decade, it may be unable to meet these challenges. Even when this capacity is combined with good intentions, enlightened policy and large capital outlays, accelerated development of agri-biotech may nevertheless be precluded. …
