Senate Bill 140: How Much Did It Change Texas Family Code Section 153.004?, Shelly Holcomb Oct 2002

Senate Bill 140: How Much Did It Change Texas Family Code Section 153.004?, Shelly Holcomb

Texas Wesleyan Law Review

This Note examines Texas Senate Bill 1408 (SB 140), passed by the Seventy-Seventh Texas Legislature, which amended Texas Family Code (TFC) section 153.004 relating to the history of domestic violence. The bill had two main purposes: (1) to give direction to judges "regarding the appointment of sole custody in family violence cases," and (2) to change the way Texas courts handle visitation when a parent has a history of domestic violence.' After a long Texas summer of well-publicized domestic violence cases, this amendment appeared to be the next logical, and much-needed, step in furtherance of the public policy of this …

Effect Of Hydrophobic Surfactant Proteins Sp-B And Sp-C On Phospholipid Monolayers. Protein Structure Studied Using 2d Ir And Βν Correlation Analysis, Saratchandra Shanmukh, Phillip Howell, John A. Baatz, Richard A. Dluhy

MUSC Faculty Journal Articles

We have applied two-dimensional infrared (2D IR) and beta-nu correlation spectroscopy to in-situ IR spectroscopy of pulmonary surfactant proteins SP-B and SP-C in lipid–protein monolayers at the air—water interface. For both SP-B and SP-C, a statistical windowed autocorrelation method identified two separate surface pressure regions that contained maximum amide I intensity changes: 4–25 mN/m and 25–40 mN/m. For SP-C, 2D IR and beta-nu correlation analyses of these regions indicated that SP-C adopts a variety of secondary structure conformations, including alpha-helix, beta-sheet, and an intermolecular aggregation of extended beta-sheet structure. The main alpha-helix band split into two peaks at high surface …

A Fool’S Errand? Legal Legacies Of Reconstruction In Two Southern States, Joseph A. Ranney Oct 2002

A Fool’S Errand? Legal Legacies Of Reconstruction In Two Southern States, Joseph A. Ranney

Texas Wesleyan Law Review

This Article examines several legal aspects of Reconstruction. It first looks at how the Texas and North Carolina supreme courts helped mediate the transition from a pre-war to a post-war society. Were the courts composed of unconditional Unionists, Conservatives, or a mix? Did they try to help the people of their states accept slav- ery's demise or did they aggravate the sting of defeat? A closely related issue is how Reconstruction lawmakers adjusted the legal rights of blacks following the abolition of slavery. Did they leave a permanent imprint on civil rights law or did they confirm Tourgee's judgment that …

Relationships Between Blueberry Flower Age, Pollination, And Conidial Infection By Monilinia Vaccinii-Corymbosi, Jeffery S. Lehman, Henry K. Ngugi, Harald Scherm Oct 2002

Relationships Between Blueberry Flower Age, Pollination, And Conidial Infection By Monilinia Vaccinii-Corymbosi, Jeffery S. Lehman, Henry K. Ngugi, Harald Scherm

Biology and Earth Science Faculty Scholarship

Monilinia vaccinii-corymbosi infects open blueberry flowers via the gynoecial pathway, leading to mummification of the developing fruit. To determine the effect of flower age on infection, stigmata were inoculated with conidia of M. vaccinii-corymbosi between 0 and 5 days after anthesis, fungal growth rates through the stylar canal were measured in detached flowers in the laboratory, and fruit disease incidence was determined in plants grown in the greenhouse. Hyphal growth rates were greatest in flowers inoculated on the day of anthesis, declined linearly with increasing flower age at inoculation (r = 0.921; P < 0.0001; n = 12), and were unaffected by the presence or absence of pollen applied at the time of inoculation. In greenhouse-grown plants, the percentage of infected fruit decreased exponentially with increasing flower age at inoculation (R = 0.878; P = 0.0057; n = 10), with disease incidence ranging from 76.4% for flowers inoculated on the day of anthesis to 15.5% for those inoculated 4 days later. Fruit disease incidence in the greenhouse was linearly correlated with hyphal growth rates in detached flowers (r = 0.985; P < 0.0001; n = 9), justifying the use of detached flowers when investigating gynoecial infection by M. vaccinii-corymbosi. In separate experiments, the effects of timing and sequence of pollination and inoculation on hyphal growth rates through the stylar canal and on disease incidence were investigated. Application of pollen to detached flowers 1 or 2 days before inoculation reduced hyphal growth rates by between 14.0 and 42.9% compared with flowers that received pollen and conidia simultaneously. Similarly, reductions in fruit disease incidence by between 9.5 and 18.3% were observed on greenhouse-grown plants for pollination-to-inoculation intervals ranging from 1 to 4 days. These results document that newly opened flowers are most susceptible to infection by M. vaccinii-corymbosi and that fruit disease incidence is reduced if pollination occurs at least 1 day before inoculation. Strategies that lead to early pollination of newly opened flowers may be useful for managing mummy berry disease in the field.

Rhino Earth Tiller Test Report: Area Reduction In Mixed Minefields, Christopher Wanner Oct 2002

Rhino Earth Tiller Test Report: Area Reduction In Mixed Minefields, Christopher Wanner

Global CWD Repository

The Rhino is a tracked tilling vehicle custom designed and built from the ground up. The working tiller consists of two horizontal drums, stacked one overtop of the other. The drums are studded with commercially available, asphalt shredding chisels. The lower drum counter rotates against the direction of vehicle travel, excavating soil and objects from burial depths of 25 – 35 centimeters. The excavated soil and constituent objects are carried up the face of the lower, digging drum and into the 1 to 5 centimeter gap between the lower and upper drums. The chisels on the two drums mesh with …

An Extension Of The Fundamental Theorem Of Linear Programming, A Brown, A Gedlaman, Allen G. Holder, S Martinez Oct 2002

An Extension Of The Fundamental Theorem Of Linear Programming, A Brown, A Gedlaman, Allen G. Holder, S Martinez

Mathematics Faculty Research

In 1947 George Dantzig developed the Simplex Algorithm for linear programming, and in doing so became known as The Father of Linear Programming. The invention of the Simplex Algorithm has been called "one of the most important discoveries of the 20th century," and linear programming techniques have proven useful in numerous fields of study. As such, topics in linear optimization are taught in a variety of disciplines. The finite convergence of the simplex algorithm hinges on a result stating that every linear program with an optimal solution has a basic optimal solution; a result known as the Fundamental Theorem of …

Universal Approximation Theorem For Uninorm-Based Fuzzy Systems Modeling, Ronald R. Yager, Vladik Kreinovich Oct 2002

Universal Approximation Theorem For Uninorm-Based Fuzzy Systems Modeling, Ronald R. Yager, Vladik Kreinovich

Departmental Technical Reports (CS)

Most existing universal approximation results for fuzzy systems are based on the assumption that we use t-conorms and t-conorms to represent "and" and "or". Yager has proposed to use, within the fuzzy system modeling paradigm, more general operations based on uninorms. In this paper, we show that the universal approximation property holds for an arbitrary choice of a uninorm.
