This Article begins by briefly describing the role of the board both in law and in practice. Part II explores the distinction be- tween consensus and authority as modes of institutional decision- making. As hierarchical institutions, corporations rely far more heavily on authority than on consensus. Yet, at the apex of the hierarchy is a collegial body that functions mainly by consensus.

Part III is the core of the Article. In order to evaluate corporate law's preference for collective decisionmaking, we need to know whether group decisionmaking is superior to that of individuals. A wealth of experimental data suggests that …

Georgia decision, Justice Brennan likened capital punishment to a mere game of chance: "When the punishment of death is inflicted in a trivial number of the cases in which it is legally available, the conclusion is virtually inescapable that it is being inflicted arbitrarily. Throughout the development of employment discrimination law, the United States Supreme Court has wrestled with the task of producing a suitable analytical framework, under which plaintiffs can attempt to prove their cases of disparate treatment by their employers. An element of this task has been determining which types of evidence of discriminatory intent have probative value, and what effect that evidence should have on plaintiffs' and defendants' cases. In June 2000, the Supreme Court decided Reeves v. In this paper, the asymptotic expression of the eigenvalues and eigenfunctions of the Sturm-Liouville equation with the lag argument y''(t) + \lambda^2 y(t) + M(t)y (t - \Delta(t)) = 0 and the spectral parameter in the boundary conditions \lambda y(0) +y'(0) = 0 \lambda^{2}y(\pi) + y'(\pi) = 0 y(t - \Delta(t)) = y(0)\varphi(t - \Delta(t)), t - \Delta(t) < 0 has been founded in a finite interval, where M(t) and \Delta(t) \geq 0 are continuous functions on [0, \pi], \lambda > 0 is a real parameter, \varphi(t) is an initial function which is satisfied with the condition \varphi(0) = 1 and continuous in the initial set.

Previous chapters have described the vast array of resources that Cal Poly’s officials oversee. As students, educators and others in the surrounding community continue to use Cal Poly Land and surrounding areas, the ecological system and its capacity to recover become strained. In order to ensure that in 100 years students (and other Cal Poly stakeholders) will be able to have the same opportunities to benefit from the land resources, Cal Poly’s stakeholders need to develop the mind-set and tools to help us maintain and enhance these resources. This section describes several approaches available to help us.

To explore the contextual factors influencing health-seeking behavior of women in Karachi regarding reproductive tract infections, 18 women with reproductive tract infections from different clinics and community settings were identified and in-depth interviews were conducted. Physicians in our study diagnosed a woman to have lower reproductive tract infection if she complained of malodorous vaginal discharge with or without perineal itching; and to have pelvic inflammatory disease or upper reproductive tract infection if she had any two of the following complaints: malodorous vaginal discharge, menstrual irregularities, lower abdominal pain or dyspareunia. Botrytis, causal agent Botrytis cinerea, is a fungal disease of grapevines that is commonly referred to as Botrytis bunch rot or grey mould. Botrytis is most prevalent where warm, wet conditions are frequent, but symptoms can occur in cool, wet weather and high humidity. All grape varieties are susceptible. Varieties most at risk are those with berries that are thin-skinned and/or have tight bunches.

Fertigation is the technique of using soluble fertilisers to supply essential nutrients to vegetables through sprinkler or trickle irrigation systems, or by means of a boom spray. It is ideally suited to most horticultural areas in Western Australia, especially the sandy soils of the Swan Coastal Plain that have a poor capacity to retain nutrients.

Before and after planting, nutrients are often applied to vegetables on soils of the Swan Coastal Plain by applications of poultry manure* or solid fertilisers. After planting, fertigation is a safe and effective method of applying top-dressings of nutrients to crops, especially after the rows …

The effect of Quartermate pre-milking teat sanitation on milk quality was investigated in twelve dairy herds over a period of eight weeks. Pre-milking teat sanitation was carried out on all cows for six weeks on each of six farms and mesophile and thermophile bacteria counts of raw milks were compared before the milk line (“cluster” samples), and at various points within milking plants. Rates of mastitis, vat milk iodide levels and specific bacteria were also monitored.

Locating Moral Responsibility For War Crimes : The New Justiciability Of 'System Criminality' And Its Implications For The Development Of An International Polity, Samantha Jane King

School of Law, Humanities and Social Sciences Theses

This thesis examines the question of international responses to system criminality. It argues that the assignation of moral responsibility, expressed in the act of prosecuting individuals, expresses a fundamental conceptual shift towards an international polity. Although political rhetoric, the media and international legislation express the moral dimension of system criminality, the character of humanitarian law and the contingency of its operation is the most concrete indicator of such a development. The status of an embryonic international polity becomes particularly evident- with `individual responsibility' being a criminally liable offence, as set against `collective responsibility' which entails `civil', (non-penal) liabilities.
