Load Tests On Pipe Piles For Development Of Cpt-Based Design Method, Kwangkyum Kim, Rodrigo Salgado, Junhwan Lee, Kyuho Paik Jan 2002

Load Tests On Pipe Piles For Development Of Cpt-Based Design Method, Kwangkyum Kim, Rodrigo Salgado, Junhwan Lee, Kyuho Paik

JTRP Technical Reports

This research focused on the drivability and load-carrying capacity of both open and closed-ended steel pipe piles. Two pipe piles (one open-ended, the other closed-ended) were installed in a sandy soil to the same depth. The site was extensively characterized. SPT and CPT tests were performed both before and after pile installation. A variety of soil indices and shear strength parameters (such as the constant-volume friction angle) were measured in the laboratory. The piles were fully instrumented, permitting separate measurement of shaft and base capacity for the closed-ended pile and shaft, annulus and soil plug capacities for the open-ended pile. …

Performance-Related Specifications For Concrete Bridge Superstructures, Volume 4: Bond Of Epoxy-Coated Bars With Thicker Coatings, J. A. Ramirez, Michael K. Appelhans Jan 2002

Performance-Related Specifications For Concrete Bridge Superstructures, Volume 4: Bond Of Epoxy-Coated Bars With Thicker Coatings, J. A. Ramirez, Michael K. Appelhans

JTRP Technical Reports

In Volume 4 of the final report, the results of an evaluation of the bond performance of epoxy-coated bars with a coating thickness up to 18 mils are presented. The experimental work on the bond performance of epoxy-coated bars with thickness up to 18 mils indicates that the current AASHTO requirements for development length of epoxy-coated bars up to #8 could be safely extended to coating thickness of up to 18 mils. Thus, no change to the bond specifications is recommended in order to implement the use of bars with diameters up to a #8 with epoxy-coating thickness up to …

Performance-Related Specifications For Concrete Bridge Superstructures, Volume 3: Nonmetallic Reinforcement, Robert J. Frosch, Christopher P. Mosley, Ahmet Koray Tureyen

JTRP Technical Reports

In Volume 3 of the final report, research work conducted to investigate the behavior of fiber reinforced polymer (FRP) reinforcement is summarized. This study focused on the behavior of FRP reinforced concrete structures with an emphasis on bond and shear. For the bond investigation, three series of beam splice tests were performed on specimens reinforced with steel, glass FRP, and aramid FRP to determine the effect of the different types of reinforcement on bond, cracking, and deflections. The test results indicate that the use of FRP reinforcement leads to lower bond strengths and, therefore, require longer development lengths. The specimen …

The Lawyer As Consensus Builder: Ethics For A New Practice, Carrie Menkel-Meadow Jan 2002

The Lawyer As Consensus Builder: Ethics For A New Practice, Carrie Menkel-Meadow

Georgetown Law Faculty Publications and Other Works

In this Article, I explore the roles of lawyers in alternative dispute resolution ("ADR"), including traditional roles in arbitration and "new" roles in mediation and facilitation. I also discuss how conventional ethics rules for lawyers fail to provide guidance and "best practices" for lawyers who serve in these new roles. State legislatures and professional associations, such as the American Arbitration Association ("AAA"), the Center for Public Resources Institute for Dispute Resolution ("CPR"), and the Association of Conflict Resolution, have adopted ethical codes for mediators and arbitrators. Select professional associations are also developing "best practice" guides for the provision of ADR …

A Subversive Strand Of The Warren Court, Gary Peller Jan 2002

A Subversive Strand Of The Warren Court, Gary Peller

Georgetown Law Faculty Publications and Other Works

The choice between "de jure" and "de facto" standards of review arises whenever a legal standard is needed to identify violations of specific constitutional rights or norms in particular cases. The issue is methodological in the sense that the question is faced regardless of the particular right or norm at issue (although it is not really true that the choice between these methodologies would have no influence on the choice of rights or norms to apply). A de Jure approach limits the imposition of constitutional norms to cases in which the state has affirmatively acted to help create a particular …

The Limits Of Being "Present At The Creation", Roy A. Schotland Jan 2002

The Limits Of Being "Present At The Creation", Roy A. Schotland

Georgetown Law Faculty Publications and Other Works

Having been invited late to this Symposium and having read fewer than all essays, I offer, (with deep appreciation for the invitation), only mini-comments on three of the many valuable contributions: the essays by Professors Persily, Hasen, and Gerken. But first, at risk of pedantry, may I suggest changing the Symposium's title to something like "Baker and its Progeny .... (or "Baker, doughnuts, and holes"?). Most of the treatment seems to be about the progeny, as surely it should be. While of course everyone knows how far Baker went, what Reynolds did, and what was not done until after Reynolds, …

Liberty And Property In The Patent Law, John R. Thomas Jan 2002

Liberty And Property In The Patent Law, John R. Thomas

Georgetown Law Faculty Publications and Other Works

Patents have seldom troubled civil libertarians. A specialized form of property, patents seemed pertinent to the technologies of traditional industry but little else. Patent instruments offered their readers mere technical documentation; patent cases presented no more than the mapping of a text onto an instantiated artifact; patent policy was principally oriented toward economic optimization of the length and scope of protection. Unbound from technology, contemporary patent law now seems a more robust discipline. Modern patent instruments appropriate a diverse array of techniques that span the entire range of human endeavor. Patent claims, cut loose from physical moorings, have grown more …

A Voice Of Reason: The Products Liability Scholarship Of Gary T. Schwartz, Joseph A. Page Jan 2002

A Voice Of Reason: The Products Liability Scholarship Of Gary T. Schwartz, Joseph A. Page

Georgetown Law Faculty Publications and Other Works

Of my many fond personal memories of Gary Schwartz, the one that stands out most vividly summons from the mists of time an evening in June 1983 at Boston's Fenway Park. It was my last visit to a childhood haunt where I had seen my first professional baseball game in 1941, an occasion that marked the beginning of a lifelong passion for the national pastime. Settled into an excellent seat that faced the storied left-field wall (and brought to mind visions of the large advertisements that covered its surface before it became known as the "Green Monster”,), I began to …

What Would It Take To Feel Safe?, Mari J. Matsuda Jan 2002

What Would It Take To Feel Safe?, Mari J. Matsuda

Georgetown Law Faculty Publications and Other Works

What would it take to make people feel safe? What message will those who would wage peace offer to this beleaguered planet? There is indeed a threat. I will call that threat terrorist fascism because that is what it is. It thwarts human beings in pursuit of the most basic need identified by psychologists: The need to feel their bodies are safe. This threat is horrible indeed, and the road to ending it is long and hard. I do not know all we need to do to end terrorist fascism, but what I know of history tells me that militarism …

The Essential Facilities Doctrine Under United States Antitrust Law, Robert Pitofsky, Donna Patterson, Jonathan Hooks Jan 2002

The Essential Facilities Doctrine Under United States Antitrust Law, Robert Pitofsky, Donna Patterson, Jonathan Hooks

Georgetown Law Faculty Publications and Other Works

The issue of essential facilities has attracted renewed attention in Europe in recent years because of the controversy between IMS Health Inc. and NDC Health Corporation, two competitors in pharmaceutical data services in Germany . . . After an extensive investigation, the European Commission (EC) ordered that IMS grant access to the 1860 brick structure on commercially reasonable terms, and the EC decision is now on appeal in the Court of First Instance in Luxembourg. One issue that emerged in that litigation is whether a decision by European authorities to grant access to the alleged essential facility, especially one whose …

An Interview With Sandra Harding, Stephanie Urso Spina, Mike Roberts, Patricia Ticento Clough Jan 2002

An Interview With Sandra Harding, Stephanie Urso Spina, Mike Roberts, Patricia Ticento Clough

Publications and Research

Harding’s position has been critiqued as more postmodern than feminist, as viable without nasty entanglements in feminism, as too concerned with established Eurocentric, scientific discourses, and as appealing to foundational innocence by her concern with realism. But what seems to drive Harding’s choices more than anything is a conscious attempt to be effective in intervening in existing systems of power, whether empiricist and postmodern. By taking this position, Harding undertakes a difficult task. Its difficulty, however, is compensated for by the conversations she generates. As a voice not restricted to one intellectual school, Harding demands attention from many with opposing …

Review Of Treasures Of Castilla Y León: A Cultural Season In New York, Antoni Pizà Jan 2002

Review Of Treasures Of Castilla Y León: A Cultural Season In New York, Antoni Pizà

Publications and Research

Spanish religious art tends to be theatrical in nature. During the Middle Ages and the Renaissance, for example, the original setting of sculpted figures invariably emulated a stage in order to create a dramatic environment in which light, smells, and sounds were controlled for effect. Just consider the religious sculptures frequently paraded in processions or the statuary placed in chapels and niche-like recesses. Or think also of the dramatic paintings that functioned almost as backdrops for what amounted to the "staging" of the Catholic liturgy. Medium and message, thus, went hand in hand, a dependence that was made even stronger …

Finite Element Assessment Of The Effects Of Seismic Loading Rate On Soil Liquefaction, Radu Popescu Jan 2002

Finite Element Assessment Of The Effects Of Seismic Loading Rate On Soil Liquefaction, Radu Popescu

Architectural Engineering

The influence of frequency content of seismic excitation on the extent and pattern of pore-water pressure build-up in saturated soil deposits is addressed. Seismic acceleration time histories are generated as uniformly modulated nonstationary stochastic processes, in accordance with prescribed response spectra and prescribed modulating functions. Based on numerical examples, it is shown that the interplay between the frequency content of seismic excitation and the dynamic characteristics of the soil system and their evolution during and after the earthquake have important implications on the dynamic response.Key words: seismic motion, frequency content, finite elements, soil dynamics.

A Model And Methodologies For The Location Problem With Logistical Components, Siddhartha Syam Jan 2002

A Model And Methodologies For The Location Problem With Logistical Components, Siddhartha Syam

Management Faculty Research and Publications

This paper significantly extends traditional facility location models by introducing several logistical cost components such as holding, ordering, and transportation costs in a multi-commodity, multi-location framework. Since location and logistical costs are highly inter-related, the paper provides an integrated model, and seeks to minimize total physical distribution costs by simultaneously determining optimal locations, flows, shipment compositions, and shipment cycle times. Two sophisticated heuristic methodologies, based on Lagrangian relaxation and simulated annealing, respectively, are provided and compared in an extensive computational experiment.

Tradition, Principle And Self-Sovereignty: Competing Conceptions Of Liberty In The United States Constitution, Robin West Jan 2002

Tradition, Principle And Self-Sovereignty: Competing Conceptions Of Liberty In The United States Constitution, Robin West

Georgetown Law Faculty Publications and Other Works

The “liberty” protected by the United States Constitution has been variously interpreted as the “liberty” of thinking persons to speak, worship and associate with others, unimpeded by onerous state law; the liberty of consumers and producers to make individual market choices, including the choice to sell one’s labour at any price one sees fit, free of redistributive or paternalistic legislation that might restrict it; and the liberty of all of us in the domestic sphere to make choices regarding reproductive and family life, free of state law that might restrict it on grounds relating to public morals. Although the United …

Never Trust A Corporation, William W. Bratton Jan 2002

Never Trust A Corporation, William W. Bratton

Georgetown Law Faculty Publications and Other Works

I would like to start by noting multitudinous objections to assertions made in Larry Mitchell's Corporate Irresponsibility: America's Newest Export. But I waive these points for purposes of this Symposium. I would prefer to take the occasion to celebrate the book. So I will make two points on the subject of corporate social responsibility on which the book and I stand in complete accord.

Venture Capital On The Downside: Preferred Stock And Corporate Control, William W. Bratton Jan 2002

Venture Capital On The Downside: Preferred Stock And Corporate Control, William W. Bratton

Georgetown Law Faculty Publications and Other Works

This Article takes the occasion of the simultaneous collapse of the high technology stock market and the failure of the dot-coin startups, along with the subsequent retrenchment of the venture capital business, to examine the law and economics of downside arrangements in venture capital contracts. The subject matter implicates core concerns of legal and economic theory of the firm. Debates about the separation of ownership and control, relational investing, takeover policy, the law and economics of debt capitalization, and bankruptcy reform, all grapple with the downside problem of controlling and terminating unsuccessful managers for the benefit of outside debt and …

Enron And The Dark Side Of Shareholder Value, William W. Bratton Jan 2002

Enron And The Dark Side Of Shareholder Value, William W. Bratton

Georgetown Law Faculty Publications and Other Works

This Article addresses the implications that the Enron collapse holds out for the self-regulatory system of corporate governance. The case shows that the incentive structure that motivates actors in the system generates much less powerful checks against abuse than many observers have believed. Even as academics have proclaimed rising governance standards, some standards have declined, particularly those addressed to the numerology of shareholder value. The Article's inquiry begins with Enron's business plan. The Article asserts that there may be more to Enron's "virtual firm" strategy than meets the eye beholding a firm in collapse. The Article restates the strategy as …

A Tribute To Paul Szasz, Edith Brown Weiss Jan 2002

A Tribute To Paul Szasz, Edith Brown Weiss

Georgetown Law Faculty Publications and Other Works

Throughout the world, Paul Szasz has garnered everyone's respect for his intellect, his uncompromising integrity, his innate sense of fairness, and his dedication. Paul treated everyone the same, whatever the nationality. He passionately believed in international law. Even in the last 20 months when he was ill, he continued to live and breathe the life of international law, flying repeatedly to Geneva, to Rio, to The Hague, to California, and elsewhere to advise on international negotiations for a framework convention to control tobacco or to present a paper. Paul was an inspiration to people around the world, young and old. …

The Bounds Of Zeal In Criminal Defense: Some Thoughts On Lynne Stewart, Abbe Smith Jan 2002

The Bounds Of Zeal In Criminal Defense: Some Thoughts On Lynne Stewart, Abbe Smith

Georgetown Law Faculty Publications and Other Works

On April 9, 2002, a troop of armed FBI agents stormed the Brooklyn town house of sixty-two-year-old Lynne Stewart. A school librarian turned criminal lawyer, Stewart thought they had come for her life partner, longtime political activist Ralph Poynter. Flashing an arrest warrant, the agent in charge informed her otherwise, "We're not here for him, we're here for you." As her neighbors looked on, Stewart was handcuffed and taken off to jail.

Indicted under a federal law that prohibits providing "material support or resources" to organizations designated by the Secretary of State as engaging in terrorist activity, Stewart suddenly found …
