This Article discusses the court’s misuse of the similarly situated concept. Part II is a short summary of the employment discrimination law, concentrating on the system developed by the Supreme Court for indirectly proving an individual disparate treatment case. Under the Supreme Court’s methodology, one way that a plaintiff may prove a prima facie case is to point to a similarly situated employee who the employer treated differently. Some courts, however, require a similarly situated showing as an element of plaintiff’s prima facie case. Part III discusses the problems with such a requirement. Have Another Round On Me: Missouri Court Awards Workers' Compensation Benefits To Intoxicated Employees, Kimberly D. Sandner

This Note examines the broadened application of Missouri’s workers’ compensation statute under Smith v. District II A & B, in which the Missouri Court of Appeals awarded workers’ compensation benefits to a worker injured when he drove from a work function while intoxicated. By awarding workers’ compensation benefits to cover illegal conduct such as illegally driving while intoxicated, Missouri courts are violating legislative intent, violating the historical purpose of workers’ compensation, and potentially hurting the society the legislature sought to unburden when it created a compensation scheme for injured workers.

When Michael Fisher filed his workers’ compensation claim, he was unaware that his employer, Waste Management of Missouri, had been secretly videotaping his physical activities. Not surprisingly, the submission of the surveillance videotapes at Fisher’s compensation hearing significantly contributed to the reduction of his disability ruling. The admission of these surveillance videotapes is, subsequently, the focus of this Note. Specifically, this Note will examine the meaning of a “statement” under Missouri’s workers’ compensation law and the process through which an employee can obtain such statement prior to a compensation hearing.

The federal courts have often been faced with the “recurring and inherent conflict” between the Limitation of Liability Act and the saving to suitors clause. The Limitation of Liability Act allows a shipowner to absolutely limit its liability, for collisions and other losses which take place without the owner’s privity or knowledge, to the value of the ship and its freight then pending. The Act also provides for exclusive federal admiralty jurisdiction to determine whether an owner is entitled to limitation of its liability. This Law Summary begins with a brief overview of the clinical treatment of sexual predators. The clinical background section enhances the discussion of legislation and jurisprudence because the adjudication of an individual as a sexually violent predator, in many states, involves testimony form medical experts and findings as to the individual’s ability to control his behavior, and, consequently, the likelihood that he will re-offend if he is released. Lawyers often seek disqualification of the opposing counsel based upon their conflicts of interest as a strategic measure to delay litigation and increase costs for the other side. For many years, courts presumed that parties unaffected by the conflict of interest had standing because of the lawyer's professional obligations to report violations of ethics rules. Recently, the United States Supreme Court has cast doubt on the standing of such parties. Missing data handling is an important preparation step for most data discrimination or mining tasks. Inappropriate treatment of missing data may cause large errors or false results. In this paper, we study the effect of a missing data recovery method, namely the pseudo- nearest neighbor substitution approach, on Gaussian distributed data sets that represent typical cases in data discrimination and data mining applications. The error rate of the proposed recovery method is evaluated by comparing the clustering results of the recovered data sets to the clustering results obtained on the originally complete data sets. The 2000 United States presidential election was one of the closest in history, and issues of importance to older Americans such as Social Security, prescription drugs, and taxes were front and center in the national debate. This article examines how AARP, formerly the American Association of Retired Persons, portrayed the candidates and issues through its two publications: AARP Bulletin and Modern Maturity.

The purpose of this study was fourfold: (a) to empirically evaluate the correlation between perceived psychosocial stressors (expressed concerns), immature defense styles, dysfunctional personality patterns, clinical syndromes, and maladaptive behaviors, as measured by the Millon Adolescent Clinical Inventory (MACI), Defense Style Questionnaire-40 (DSQ-40), and Youth Outcome Questionnaire-2.0 (YOQ); (b) to look at how wilderness therapy affects the expressed concerns, immature defense styles, clinical syndromes, dysfunctional personality patterns, and maladaptive behaviors of troubled adolescents; (c) to see if subjects whose post-test defense styles change improve more than subjects whose defense styles remain the same or get worse; and (d) to begin …

Presidential Domain: An Exploratory Study Of Prospect Theory And Us Climate Policy Since 1998, Hal T. Nelson

The Bush administration's decision to abandon the Kyoto Protocol can be explained by prospect theory. The change in federal climate policy between the Clinton and Bush administrations was due to the difference in domain that each president operated under. President Clinton operated under a domain of losses as he associated continued fossil fuel use with future socio-economic and environmental damages from climate change. This domain of losses increased President Clinton's risk tolerances and explains his pursuit of the Kyoto Protocol, an international agreement to limit greenhouse gas emissions. Conversely, President Bush operated under a domain of gains where he did …

A Qualitative Study Of Bullying Behavior In Federal Law Enforcement: An Examination Of Former Officers' Perceptions Regarding The Problem, Rande W. Matteson

The purpose of this phenomenological research project was to study and review through naturalistic inquiry, the perceptions of former federal agents and officers as to whether they believe they were bullied at their workplace, and if so, what did those participants do to cope or adjust to the bullying behavior. Multiple sources for data collection were deployed to explore and examine whether former agents perceive they were bullied at work and what mechanisms those employees found were helpful as coping strategies.

This research project used a non-random, purposeful sample selected from contacts established through the Federal Law Enforcement Officers Association. …
