The traditional forms of public health law were directly largely toward communicable diseases and other externalities, such as pollution, with negative health impacts. The more modern view treats any health issue as one of public health so long as it effects large numbers of individuals, which would include such matters as obesity and diabetes. Historically, this paper examines the constitutional evolution of the public health principle from the narrower to the broader conception. It then argues that the narrower principle better defines the appropriate scope of coercive government intervention than the broader definition, which could easily authorize those forms of …

Taxation And Risk-Taking With Multiple Tax Rates, David A. Weisbach

This paper extends the Domar and Musgrave results concerning the effect of an income tax on risk taking to the case where different tax rates apply to different types of assets. Although the results depend on exactly how the differential tax rates are imposed, as a general matter, an income tax with differential rates can be seen as a tax only on the risk-free rate of return and a fixed ex ante subsidy for purchasing the lower-taxed assets. There are implications for measuring deadweight loss from differential taxation and for spending resources on accurately measuring capital income.

The law of corporate reorganizations is conventionally justified as a way to preserve a firm’s going-concern value: Specialized assets in a particular firm are worth more together in that firm than anywhere else. This paper shows that this notion is mistaken. Its flaw is that it lacks a well-developed understanding of the nature of a firm. Initially, it is easy to confuse size with specialization and overstate the extent to which assets are dedicated to a particular enterprise. Even when such dedicated assets exist, they often do not need to stay in the same firm. As Coase taught us, as …

為培養護理人員面對新世紀多元的健康議題與需求之挑戰，並能提供優質之護理服務，多所護理學校正積極進行教育改革，本文為作者參與2002年7月至8月於加拿大McMaster大學之暑期PBL護理教學研習會後，對學習內容及經驗進行對話省思，以錄音方式進行並將內容分析及評論有關PBL推行之議題所做的整理。分析結果共包括八大議題：（1）課程規劃需有系統，並基於護理教育的理念、（2）重視學生特質與主動學習（3）教師可在與學生互動中促進雙方身心靈的成長、（4）教學資源可充實學生主動學習能力、（5）評值方式的回饋，可引導學生自我成長、（6）師資培育與激勵策略、（7）行政組織的功能及支援，及（8）以研究精鍊PBL教育方法之應用。此結果之分享可作為護理教育者於推動PBL學習法時於結構面、過程面的參考。

The Metamorphosis Of The Defense Industry, Margaret A. Noble

The downsizing of the United States defense industry in recent years had a multitude of effects on defense and defense-related manufacturers. Besides the inevitable loss of jobs, these firms essentially had to reinvent themselves in order to compete in the commercial sector more effectively. Moreover, the defense cutbacks also resulted in implications for the U.S. as a whole. These include questionable preparedness for armed conflict, as well as the potential loss of defense-related suppliers that could affect the ability to sustain armed conflict. These and other insights were gleaned from plant-level interviews and tours of several, small defense-related manufacturers.

Employee Interests In Bankrupcy: Lessons From Enron, Lorie Johnson

Popular Media

Enron employees lost over $1 billion in retirement savings when the company failed and filed for bankruptcy protection. Many of these employees also lost their jobs. Enron employees were both visible and vocal about their losses, quickly obtaining the support of both the AFL-CIO and Jesse Jackson’s Rainbow/Push Coalition in their fight to get some redress for their losses. Since Enron was current on its payroll at the time of the bankruptcy filing, employees’ losses consisted of severance payments totaling $145 million and the losses associated with investments in Enron stock through their 401(k) accounts.

In the year 2000, over one million children were involved in a new divorce. These statistics indicated that this subgroup of children would continue to be a large part of the school population. The school, because of time spent there, becomes a likely place for the recognition and identification of problems that may arise from parental divorce, thus providing an appropriate setting for interventions to be conducted.

The purpose of this study was to survey special education teachers and speech therapists in eleven school districts in Northeast Tennessee regarding their knowledge level (etiology and educational programming) of autism spectrum disorder (ASD). The primary focus of the study was to identify effective programs and methods used by special educators in this region, comparing them to the latest techniques and teaching methods prescribed by recent research. In addition, identified weaknesses were used to recommend future training and staff development to enable educators to provide the best possible programs for children with autism.

The case of Eldred v. Ashcroft, argued before the U. S. Supreme Court on October 9, 2002, is the most important copyright case since 1834, when the court decided its first, Wheaton v. Peters. In Wheaton, the court ruled that under the Copyright Clause of the U.S. Constitution only Congress can grant copyright for published works. In Eldred, the court will decide the scope of Congress’ copyright power. Ultimately, this paper stems from two cultural strands which intersect in one cultural form, self-improvement advertising aimed at men. The first of these is the figure of the "new man," which appeared in the mid-1980s. The novelty lies in the positioning of masculine bodies precisely for the purpose of being seen. The available criticism was not equipped to account for these positionings. The second cultural strand, the proliferation of technologies which alter the body itself, as opposed to its coverings, makes the gap in the criticism more apparent. This project discusses the development and use of an online K-12 attendance, grading, and transcript program to be used by East Dakota Educational Cooperative teachers who are located at the main building and at external schools located approximately 100 miles from the main office. The internet-based program has a fully functional database that will store all grade and attendance information about each student attending an East Dakota Educational Cooperative school. Fracturing a hip is a devastating experience for the older adult, and mortality and morbidity following a hip fracture are high among this vulnerable population. Mortality rates from 12 to 37 percent have been reported within one year after a hip fracture. It is estimated that 50 percent of individuals who experience hip fractures become partially dependent in activities of daily living, and 33 percent become totally dependent in activities of daily living. Reducing morbidity by improving rehabilitation outcomes is an important healthcare goal for older adults. Measurement of intuition use among nursing students has not occurred because developed intuition measures have been designed specifically for experienced nurses. The purpose of this study was to develop and psychometrically evaluate an intuition instrument for nursing students. An intuition instrument can provide the means to (a) determine if students use intuition in care providing activities and (b) measure intuition use over time. Instrument development included (a) concept clarification, (b) item development, and (c) psychometric testing.
