Under the Pregnancy Discrimination Act (PDA), employers are prohibited from discriminating against women by treating pregnancy and childbirth different from other medical conditions. Employers who offer medical benefits to their employees have thus been required to cover pregnancy-related medical costs on the same terms as other medical coverage. The cost of prescription contraception, however, has generally not been covered by employer-sponsored medical plans, even while other prescription drugs were. This Note examines the recent case of Erickson v. Bartell Drug Co., which challenged this practice of excluding prescription contraception coverage as discriminatory under the PDA, and argues that further federal …

Understanding Prophylactic Remedies Through The Looking Glass Of Bush V. Gore, Tracy A. Thomas

Using the context of Bush v. Gore as a vehicle for discussion, Professor Thomas examines the use and legitimacy of prophylactic remedies. In this Article, Professor Thomas advances the argument that the broad prophylactic remedy provided by the U.S. Supreme Court in Bush v. Gore may be viewed as contrary to the law of remedies in that it operated to negate, rather than enforce, legal rights. In particular, prophylactic remedies which are untailored and unachievable, as in Bush v. Gore, threaten the legitimacy of prophylaxis. "Living Constitution " ideas are most often associated with individual-rights guarantees like equal protection and due process, but they were originally developed in the early twentieth century to revolutionize the law of the structural Constitution - including the Commerce Clause. In this Article, Professor Claeys interprets Progressive political theory, which played a crucial role in legitimating the expansion of the national government. As applied to federalism, Progressive living-Constitution theory required that the Commerce Clause be interpreted as a constitutional transmitter letting the national government regulate whatever the American people deem to be a national problem. The use of psychological state words during mother-child play sessions at age 3 was examined in 31 children diagnosed with delayed expressive language at 24-31 months and 21 age-matched typically developing comparison children. Children and mothers in the late talker group made more references to physiological states and fewer references to cognitive states than the children and mothers in the typically developing comparison group. The children's use of cognitive terms correlated significantly with measures of language ability, including mean length of utterance, Index of Productive Syntax score, and use of propositional complements, as well as with their mothers' use of …

Job satisfaction and the factors that contribute to it are well-researched phenomena. Despite this, however, theories of job satisfaction are still not well perfected. Research in the field falls into five categories based on the causes of satisfaction they seek to establish: need fulfilment models, discrepancy models, value attainment models, equity models and trait component models. The last category includes studies that investigate the relationship between job satisfaction and the cultural and ethnic background of employees. Studies in this area report contradictory findings.
