One of the most controversial and evolving rights recognized within recent years has been the right to privacy. During the twentieth century, the Supreme Court and the United States Congress recognized the existence of this right, although in limited aspects. In the twenty-first century, Americans' privacy rights have clashed with the evolution and the use of the Internet. Complications between a person's privacy and the information needed for national security interests arose. Faster, simpler, and more cost-effective held screening tools can increase the amount of information available concerning the location, source, and/or concentration of pollutants present in the environment. The Enzyme Inhibition Bioassay 96 (EIB 96) is one such field-screening tool; The EIB 96 is an assay that can detect the presence of organophosphate and carbamate compounds, providing scientists with valuable information to focus their future sampling efforts. The assay is based on the inhibition of the enzyme acetylcholinesterase by organophosphate and carbamate compounds. Steward's Southern Great Basin Research Validated Through Obsidian Artifact Sources, Lynn Ellen Haarklau

Energy Dispersive X-Ray Fluorescence (EDXRF) analysis of obsidian artifacts collected from ethnohistoric sites in southern Nevada revealed patterns consistent with Julian Steward's documentation of Western Shoshone socioeconomics. Specific obsidian sources were predicted to be present in artifact samples collected from six sites in the study area. Predictions were based on Steward's documentation of Lida Vicinity, Kawich Mountains, and Beatty/Belted Mountains Shoshone subsistence travels and inter-district festival relationships. Using Steward's data, criteria were established for field identification of Shoshone winter camps. Data review and field reconnaissance resulted in identifying six camps. In 1983, President Ronald Reagan addressed the National Association of Evangelicals, delivering what is now referred to as his "Evil Empire" speech. Hoping to reestablish his commitment to conservative values and encourage the audience to oppose a nuclear freeze, Reagan condemned the Soviet Union as the "focus of evil" in the modern world and urged the audience to resist the aggressive impulses of an evil empire. West Virginia's coal mining industry experienced extremely high casualty rates during the first half of the twentieth century. This study examines the cultural, political, and technological factors that contributed to the hazardous nature of mining and prevented significant improvements in mine safety. The period was characterized by rapid advancements in technology which enabled mine operations to expand significantly. However, these technological improvements unleashed dangerous forces underground, such as increased accumulations of coal dust. In 1917, the Navy Department authorized a factory to manufacture battleship armor plate. Although the plant failed in its intended purpose, its example reflected both the government's search for a way to regulate the growth of monopoly and cartels, and the changing face of military-industrial relations. Difficulties with the steel industry began in the late 1800s, but the influence of Wilsonian “New Freedom,†precedents for government ordnance manufacture established by Navy Secretary Josephus Daniels, and attachment to the 1916 naval build program, helped assure the armor plant's construction. Franklin Roosevelt's experience in the Navy Department under Daniels, provided continuity of …

The Reluctant Delegate: Alexander Campbell And The Statehood Movement In Western Virginia., Jill Adana Rogers

When Alexander Campbell, a young Scots-Irish minister, immigrated to the United States in 1809, he encountered a new nation that was pulsating with religious revival, hungry for more territory, and already divided by the “peculiar institution” of slavery. Within twenty years, Campbell established himself as a well-known religious reformer, educator, and landholder in Virginia’s Northern Panhandle. Although Campbell otherwise believed in separation of church and state, he agreed to participate as a western political delegate to the 1829-1830 Virginia Constitutional Convention. Campbell’s able representation of western sectional interests astounded other more politically experienced delegates. Disheartened by eastern Virginia’s suppression of …

Practicing "In The Interests Of Justice" In The Twenty-First Century: Pursuing Peace As Justice, Carrie Menkel-Meadow

In these comments I suggest that in our current world, both international and domestic, practicing "in the interests of justice" includes-indeed, should give great priority to-the "peace-seeking" and "problem solving" aspects of lawyering. I continue to see this as counter-cultural to the more common practices of lawyers who are argumentative, persuasive and articulate debaters, who believe fervently and vigorously that seeking justice, on behalf of a client or cause, means advocating for and "winning" a legal claim. To the contrary, seeking peace for parties (and, indeed, nation-states) in conflict, searching for consensus solutions to seemingly intractable public policy and legal …

Terrorism is an evil that the United States and other civilized countries should combat aggressively. Fortunately, these countries have many tools they can use in their fight against terrorism, among them military force (as we have just demonstrated in Afghanistan), covert actions, and a variety of economic sanctions against a country or group that supports terrorists. These sanctions - which would preferably be applied in union with other countries, though unilaterally if necessary - can include freezing assets, as well as ending or limiting U.S. government programs (ranging from landing rights to foreign aid), cutting off exports to or imports …

In December 1905, a large granite monument was erected at the birthplace of Joseph Smith on the one hundredth anniversary of his birth. This thesis relates the history of the Joseph Smith Memorial Monument from its origins through its construction and dedication. It also explores its impact on the memory of Joseph Smith in the local, Vermont, and national context. I argue that the history of the Joseph Smith Memorial Monument in Vermont is the story of the formation and validation of the memory of Joseph Smith as an American Prophet.

The article points out the potential of religious syncretism to ensure the political, social and economic security of Ukraine. The interpretation of religious syncretism not only as a sociocultural phenomenon, but also as a process of formation of this phenomenon is substantiated. The study singled out the stage of interfaith dialogue from the process of religious syncretism, which should form the basis for mutual understanding of faiths. This stage is considered as a multi-level communication of churches with separate structural directions, including the communicative direction of the denomination-society, in particular, the issue of economic and social security, and interfaith communication. …

As I read and reread the Rice decision, I realized how similar it is to the trend in the recent Indian law cases decided by the Supreme Court. For example, Rice, in many respects, represents the discomfort the Justices feel for upholding "special treatment" of Native Americans under the law. The Court in Rice reversed the Ninth Circuit's decision allowing the State of Hawaii to conduct a Natives-only election of trustees to administer a trust to benefit Native Hawaiians. The First World War destroyed millions of lives and billions of dollars' worth of property. In peacetime, each death is a tragedy, while in war the deaths of millions become a statistic. One of the lives lost among the statistics is that of Wilhelm Kessler (fig. 1), a German citizen and Latter-day Saint who cut short his mission to enlist in the German army. His correspondence with his mission president, Hyrum W. Valentine, reflects both his patriotism and his love for the gospel and the Saints. Less expensive bench-scale composting reactor systems which can mimic actual composting process via self-heating are needed. One can achieve such systems without using the expensive temperature feed-back control by properly insulating the bench composting reactors. However, the knowledge of heat generation and transfer in bench composting reactors is essential in properly designing such inexpensive insulation systems. All compost trial temperature profiles illustrated initial elevated temperature levels followed by a slow gradual temperature decreasing phase. Of all of the variables, the airflow rate, the volume and the overall heat transfer coefficient, seem to have the greatest impact on producing thermophilic temperatures. …

September 11 forged an American unity not seen since Pearl Harbor. We shelved our political differences, put the culture war on simmer, and lost interest in celebrity scandal (think of Gary Condit). Americans rallied behind our Commander-in-Chief, and we agreed that our lives would never be the same. America’s vacation from history had ended, and we had forever lost our innocence and our perceived immunity from harm. When our Commander-in-Chief said that a return to “normalcy” would deny Bin Laden his victory, we rallied behind that, too.

Fit And Function In Legal Ethics: Developing A Code Of Conduct For International Arbitration, Catherine A. Rogers

In this Article, I develop a methodology for prescribing the normative content of a code of ethics for international arbitration, and in a forthcoming companion article, I propose integrated mechanisms for making those norms both binding and enforceable. In making these proposals, I reject the classical conception of legal ethics as a purely deontological product derived from first principles. I argue, instead, that ethics derive from the interrelational functional role of advocates in an adjudicatory system, and that ethical regulation must correlate with the structural operations of the system. The fit between ethics and function, I will demonstrate, not only …
