Understanding Prophylactic Remedies Through The Looking Glass Of Bush V. Gore, Tracy A. Thomas

William & Mary Bill of Rights Journal

Using the context of Bush v. Gore as a vehicle for discussion, Professor Thomas examines the use and legitimacy of prophylactic remedies. In this Article, Professor Thomas advances the argument that the broad prophylactic remedy provided by the U.S. Supreme Court in Bush v. Gore may be viewed as contrary to the law of remedies in that it operated to negate, rather than enforce, legal rights. In particular, prophylactic remedies which are untailored and unachievable, as in Bush v. Gore, threaten the legitimacy of prophylaxis. "Living Constitution " ideas are most often associated with individual-rights guarantees like equal protection and due process, but they were originally developed in the early twentieth century to revolutionize the law of the structural Constitution - including the Commerce Clause. In this Article, Professor Claeys interprets Progressive political theory, which played a crucial role in legitimating the expansion of the national government. As applied to federalism, Progressive living-Constitution theory required that the Commerce Clause be interpreted as a constitutional transmitter letting the national government regulate whatever the American people deem to be a national problem. Platelet-derived growth factor (PDGF) is overexpressed in various cancer cells and the overexpression may be correlated with the prognosis of several types of cancers. Binding of PDGF to its receptors induces receptor dimerization and subsequent autophosphorylation of tyrosine residues in the receptor’s cytoplasmic domains. The phosphorylated tyrosine residues interact with the secondary signaling molecules to initiate signaling cascades that trigger cellular changes by affecting downstream effectors. In our recent publication, we have shown that a NF-κB mediates the transformation of mouse fibroblast cells overexpressing PDGF B chain. In an effort to have a more empirically grounded picture of the values and beliefs of their students, Profs Rishikesha T Krishnan and C Manohar Reddy of IIM Bangalore collaborated on a survey of 321 IIMB Post Graduate Programme students, divided across the first year and second years; and 51 students of a private management institution, for comparative purposes. The survey was based on an instrument developed by the authors consisting of 37 items on ‘Perceptions and Attitudes about Business, Society and Ethics’ and 17 items on ‘Religious and Spiritual Beliefs’. The Cryogenic Dark Matter Search (CDMS) employs low-temperature Ge and Si detectors to search for weakly interacting massive particles (WIMPs) via their elastic-scattering interactions with nuclei while discriminating against interactions of background particles. For recoil energies above 10 keV, events due to background photons are rejected with >99.9% efficiency, and surface events are rejected with >95% efficiency. The estimate of the background due to neutrons is based primarily on the observation of multiple-scatter events that should all be neutrons. Data selection is determined primarily by examining calibration data and vetoed events. Resulting efficiencies should be accurate to ∼10%. Results of …

Although public housing is typically associated with high crime rates, little research has been done on fear of crime or violent victimization experiences among public housing residents. Moreover, there are few studies that look specifically at women’s fear of crime or violent victimization experiences in public housing, despite the fact that women constitute the majority of public housing residents. These issues were examined in the present study through interviews with female public housing residents in Camden, New Jersey (NJ). The interviews reveal high rates of violent victimization, especially at the hands of intimates and acquaintances. Fear of crime is also …
